IONA COMMUNITY CENTER PRESENT: Mayor Brad Andersen, Council President Jane Shaw, Council member Dennis McArthur, Council member Dan Gubler, Council member Bruce Case, Public Works Supervisor Zech Prouse, Police Chief Shannon Basaraba, City Clerk Robyn Keyes. VISITORS: Steve Serr, Angie Schreier, Barbara Schreier, Dana Izatt. Reports: Public Works Supervisor Prouse said he was working with Attorney Storer regarding the amendments to the development agreement for David Bigelow. Mayor Andersen entertained the notion of completing the upgrades for extending Denning Avenue in the near future. Supervisor Prouse said the Safe Routes to School (SR2S) project would begin as soon as the weather permitted. The signs for the flashing lights would be placed on the west end of 6-12 property and on the east end of the fence on the Ashwood Acre townhouses. County Zoning Discussion. Mayor Andersen welcomed Steve Serr from Bonneville County Planning and Zoning and explained that Mr. Serr was invited to discuss some issues the County had with the City zoning ordinances. Mr. Serr said a City planning and zoning member had gone in to talk with him regarding the impact area, and while looking at the City's zoning ordinances Mr. Serr noted some issues with the City's zoning. Mr. Serr said the City could not require an attached garage for manufactured homes unless it required attached garages for all homes in Iona. By only requiring manufactured homes to have an attached garage, that was considered a discrimination. The City could not discriminate against an individual or class. Mr. Serr said the City needed to offer varying residential zones, the description and requirements for each zone needed to be unique with distinguishable differences, and home size could not be dictated as long as the set back requirements were met. Mr. Serr said the developer could set requirements and regulations; and recommended the City did not look at the developer's restrictive covenants so the City could make an unbiased agreement with the developer. Mr. Serr recommended the City look at different open space options within the different zones and perhaps reconfigure the front and side set back requirements. 1 Mr. Serr said as per the impact agreement, the County was honoring the City's zoning ordinances for developments within the City's impact area. 10 years ago the City and County got together to decide on the types of zones that would be allowed so there was continuity with roads, and standards between the two areas. An impact agreement was made and the County modified its zones within the City's impact area. Mr. Serr said the County encouraged individuals who were contiguous to the City to hook onto City water and district sewer. Council member Gubler asked what the County did with people who were contiguous with the City but did not want to hook onto City water. Mr. Serr said the County did not force them to hook onto the services. Mr. Serr said if a homeowner who was not contiguous with the City wanted to hook onto City water, the homeowner was responsible for the cost of running the line. Mayor Andersen thanked Mr. Serr for his time and asked Council member Gubler to meet with the Planning and Zoning commission regarding the information from Mr. Serr. Mr. Serr asked the Council if they were present during the Planning and Zoning public hearings. Mayor Andersen said there had been one time a Council member had been present for other purposes and should have left during the hearing, but all of the Council now understands they cannot be present during a Planning and Zoning public hearing.
