Mayor Harker called the regular meeting of the City Council to 2. order at 7:35 P. M. Invocation was given by Rev. Roger Hillis 3. of Westminster Presbyterian Church of Temple City. Mayor Harker then led the Pledge of Allegiance to the Flag. 4. ROLL CALL: PRESENT: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker ABSENT: Councilmen -None ALSO PRESENT: City Attorney Martin & Acting City Manager Koski 5. APPROVAL OF MINUTES: Regular Meeting of September 21, 1965. The Deputy City Clerk corrected item #20 of the minutes to read "2016" Temple City Blvd. and not "2026 ". Councilman Nunamaker moved to approve the minutes of September 21, 1965, as mailed with the above correction, Councilman Merritt seconded, and the motion carried unanimously. Councilman Nunamaker presented the Council and those in atten- dance with "sweet" treats which everyone enjoyed. UNFINISHED BUSINESS: PUBLIC HEARING: 7:30 P. M., curb & gutter, Lower Azusa, south side Temple City Blvd. to Ellis Lane. Councilman Dickason moved to re -open the public hearing, Council- man Nunamaker seconded, and the motion carried unanimously. Act- ing City Manager Koski reported that in this block there is ex- isting more than 50% of the curb and gutter. He stated jurisdic- tion was requested from the City of El Monte and he presented a Resolution of that city which gives Temple City jurisdiction for this proceedings. City Attorney Martin stated the resolution was in order. Mayor Harker then asked if anyone in the audiencE wished to speak for or against this installation. John Sarato, 9650 Lower Azusa Rd., stated he was not in favor of this installation at this time as he felt the cost was prohibi- tive as he estimated on his property it would cost him around $600. He stated the two adjoining properties to his were also opposed. Mr. Sarato was advised on his 63 ft. lot the curb and gutter cos :: would be in the neighborhood or $120. plus the cost of the drive- way apron, and this cost would be determined by its width Mr. Sarato also believed that the sidewalks were included in the im- provement at this time and was advised this was only for the cu;. and gutter installation and that the City assumed the paveout and engineering and specification costs in addition to the 50t per lineal foot rebate for those approving and paying the cost without going to assessment. Following further discussion and questioning Mr. Sarato, Council- man Merritt moved to close the public hearing, Councilman Dick- son seconded, and the motion carried unanimously. Acting City Manager Koski explained that this would solve the drainage pro- blem and complete the bloc!‹. PUBLIC HEARING: 7:30 P. M, re Restau n t.s, tea rooms, cafes, etc., serving on -sale alcoholic beverages (proposed Ord. #65.163) City Attorney Martin advised the Planning Commission has made a recommendation to the Council for ad:on t i on of nn ordinance amending the zoning code h i ch would require establishments of this nature within 200 'ft. of Ri, R2, or R3 to have a speci:,► use permit. He stated control cf bars, etc., is legally vested 8..10 Council Minutes, October 5, 1965, page 2 by the State in the Alcoholic Beverage Control and the cities hove little control over it and the ordinance at best is ques- tionable. Co!incilman Merritt moved to open the public hearing, Councilman Dickason seconded and the motion carried unanimously. Mayor Harker asked if anyone wished to speak for or against this recommendation. No one came forward to speak at this time. Coun- cilman Dickason moved to close the public hearing, Councilman Merritt seconded and the motion carried unanimously. City Attorney Martin read title to Ordinance No. 65 -163 AN ORDI- NANCE OF THE CITY OF TEMPLE CITY AMENDING SECTIONS 301 (35) AND 901 (35) AND ADDING SECTION 1300 (20) TO THE TEMPLE CITY MUNICI- PAL CODE. He advised this ordinance is in effect in San Marino, Downey, So. Pasadena, San Leandro and elsewhere. In San Leandro it was upheld in a court case. Councilman Tyrell:;tcoved.to read by title only and waive further reading, Councilman Nunamaker seconded, and the motion carried unanimously. No further action was taken as this was the first reading of the Ordinance. PUBLIC HEARING: 7:30 P. M. Curb & Gutter Assessment Hearing: 4812 & 4816 Temple City Blvd., $87.50 and $50. Acting City Manager Koski advised these two properties are on the east side of Temple City Blvd., northerly of Lower Azusa, and the owners have chosen not to pay. Councilman Merritt moved to open the public hearing, Councilman Dickason seconded, and the motion carried unanimously. The Mayor asked if anyone wished to speak for or against this assessment. No one came forward to speak. Councilman Merritt moved to close the public hearing, Councilman Nunamaker seconded, and the motion was unanimously carried. Councilman Dickason moved to approve the assessment and direct the property be so assessed, Councilman Merritt second ed and the motion carried unanimously. NEW BUSINESS: 6. RESOLUTION NO. 65 -527: appointing part time and temporary employ ees, Recreation Dept. Acting'City Manager Koski read title to Resolution No. 65 -527 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APP0!MT- ING PART -TIME AND TEMPORARY EMPLOYEES, Councilman Merritt moved to adopt Resolution No. 65 -527, Councilman Tyrell seconded, and the motion carried unanimously. 