HomeMy Public PortalAboutRES-CC-2008-27CITY OF MOAB COUNCIL RESOLUTION NO.27-2008 A RESOLUTION APPROVING AN EXPANSION OF THE HISTORIC JOHN W. "DOC" WILLIAMS HOME AT 40 WEST 100 NORTH WHEREAS, Kara Dohrenwend and Ray Williams as owners (Owners/Applicant) of record of the property located at 40 West 100 North, Moab Utah 84532, in accordance with Code Chapter 17.90(h)(2), have applied to the City of Moab for a conditional use permit to expand the historic "Doc„ Williams home located at the above described location; and, WHEREAS, the applicants in accordance with have provided the required submittals of Code Section 17.09.530, Conditional Uses, to be reviewed by City Staff (Staff) and the Moab City Council (Council); and, WHEREAS, the City adopted section 17.90 in an effort to encourage the preservation "and enhance the historic quality and character of Moab and surrounding area, and to recognize and maintain the attractiveness of older residential neighborhoods and of the central business district that presents a "sense of place" unique to Moab."; and, WHEREAS, Council reviewed the proposed expansion to said historic structure in a public meeting held on August 26, 2008, to determine the appropriateness of the expansion and if the proposal satisfies the review criteria of Chapter 17.90(h)(1) a-g to determine the compatibility of the proposed alteration; and, WHEREAS, Council adopted Resolution No. 27-2008, subsequent to said review, and found that the property does meet the appropriate criteria for the design and renovation of the structure and that the architecture of the addition: a. Had little effect upon the general historical and architectural character of the structure and property; b. The architectural style, arrangement, texture and material used on the existing and proposed structure and their relation were compatible with other architectural elements of the existing home; c. The size of the structure, its setbacks, its site, location were appropriate when compared to existing structure and the site; d. There was little effect of the proposed work in creating, changing, destroying, or otherwise impacting the exterior architectural features of the structure upon which the work is proposed; e. The existing improvements are not a hazard to public health and safety; f. The proposed work upon the structure is essential for the protection, enhancement, perpetuation and use of the property. WHEREAS, Council has determined that the application meets or exceeds the conditions of approval outlined in Chapter 17.09.530 (h), Conditions of Approval, as well as Chapter 17.90(h)(2), Historic Preservation Conditions of Approval. NOW, THEREFORE, BE IT RESOLVED BY THE MOAB CITY COUNCIL, that the proposed addition to the historic structure located at 40 West 100 North, Moab Utah, is hereby approved the first historic designation and shall be entered into the registry as maintained by the City Recorder.
