RESOLUTION NO. 69 -933
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TEMPLE CITY DENYING AN APPLICA-
TION.FOR MODIFICATION. (Case No. 69 -276)
(SHELL OIL COMPANY)
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES RESOLVE:
SECTION 1. The City Council hereby finds and determines
that the Shell Oil Company did heretofore submit an applica-
tion for construction of a new service station at 5505 North
Rosemead Boulevard; that the City Council, based upon the
recommendation of the Planning Commission therefor, did
grant said conditional use permit in the manner and means
set forth in Resolution 69 -908, attaching to such grant
several conditions, found by the City Council to be necessary
and appropriate to properly accommodate the new facility into
the neighborhood; that the applicant did heretofore file an
application for modification of said conditional use permit,
as granted, for the purpose of seeking relief from conditions
"(a)" and ":(b) ", reading as follows:
(a) that the entrance to hydraulic hoists and
lubrication area shall be reversed, and that
steam cleaning, automatic washing and repair
work shall be conducted within the enclosed
building; and
(b) that planting areas shall be provided and main-
tained substantially as shown on Exhibit "A ",
with the building reversed, and shall be
separated from asphaltic paving by a 6" high
curbing; and
finally that the City Council has heretofore held a public
hearing with respect to such application for modification,
and makes the findings and determinations hereinafter set
forth in Section 2, based:
1. upon the evidence adduced at such hearing;
2. upon the files, records and testimony pre-
viously presented at the conditional use
permit hearing; and
3. upon the 'personal observations of the
individual Councilmen of the site involved.
SECTION 2. The City Council hereby denies said applica-
tion for modification, and specifically requires the
applicant to comply with conditions "('a)" and "(b)" as set
forth in Resolution 69 -908 in conjunction with the performance
of all of the other previously accepted conditions set forth
in such Resolution. In requiring the applicant to comply with
conditions "(a)" and "(b)" (hereinafter referred to as
"reverse bays "), the Council finds and determines specifically
as follows:

1. That the requirement of reverse bays is not
unreasonable, as a general principle, for the reason
that several other oil companies, such as Standard
Oil, have indicated that reverse bays are modern,
proper and good market practice;
2. That a substantial percentage of service
stations developed in the San Gabriel Valley within
the past 12 months have been constructed with
reverse bays;
3. That several of the service stations recently
constructed in the Temple City area have been con-
structed with reverse bays;
4. That reverse bays are safer with respect to
traffic hazards in that cars do not enter or exit
from the bay in the vicinity of the pump islands;
that the congestion of cars in and around the pump
islands can lead to safety hazards;
5. That the reverse bays are aesthetically more
desirable from the standpoint that the customary
litter and discarded supplies and other equipment
are not open to view from the intersecting streets,
and thus uphold property values in the neighborhood
of such service stations to a better degree than
service stations with the front bay open and
revealing such activities;
6. That the reverse bay is more desirable
from a street traffic standpoint because the
activities within the building are not discern-
able thus causing distraction to the motorist;
7. That the persuasiveness of the foregoing
findings with respect to reverse bays, in general
is not attenuated in any way by the application of
such principles to the particular site involved
here in that:
(a) the foregoing findings would be
specifically and particularly applicable at
this location;
(b) the site is large enough to adequately
permit the reverse bays and auto access thereto;
(c) that whatever traffic hazards exist
with respect to a service station at this
location would be reduced by reversing the bays
as proposed by the City Council;

(d) that wherever possible this City
Council feels that commercial activities, and
in particular service activities should be
conducted within enclosed buildings; the
reversing of the bay at service stations
comes closer to this desired result than open
front bays.
SECTION 3. There being no new evidence or testimony
submitted at the modification hearing, the City Council
finds no reason to modify its earlier finding that the
reverse bay will best serve the public health, safety and
welfare of the residents of Temple City, and declares (as
a matter of policy) that reverse bays will be required in
all new service stations where feasible.
SECTION 4. The City Clerk shall certify to the adoption
of this Resolution.
