THIS ADDENDUM, (Number 1 to Contract No. 165-2009) is made and entered into this _29th _ day
of _December 20_09 , by and between Richmond, Indiana, a municipal corporation acting through its
Board of Public Works and Safety with its office at 50 North 5th Street, Richmond, Indiana, (hereinafter referred
to as "City"), and Mike DeLucio & Son, Inc., 3436 Chester Boulevard, Richmond, IN 47374 (hereinafter referred
to as "Contractor").
WHEREAS, City and Contractor entered into Contract No. 165-2009 on December 3, 2009 and
Contractor has commenced with the demolition and removal services set forth in that
Contract; and
WHEREAS, Pursuant to Indiana Code 36-1-12-18 if, during the course of the public work project, it
becomes necessary to change or alter the original specifications, a change order that adds,
deletes, or changes an item in the original contract will become an addendum that is
required to be approved and signed by the board and the contractor; and
WHEREAS, City and Contractor agree that, due to unforeseen circumstances necessitating an
alteration of the original specifications, the scope of the project set forth in Contract No.
165-2009 should be amended; and
WHEREAS, City wishes to retain Contractor to continue providing services within the scope of
Contract No. 165-2009 as altered by this Addendum.
NOW, THEREFORE, in consideration of the mutual promises and covenants herein contained, including
the above stated recitals, City and Contractor hereby agree as follows:
The City and Party executed and entered into Contract No. 165-2009, on December 3, 2009.
Contract No. 165-2009 is attached hereto, marked as Exhibit "A" and incorporated by reference.
The scope of the project set forth in Contract No. 165-2009 shall be altered and amended as
follows:
a. Contractor shall continue to remove all debris associated with the demolition Contractor
has performed to date;
b. Contractor shall cease all demolition of the basement portion of the structure over which
the cistern is located;
Contractor shall construct a fence on the perimeter of the building footprint of the project
site to fully surround and enclose the building footprint and basement area, taking into
consideration the slope and grade of the basement and adjacent land;
d. Contractor shall construct and place metal covers to place over the opening of any well or
cistern located beneath the demolished material or basement portion; and
Contractor shall construct and place metal covers to place over the opening of any tunnel
or entrance located adjacent to the basement structure.

Both parties hereby agree that the additional items to be performed in this Addendum shall be
performed in the same workman like manner and under the same conditions and terms set forth in
Contract No. 165-2009.
Both parties hereby agree that the Contractor shall be paid an additional sum not to exceed Five
Thousand Five Hundred Eighty Dollars and Zero Cents ($5,580.00) in addition to the amount set
forth in Contract No. 165-2009 for a grand total amount not to exceed Seventeen Thousand
Eight Hundred Sixty Dollars and Zero Cents ($17,860.00) for complete and satisfactory
performance of the work required under this Addendum and under Contract No. 165-2009.
Both parties hereby agree that with the exception of the above additions and alterations to the
scope of the project being performed by Contractor under Contract No. 165-2009 and the
additional payment to Contractor under this Addendum, Contract No. 165-2009 shall remain
intact and unchanged.
IN WITNESS WHEREOF, this Addendum is executed and approved by the undersigned representatives
of the City and Contractor this , day of 20 to be effective immediately.
