the Bethlehem Lutheran Church, 5319 Halifax, followed by the

5. APPROVAL OF MINUTES: Regular meeting of Sept. 7, 1965.
Councilman Nunamaker moved to approve the minutes of the regular
Council meeting of September 7, 1965, as mailed, Councilman
Merritt seconded, and the motion was unanimously carried.
UNFINISHED BUSINESS:
6. ORDINANCE NO. 65 -162: 2nd read. Re Off-Street Parking Exemptions.
City Attorney Martin presented Ordinance No. 65 -162 and read
title AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTION
1609 AND ADDING NEW SECTION 1610 TO THE ZONING CODE, ARTICLE IX
OF THE TEMPLE CITY MUNICIPAL CODE, RELATING TO COMPREHENSIVE
PLANNED FACILITIES FOR PARKING. Councilman Tyrell moved to waive
further reading of Ordinance No. 65 -162, Councilman Nunamaker
seconded, and the motion carried unanimouslyy. Councilman Tyrell
moved to adopt Ordinance No. 65 -162, Councilman Nunamaker second-
ed, and the motion was unanimously carried.
ORDINANCE N0...65 -175: 2nd read. Incorporation of Ord. #151 and
Ord. #153 into Municipal Code.
City Attorney Martin presented Ordinance No. 65-175 and read
title AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING THE ZONING
CODE OF THIS CITY BY INCORPORATING THEEIN BY REFERENCE ORDINAN-
CES #65 -151 AND #65 -153 PREVIOUSLY ADOPTED. Councilman Tyrell
moved to waive further reading of Ordinance No. 65 -175, Council-
man Dickason seconded, and the motion carried unanimously. .Coun-
cilman Tyrell moved to adopt Ordinance No. 65 -1.75, Councilman
Nunamaker seconded and the motion carried unanimously.
8. ORDINANCE NO. 65 -172: 2nd read. Re Charitable Solicitations.
City Attorney Martin presented Ordinance No. 65 -172 with correc-
tions and read title AN ORDINANCE OF THE CITY OF TEMPLE CITY
ADDING A NEW CHAPTER 4 TO ARTICLE IV OF THE TEMPLE CITY MUNICIPAL
CODE RELATING TO THE REGULATING OF CHI.RITABLE SOLICITATIONS AND
REPEALING SECTION 4260 OF THE TEMPLE CITY MUNICIPAL CODE IN CON-
NECTION THEREWITH. Councilman Tyrell moved to waive further
reading of Ordinance No. 65 -172, Councilman Nunamaker seconded,
the motion was unanimously carried. Councilman Tyrell moved to
adopt Ordinance No. 65 -172 as corrected, Councilman Nunamaker
seconded and the motion carried unanimously.
9. ORDINANCE NO. 65 -174: 2nd read. Relating to Building Permits
City Attorney Martin read title to Ordinance No. 65 -174 AN ORDI-
NANCE OF THE CITY COUNCIL_ OF THE CITY OF TEMPLE CITY ADDING NEW
SECTIONS 8103, 8104, AND 3105 TO THE TEMPLE CITY MUNICIPAL CODE
RELATING TO BUILDING PERMIT'S. Councilman Tyrell moved to waive
further reading of Ordinance No. 65 -174, Councilman Dickason
seconded, and the motion was unanimously carried. Councilman
Nunamaker moved to adopt Ordinance No. 55 -174, Councilman Tyrell
seconded, and the motion was unanimously carried.
10. ORDINANCE NO. 65 -177: 2nd read. Re purchasing procedure
City Attorney Martin read title to Ordinance No. 65 -177 AN ORDI-
NANCE OF THE CITY OF TEMPLE CITY AMENDING SECTION 2609 OF THE
TEMPLE CITY MUNICIPAL CODE. Councilman Dickason moved to waive
further reading of Ordinance No. 65 -177, Councilman Tyrell se-
conded, and the motion was carried unanimously. Councilman

Merritt moved to adopt`.Ordinance No. 65 -177, Councilman Nunamak-
er seconded, and the motion was unanimously carried. The City
Attorney explained this provides for purchases of equipment,
supplies, etc., for City Hall and equipment therewith, which can
be purchased by the City Manager by oral or written bids.
