A RESOLUTION TO ACCEPT PAYMENT FROM THE CLEAR CREEK MOBILE
HOME PARK FOR SETTLEMENT OF AN OUTSTANDING DELINQUENT UTILITY
ACCOUNT AND APPROVAL OF THE DISMISSAL OF LAWSUIT FILED AGAINST
THE CLEAR CREEK MOBILE HOME PARK ON BEHALF OF THE CITY OF TIFFIN
WHEREAS the City of Tiffin, Iowa has filed a lawsuit against the,Clear-Creek Mobile
Home Park and its owner, Jim Riggan, for recovery of an outstanding delinquent utility
account owed to the City of Tiffin, Iowa.
NOW, THEREFORE, BE IT RESOLVED by the City of Tiffin, Iowa to accept payment
from the Clear Creek Mobile Home Park for the amount of $35,000 on this 27th day of
May 2009 as final payment for the delinquent utility account and to dismiss the lawsuit
filed against the Clear Creek Mobile Home Park and its owner Jim Riggar.
Motion- has been made by Council person Wright and seconded by Council person
Bartels to approve the payment in the amount of $35,000 and to dismiss the lawsuit
against the Clear Creek Mobile Home Park and its owner Jim Riggan, upon receipt of
the payment to Mayor Royce Phillips and City Clerk Ruth Demuth.
AYES: Chris Ball, Jim Bartels, Mike Gericke, and John Wright
NAYS: None
ABSENT: Marie Petersen
Mayor Royce Phillips declares this Resolution 2009-13 has been approved and passed
this 27th day of May 2009.
