AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, DECLARING PORTIONS OF THE EAST CAPITOL AVENUE AREA AND ENVIRONS AS BLIGHTED AND DIRECTING THE CITY ADMINISTRATOR TO REQUEST THE LAND CLEARANCE FOR REDEVELOPMENT AUTHORITY TO AMEND THE URBAN RENEWAL PLAN ACCORDINGLY. WHEREAS, A "blight" study for the Capitol Avenue Study Area was commissioned by the Jefferson City Land Clearance for Redevelopment Authority ("LCRA") at the request of the City of Jefferson, Missouri; and WHEREAS, On August 16, the study entitled, "Qualifications for Chapter 99 (LCRA) Designation for the East Capitol Avenue Redevelopment Area in Jefferson City," dated July 21, 2016 ("the Blight Study") was released; and WHEREAS, The Blight Study examined the area described on Exhibit A, further determining that the area as a whole is a "Blighted Area," (hereinafter "Area") as such term is defined in Chapter 99, RSMO (sometimes referred hereinafter as "the Statute"); and WHEREAS, The Blight Study finds and concludes that the Area meets the requirements for a Blighted Area exhibiting factors including but not limited to, defective or inadequate street layout; insanitary or unsafe conditions; deterioration of site improvements; improper subdivision or obsolete platting; and existence of conditions which endanger life or property by fire and other causes; and WHEREAS, The Area is a portion of the City which by reason of the predominance of defective or inadequate street layout, insanitary or unsafe conditions, deterioration of site improvements, improper subdivision or obsolete platting, or the existence of such conditions which endanger life or property by fire and other causes, or any combination of such factors, constitutes an economic or social liability or a menace to the public health, safety, morals or welfare in its present condition. NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The City Council hereby finds, determines and declares that for the reasons set forth in the Blight Study the area described on Exhibit A, which is attached to this ordinance and incorporated by reference herein, and which is more particularly described in the Blight Study, has a predominance of insanitary or unsafe conditions, deterioration of site improvements, improper subdivision or obsolete platting, the existence of unsafe conditions which endanger life or public health, and generally insanitary, blighted, deteriorated real estate and the area is therefore "BLIGHTED." as defined in Section 99.320 of the Revised Statutes of Missouri, as amended, (the Statute being Sections 99.300 to 99.715 RSMO inclusive, as amended). It is further found, determined and declared that because of the foregoing blighted conditions the Area constitutes an economic or social liability or a menace to the public health, safety, morals or welfare in its present condition. Section 2. The redevelopment of the above described Area, as provided by the Statute, is necessary and in the public interest, and is in the interest of the public health, safety, morals and general welfare of the people of the City. Section 3. The City Administrator or his designee is directed to request the Land Clearance for Redevelopment Authority to prepare and present an amended and/or a new urban renewal plan or plans to reflect the aforementioned Blight Study in order to address the problems in the entire study area.