PUBLIC HEARING: 7 :30 P. M. CURB & GUTTER:
(a) Lower Azusa, south side, Temple City Blvd. to Ellis Lane
(b) Temple City Blvd., east side, Broadway to Live Oak
(c) Pentland, north side, Alessandro to Encinita
Councilman Nunamaker moved to open the public hearing on items
(a), (b), and (c), Councilman Tyrell seconded, and the motion
was carried unanimously. Acting City Manager Koski referred to
item (a) and advised that curb and gutter is now installed in
excess of 50%. Also that all the property to be assessed is in
the City of El Monte, and we must have the consent of that City
before the curb, gutter and driveways can be installed. He re-
commended the hearing on item (a) be held over until the next
Council meeting in lieu of this consent from El Monte. Council-
man Tyrell so moved, Councilman Nunamaker seconded, and the
motion carried unanimously.
(b) Temple City Blvd., east side Broadway to Live Oak.
Acting City Manager Koski stated under item (b) that 67.6% of the
lineal front footage was represented in this petition. Mayor
Harker asked if anyone in the audience wished to speak for or
against this installation and no one came forward to speak.
Councilman Merritt moved to close the public hearing on item (b)
Councilman Tyrell seconded, and the motion carried unanimously.
Councilman Nunamaker moved to approve the installation and to
direct the Supt. of Streets to cause the work to be done, Coun-
cilman Tyrell seconded, and the motion was unanimously carried.
(c) Pentland, north side, Alessandro to Encinita
Acting City Manager Koski stated the petition for the installa-
tion represented 83.64% of the lineal front footage of the area
involved. The Mayor asked if anyone wished to speak for or
against this installation.
Mr. Bellevue, 9217 Pentland, stated he operated a business at
this address and he was opposed to the installation as he felt
it would interfere with the present parking on the right of way.
Mayor Harker asked if anyone else wished to speak and no one
came forward. Councilman Nunamaker moved to close the public
hearing on item (c), Councilman Merritt seconded, and the motion
carried unanimously. Following discussion Councilman Merritt
moved to approve the installation and to direct the Supt. of
Streets to cause the work to be done, Councilman Dickason se-
conded, and the motion was unanimously carried.
PUBLIC HEARING: CURB, GUTTER & SIDEWALK: Broadway, T.C. Blvd. - Cloverly
north side
Councilman Merritt moved to open the public hearing, Councilman
Nunamaker seconded, and the motion carried unanimously. Acting
City Manager Koski stated one petition for the curb and gutter
was signed by 91% of the lineal footage, and 91% also on the pe-
tition for sidewalks. Mayor Harker asked if anyone in the aud-
ience wished to speak on this installation. Mrs. Kelder, 9537
E. Broadway, requested information and stated she was much in
Favor of the improvement. No one else came forward to speak at
this time. Councilman Nunamaker moved to close the public hear=
ing, Councilman Tyrell seconded, and the motion carried unanimous
ly. Councilman Merritt moved to approve the installation and to
direct the Supt. of Streets to cause the work to be done, Coun-
cilman Dickason seconded, and the motion was unanimously carried.
NEW BUSINESS:
11. RESOLUTION NO. 65 -520: re appointment to Selection Committee of
So. Calif. Rapid Transit District - A. L. Nunamaker
The Acting City Manager read title to Resolution No. 65 -520 A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIF-
ORNIA, APPOINTING A MEMBER OF SAID COUNCIL OF SAID CITY TO THE
CITY SELECTION COMMITTEE PURSUANT TO PART 3 OF DIVISION 10 OF
THE PUBLIC UTILiTfES CODE, Councilman Tyrell moved to adopt
Resolution No. 65 -520, Councilman Merritt seconded, the motion

was unanimously carried.
12. AMENDMENT TO COUNTY STREET MAINTENANCE AGREEMENT:
The Acting City Manager explained this amendment was to adjust
the overhead rates as determined by the Road Dept. and the Audi-
tor Controller, to 14% general and 6% county overhead. Council-
man Dickason moved to approve and authorize the Mayor and City
Clerk to sign on behalf of the City, Councilman Merritt seconded,
and the motion was carried unanimously.
