THE CITY OF BEL AIRE, KANSAS

AN ORDINANCE REGULATING THE USE OF LAND AND
THE LOCATION OF BUILDINGS WITHIN THE CORPORATE
LIMITS OF THE CITY OF BEL AIRE, KANSAS BY
INCORPORATING BY REFERENCE THE "CiTY OF BEL
AIRE ZONING ORDINANCE 2004," AS PREPARED AND
PUBLISHED IN BOOK FORM AND ADOPTED BY THE BEL
AIRE CITY PLANNING COMMISSION PURSUANT TO
ARTICLE 7 OF CHAPTER 12 OF THE KANSAS STATUES
ANNOTATED; ADOPTING BY REFERENCE AN OFFICIAL
MAP OF ZONING DISTRICT BOUNDARIES; AND
REPEALING ORDINANCES NUMBER 115, 212, 235, 280
AND ALL OTHER ORDINANCES IN CONFLICT HEREWITH.
WHEREAS, a duly advertised public hearing, as required by Kansas law, was held
on June 10, 2004 by the Bel Aire City Planning Commission concerning zoning regulations
prepared and published in book form and entitled "City of Bel Aire Zoning Ordinance 2004";
and
WHEREAS, subsequent to said public hearing, the Bel Aire City Planning
Commission adopted said zoning regulations entitled "City of Bel Aire Zoning Ordinance
2004" and recommended the adoption of said "City of Bel Aire Zoning Ordinance 2004" by
the Governing Body of the City of Bel Aire, Kansas;
NOW THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY
OF BEL AIRE, KANSAS:
Section 1. Adoption
Zoning regulations are hereby approved and adopted by the Governing Body of the
City of Bel Aire, Kansas, as prepared and published in book form, adopted by the Bel Aire
City Planning Commission and entitled "City of Bel Aire Zoning Ordinance 2004". The "City
of Bel Aire Zoning Ordinance 2004" is hereby incorporated by reference as fully as if set
out herein.

Section 2. Official Map
Within Chapter 6 of the "City of Bel Aire Zoning Ordinance 2004" is incorporated by
reference and adopted an Official Zoning Map designated as the Zoning District Map and
delineating the boundaries of zoning districts and the classification of such districts. Said
Zoning District Map shall be marked "Official copy of zoning district map incorporated into
zoning regulations by adoption of Ordinance No.~ by the Governing Body of the City of
Bel Aire on the~day of :D e.r.:-. , 2004" and shall be filed with the City Clerk, to be open for
inspection and available to the public at all reasonable business hours.
Section 3. Jurisdiction
From the effective date of this Ordinance, the Zoning Regulations and Official
Zoning Map herein incorporated by reference shall govern all use of the land and the
location of buildings and other structures placed within the corporate limits of the City of Bel
Aire, Kansas.
Section 4. Official Copies
Not less than three copies of the "City of Bel Aire Zoning Ordinance 2004", as
adopted herein, shall be marked "Official Copy as incorporated by Ordinance No.~",
attached to a copy of this Ordinance and filed with the City Clerk to be open for inspection
and available to the public at all reasonable business hours.
Section 5. Invaliditv of a Part
Any provisions of this Ordinance which shall be declared by a competent court to be
unconstitutional or invalid shall not affect the validity and authority of any other sections of
said Ordinance.
Section 6. Repeal
In that the floodway management provisions of Ordinance Number 115 are now
incorporated in the "City of Bel Aire Zoning Ordinance 2004", Ordinances Number 115,
212, 235 and 280 are hereby repealed. Any other ordinances or parts of ordinances in
conflict with this Ordinance are hereby repealed.
Section 7. Effective Date
This Ordinance shall take effect and be in force from and after its publication in the
official city newspaper.
