July 25, 2000

Mayor Johnson called the hearing to order at 7:03 PM and passed the gavel to Planning
Board chair Gill.
ITEM #2: Hauth introduced the Whitted request to rezone nearly one acre on NC 57 from Residential
40 to Residential 20. She indicated the zoning on surrounding properties, which are a
mixture of R-40 and R-20. Callemyn, representing Whitted, noted that the adjacent Whitted
tract is zoned R-20 and uniform zoning is needed to know what potential the entire tract has
for development. Sheridan asked the number of lots that might be allowed with the
rezoning. Hauth said a maximum of eight, but reaching than would be difficult if a road is
needed. Callemyn noted that the topography would make connection by gravity to the
existing sewer an important factor.
ITEM #3: Hauth introduced the Turner request to rezone the lot at the corner of South Churton and
J.J. Freeland Memorial Drive from General Commercial to High Intensity Commercial. She
reminded the members of the commercial re -write in the mid-1990s in which HIC was
created. She said the owner had come forward at that time to rezone this tract, as had most
of the neighbors. At that time, it was unclear that a driveway access from Freeland Drive
would be available and there was no proposed use of the site. Wilson, representing
Biscuitville, spoke on behalf of the application. He said his company's interest in the site is
what prompted Ms Turner to submit an application. He noted that a drive-thru is critical to
their interest in the site as 60% of their business is through the drive-thru. He added that
half of the remaining customers come into pick up their meals & leave the site. He noted
that their hours of operation are from 6 AM to 2 PM. Sheridan asked how firm the
agreement is with the adjacent owner to get the driveway access and how important it is to
the operation. Wilson said the realtor has indicated the Daniel Boone Company is willing to
allow the driveway; the details have not been determined. Wilson added that the driveway is
very important to their interest in the site. Lloyd encouraged him to proceed with the
agreement before the Town Board decides the zoning issue. Mayor Johnson indicated
another option would be to work with NCDOT to pull the stop bars for the traffic signal
further from the intersection to allow better access to this corner site. He noted that
pedestrian traffic in the area needs to be accommodated because current conditions are not
safe.
Gill returned the gavel to Mayor Johnson, who adjourned the meeting at 7:20 PM.