7. PLANNING COMMISSION RECOMMENDATIONS: re amending Zoning Ordinenc -, to establish permanent 35 ft. height limit on signs and advertis- ing structures (proposed Ordinance No. 65 -176) The City Attorney advised an interim ordinance had been passed on an emergency measure establishing height limit on signs, and the Planning Commission after study has come up with the same recommendation for a permanent ordinance. In amending the Zoning Ordinance a public hearing must first be held before adoption of the proposed Ordinance No. 65 -176 recommended by the Planning Commission. Councilman Tyrell moved to set a public hearing for October 19, 1965, at 7:30 P. M., Councilman Nunamaker seconded, and the motion carried unanimously. 8. SET NUM HEARINGS: CURB & GUTTER: a. Pal Mal Ave., west side, Daines Dr. to Olive b. Pal Mal Ave., east side, Daises Dr. to Olive Councilman Tyrell moved to set curb & gutter hearings for October 19, 1965, for items "a" and "b ", at 7:30 P. M., Councilman Merritt seconded, and the motion carried unanimously. 9. RESOLUTION NO. 65 -529: Giving notice of proposed annexation de- signated as Annexation #9, and setting public hearing for October 19, 1965, at 7:30 P. M. City Attorney Martin advised the Local Agency Formation Commissi- on had approved this uninhabited annexation and this Resolution was necessary to initiate proceedings. He read title to Resolu- tion No. 65 -529 A RESOLUTION OF THE CITY COUNCIL OF THE CiTY OF TEMPLE CiTY INSTITUTING PROCEEDINGS AND GIVING NOTICE OF THE PROPOSED ANNEXATION OF CERTAIN CONTIGUOUS TERRITORY DESIGNATED AS ANNEXATION NO. 9. This Resolution g=ves notice of public hear - ing on this proposed annexation to be held Octcber 19, 1965, at 7:30 P. M., in the Council Chambers at City Hall. Councilman Nunamaker moved to adopt Resolution No. 65 -529, Councilman 811 Council Minutes, October 5, 1965, page 3 Merritt seconded, and the motion carried unanimously. 10. PETITION: re Chapt. 27, Broadway; north side, requesting reloca- tion of a sidewalk from parkway sidewalk to curb sidewalk. Acting City Manager Koski presented a petition to the Council for sidewalks on the north side of Broadway between Temple City Blvd, and Cloverly requesting they be placed adjacent to the curb in- stead of at the property line as now approved by the City Counci He advised there were two trees, not very large, that would have to be removed if next to the curb. Considering the two schools and new condominum and due to the safety factor he recommended the sidewalks be placed at the property line. Following consid- erable discussion regarding the proposal, existing sidewalks, and recommendations, Councilman Merritt moved the staff contact these people suggesting the sidewalk be located at the curb side providing it is a 6 ft. sidewalk on Broadway, Councilman Dickason seconded, and the motion carried unanimously. The Council then discussed the sidewalks on Temple City Blvd. in connection with the condominum. Councilman Tyrell moved this be held over until the next meeting and give the Council an opportunity to look at the area before making a decision and the Council unanimously agreed. RESOLUTION NO. 65-528: 4arrants & Demands Councilman Merritt moved to approve Resolution No. 65 -528 war- rants and demands in the sum of $18,299.83, Nos. 7083, 7085 -7149, Councilman Dickason seconded, roll call vote to carry the motion as follows: AYES: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilmen -None 11. 12. COMMUNICATIONS: a, request for Charitable Solicitation permit for March of Dime!, for January, 1966, including Mile o'Dimes, Mothers March on Jan. 25, 1966, and to place coin collectors in retail stores beginning mid December to March 1, 1966. Councilman Tyrell moved to grant the request, Councilman Nunamak- er seconded, and the motion carried unanimously. Mayor Harker presented an invitation from the Rosemead Chamber of Commerce to the Council and citizens of Temple City to attend the 25th Anniversary Silver Jubilee, Rosemead Halloween & Ameri- can Heritage Parade on Saturday, Oct. 23, 1965, at 10 A. M. 13. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: No one came forward to speak at this time. 14. MATTERS FROM CITY OFFICIALS: Councilman Dickason suggested the Council consider an aesthetic type ordinance for the city, and cited for one thing people are parking cars on front yards, grass and on parkways. Councilman Nunamaker suggested the staff make a study concerning what should be planted in parkways as in some areas even where there are sidewalks the plantings over -run the area making it al- most impossible to walk on them. Councilman Dickason suggested possibly a program could be initiated similar to our curb and gutter program. Acting City Manager Koski stated in the signal installation pro- gram on Las Tunas Dr. the old control devices were salvaged and stored at the Road Dept. and he recommended they be sold with some other county surplus material which was approved. The Council was reminded of the Sheriff's open house on Oct. 30. The Council was asked about the refund of $125. to Mr. & Mrs. 4m. Graham, the fee paid by them in filing for variance on their . property at 5434 Temple City Blvd. Inasmuch as the Council had referred this matter back to the Planning Commission to re- consider, the Grahams' had requested the refund. The City Attorne, ruled there should be no refund unless they withdraw their appli- cation, and that a public hearing on the variance request is 812 1 1 1 Council Minutes, October 5, 1965, page 4 being processed and by the Council action it was reinstated. 15. ADJOURNMENT: Councilman Merritt moved to adjourn, Councilman Nunamaker seconded, and the motion carried unanimously.