13. RESOLUTION NO. 65 -517: Authorizing acquisition of property for
Parking District No. 4
City Attorney Martin read title to Resolution No. 65 -517 A RESO-
LUTION OF THE CITY COUNCIL OF THE C!TY OF TEMPLE CITY, FINDING
AND DETERMINING THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESS-
ITY REQUIRE THE ACQUISITION OF THE FEE INTEREST IN AND TO CERTAI1r'
REAL PROPERTY FOR PUBLIC BUILDINGS AND GROUNDS, TO WIT: OFF
STREET PARKING FACILITIES, Councilman Merritt moved to adopt
Resolution No. 65 -517, Councilman Dickason seconded, and the
motion was unanimously carried.
14. LAND ACQUISITION APPRAISAL, PARKING D I ST. No. 4
City Attorney Martin stated that the acquisition just authorized
by Resolution No. 65 -517 would necessitate hiring an appraiser
and he recommended Thomas 0. Berge be hired for the appraisal
at a fee of $325.00. Councilman Tyrell moved to approve the
hiring of Mr. Berge at a cost of $325.00, Councilman Nunamaker
seconded, and the motion carried unanimously.
15. PLANNING COMMISSION RECOMMENDATIONS: Re adoption of Ordinance
No. 65 -163 concerning tea rooms, cafes, etc., which are selling
on -sale alcoholic beverages.
The City Attorney recommended a public hearing be scheduled for
consideration of Ordinance No. 65 -163 which would amend the
zoning ordinance and a public hearing for this purpose is requir-
ed by law. Councilman Nunamaker moved to set a public hearing
for Oct. 5, 1965, at 7:30 P. M., Councilman Tyrell seconded, and
the motion was unanimously carried.
16, PARKS & RECREATION COMMISSION RECOMMENDATIONS:
a. Request for waiver of fee for use of the Auditorium at Live
Oak Park by the T. C. Jaycees. The Parks & Recreation Com-
mission recommend denial for waiver of fee based on park
policy of hourly fee being charged during hours when the
Park is not normally open.
Following discussion Councilman Merritt moved to approve the re-
commendation of the Parks & Recreation Commission and deny the
waiver of fees, Councilman Dickason seconded, and the motion was
unanimously carried.
b. Request for use of L. 0. Park facilities from American Youth
Soccer Organization Oct. 23/65 through March, 1966. Approv-
al recommended subject to city insurance requirements and no.
interfering with existing recreation programs.
Councilman Nunamaker moved to approve the recommendation of the
Parks & Recreation Commission, Councilman Dickason seconded, and
the motion was unanimously carried.
c. Request for sale of programs & refreshments at L. 0. Park
frcm Pop Warner Assn. Commission recommends approval.
Councilman Tyrell moved to approve, Councilman Nunamaker seconded .
and the motion was unanimously carried.
170. AGREEMENT BETWEEN COUNTY OF LOS ANGELES & CITY OF TEMPLE CITY:
re Improvement of Broadway between Rosemead & Muscatel.
The Acting City Manager presented the proposed agreement to cover
this joint improvement with the County. Councilman Merritt moved
to approve the Agreement and to authorize the Mayor and City
Clerk to sign on behalf of the City, Councilman Dickason Second-
ed, roll call vote to carry the motion as follows:

18. AGREEMENT GROUND MAINTENANCE AT COUNTY BUILDING- County Library:
Acting City Manager Koski presented the proposed agreement to
the Council. Councilman Dickason moved to approve and to author•
ize the Mayor and City Clerk to sign on behalf of the City,
Councilman Merritt seconded, and the motion was unanimously
carried.
19. RESOLUTION NO. 65 -522: re Denial of Variance, Maranatha Chris-
tian High School.
City Attorney Martin presented Resolution No. 65 -522 and read
title A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE
CITY DENYING A VARIANCE AND REVERSING RESOLUTION NO. 65- 163PC.
Councilman Tyrell moved to adopt Resolution No. 65 -522, Council-
man Merritt seconded, and the Resolution was unanimously adopted.
20. SET ASSESSMENT PUBLIC HEARING: 4812 & 426 Temple City Blvd.,
$87.50 and $50.00.
