COUNCIL RESOLUTION NO.23-2008
A RESOLUTION OF SUPPORT FOR THE APPLICATION OF THE INTERNATIONAL
PROPERTY MAINTENANCE CODE TO A SPECIFIC ABANDONED PROPERTY AND
RECOGNIZING THE AUTHORITY OF STAFF TO PROCURE THE SERVICES OF A
QUALIFIED CONTRACTOR FOR THE REMOVAL OF STRUCTURES
WHEREAS, the City of Moab ("City"), adopted the International Property Maintenance Code
("Code") on December 11, 2007, for regulating and governing the conditions and maintenance of all
property, buildings and structures; by providing the standards for supplied utilities and facilities and other
physical criteria and conditions essential to ensure that structures are safe, sanitary and fit for occupation
and use; by providing for the condemnation of buildings and structures unfit for human occupancy and
use, and the demolition of such existing structures as herein provided; and by providing for the issuance
of permits and collection of fees therefore; and
WHEREAS, Brad and Andrea Hatt of 2840 Sunnybrook Lane, Idaho Faits, ID 83404, as the
owners of property ("Owners") located at 301 South Main Street, Moab, Utah, have repeatedly been
notified of violations of various Code provisions and have made no attempt to correct the non -conforming
situations; and
WHEREAS, this is the first such abatement of an abandoned structure under the newly adopted
Code; and
WHEREAS, the City has served due and proper notice under the International Property
Maintenance Code for the correction of deficiencies including the deteriorated and abandoned condition
of the structure located on said property; and
WHEREAS, the Owners have not replied to the notices for appeal options and other deadlines
associated with the correction of the conditions relating to the structure; and
WHEREAS, the Owners have not taken steps to mitigate the blighted condition of the structure
and property; and
NOW, THEREFORE, BE IT RESOLVED BY THE MOAB CITY COUNCIL, that ("Council') hereby
directs Staff to proceed with the demolition of said structure as allowed by the International Property
Maintenance Code, and authorizes Staff to procure the services of a qualified contractor, according to the
City's standard purchasing policy and procedures, for the removal of said structure at the above
referenced location.
PASSED AND ADOPTED by action of the Moab City Council in open session this 22nd day of
July, 2008.