Councilman Tyrell moved to set for hearing on October 5, 1965,
at 7:30 P. M., Councilman Merritt seconded, and the motion was
carried unanimously.
21. RESOLUTION NO. 65- 521: Jarrants & Demands
Acting City Manager Koski presented Resolution No. 65 -521, tWar-
rants & Demands No. 7063 through No. 7082, in sum of $17,349.79.
Councilman Merritt moved to adopt Resolution No. 65 -521, Coun-
cilman Dickason seconded, and the motion was carried by the
following roll call vote:
AYES: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker
NOES: Councilmen -None
ABSENT: Councilmen -None
22. APPROVAL OF PLANS & SPECIFICATIONS & AUTHORIZATION TO GO TO BID
FOR LANDSCAPING ON DOUBLE DRIVE.
Acting City Manager Koski advised Krelle & Lewis had provided
the plans and specifications for the landscaping improvements on
Double Drive, and presented the plans and specifications to the
City Council. Following discussion Councilman Tyrell moved to
approve the plans and to authorize going to bid on the improve-
ment, Councilman Merritt seconded, and the motion was unanimous-
ly carried.
23.. COMMUNICATIONS:
a. request for charitable solicitation permit from United
Church Women for UNICEF on Oct. 30, through trick or treat
program. Councilman Dickason moved to approve, Councilman
Nunamakerseconded, and the motion was unanimously carried.
b. request for Proclamation for "Lock Your Car Week" Sept. 27
through Oct. 3. 4ith the approval of the Council, Mayor
Harker so proclaimed.
c. request for use of L. O. Park by Kiwanis for Kids Day, also
to sell refreshments, and to hang two street banners Sept.
20 through Sept. 27. Following discussion Councilman Tyrell
moved to grant subject to liability insurance requirements, Coun-
cilman Nunamaker seconded, and the motion was carried unanimously .
d. request for charitable solicitation permit for St. Judes
Children's Research Hospital on Oct. 24, 1965 from 2 to Lo- P.M
Councilman Nunamaker moved to approve, Councilman Merritt second-
ed, and the motion was carried unanimously.
e. L. A. County Boundary Commission re proposed annexations #43
& #44, City of Monrovia. Councilman Merritt moved to receive
and file, Councilman Nunamaker seconded, and the motion was unan-
imously carried.
24. TIME FOR THOSE I N THE AUDIENCE WHO WISH TO SPEAK:
No one came forward to address the Council at this time.
25. MATTERS FROM CITY OFFICIALS:
Councilman Nunamaker reminded the Council of the Sister City
invitation to the ice cream social on Sept. 26 from 4 to 7 P. M.
in Temple City Park.

City Attorney Martin presented Resolution No. 65 -524 to start
proceedings for acquisition of land for a public park and read
title A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY,
FINDING AND DETERMINING THAT THE PUBLIC INTEREST, CONVENIENCE AND
NECESSITY REQUIRE THE ACQUISITION OF THE FEE INTEREST IN AND TO
CERTAIN REAL PROPERTY FOR PUBLIC BUILDINGS AND GROUNDS, TO WIT:
PUBLIC PARK PURPOSES. Councilman Tyrell moved to adopt Resolu-
tion No. 65 -524, Councilman Nunamaker seconded, roll call vote
to carry the motion as follows:
AYES: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker
NOES: Councilmen -None
ABSENT: Councilmen -None
The City Attorney recommended in connection with Parking District
No. 1 that the purchase be completed by the City of the Young
property in the amount of $61,812.82. Councilman Nunamaker so
moved, Councilman Merritt seconded, and the motion carried by
the following called vote:
AYES: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker
NOES: Councilmen -None
ABSENT: Councilmen -None
City Attorney Martin presented Resolution No. 65 -525 authorizing
the advance from the general fund to complete the above purchase.
Councilman Tyrell moved to adopt Resolution No. 65 -525, Council-
man Dickason seconded and the motion carried unanimously.
The City Attorney stated the City has been collecting $150. per
month rent on one of the properties in Parking District #1 and
he recommended it be general fund monies and that this money
should apply against the funds the City has paid. City Treasurer
Buchan stated the City has been paying monthly payments and inter-
est out of general funds and this would be one way to reimburse
the City. Councilman Dickason moved to Follow the City Attorney's
recommendation and that the $150. per month be credited to gener-
al funds and not to the Parking District, Councilman Tyrell se-
conded and the motion was unanimously carried.
City Attorney Martin stated it was still his recommendation that
a settlement be made on the acquisitions in Parking District #3.
Councilman Nunamaker moved to advance the money to get Parking D
District #3 under way, Councilman Tyrell seconded. The City
Attorney stated the 30 day escrow requested should start as of
this date, and the Acting City Manager recommended the payment
be contingent upon reimbursement of the funds advanced to Parking
District #1. The motion was carried unanimously. City Attorney
Martin presented Resolution No. 65 -526 authorizing the advance
of funds for the acquisitions in Parkins District #3. Councilman
Nunamaker moved to adopt Resolution No. 65-526, Councilman Tyrell
seconded, and the motion carried by the Following called vote:
AYES: Councilmen- Dickason, Nunamaker, Tyrell, Harker
NOES: Councilmen -None
ABSENT: Councilmen-None
ABSTAINING: Councilman- Merritt
Acting City Manager Koski presented a request from the School
District for use of four bleachers to be used at the T. C. High
School, the District to pick them up and return in good condi-
tion. Councilman Tyrell moved to grant, Councilman Nunamaker se-
conded, and the motion carried unanimously.
Mr. Koski presented a request from the T. C. Lions Club to place
a banner across Las. Tunas jct. 4 -18 advertising their annual
breakfast on Oct. 17. Councilman Tyrell moved to grant subject
to the insurance requirements, Councilman Merritt seconded, and
the motion carried unanimously.
Mr. Koski presented Resolution No. 65 -523, a warrant in the sum
of $04.90 against the Parking Dist. Imp. Fund #2 to the Tax
Collector. Councilman Nunamaker moved to adopt Resolution No.
65 -523, Councilman Tyrell seconded, and the motion was unanimous-
ly carried.
The Acting City Manager presented the requirements for a Planning
Director, salary range $755. - $940., the position under the dir-
ection of the City Manager, and working with the Planning Commis-
sion and City Council. Following discussion Councilman Tyrell

moved to have this published to find a Planning Director subject
to these specifications, Councilman Merritt seconded, and the mot;
motion carried unanimously.
The Acting City Manager presented an additional warrant payable
to John Bloeche in the amount of $172.50, a park employee in the
Recreation Dept. who has returned to school. Councilman Merritt
moved to approve, Councilman Tyrell seconded, and the motion was
unanimously carried.
Mayor Harker presented a letter from the P. T. A. Assn. request-
ing Oct. 4 -10 be proclaimed as P. T. A. Membership Week. Coun-
cilman Merritt moved to have the Mayor so proclaim, Councilman
Dickason seconded, and the motion carried unanimously.
Mayor Harker at this time asked Mrs. Grace Vett in the audience
if she wished to address the Council as she had not done so at
the time for those in the audience who wished to speak. She came
forward and protested to the Council concerning their action on
Sept. 7 reinstating the building permits on the Graham property
at 5434 Temple City Blvd. Following a lengthy discussion between
Mrs. Vett and the City Council, Councilman Nunamaker moved to
refer this matter back to the Planning Commission, Councilman
Merritt seconded. Councilman Tyrell stated he felt there was
nothing to be accomplished by this action, that the Planning
Commission will be on record one way or the other, and it will
be appealed back to the Council. That it was just more paper
work and just prolonging an unfortunate position. Roll call vote
to carry the motion as follows:
AYES: Councilmen- Dickason, Merritt, Nunamaker, Harker
NOES: Councilmen - Tyrell
ABSENT: Councilmen -None
26. ADJOURNMENT: Councilman Merritt moved to adjourn to the next re-
gular Council Meeting on Oct. 5, 1965, seconded and carried.
Council adjourned at 9 :15 P. M. Next regular meeting on October
5, 1965, in the Council Chambers of the City Hall, 5938 Kauffman
Ave., Temple City,. at 7 :30 P. M.
