An ordinance enacting a six month temporary moratorium on the
issuance of building permits in the C-1 and C-5 zoning districts
within the Moab City limits for the purposes of allowing revisions
to height and buffering requirements for development within those
zones.
WHEREAS many residents of Moab City have expressed
dissatisfaction with the height, buffering, and landscaping
requirements for commercial development in the C-1 zone adjoining
existing residential neighborhoods; and
WHEREAS the intent behind the creation of the both the C-1 and
C-5 zones was to allow limited commercial development to proceed in
harmony with residential uses; and
WHEREAS there is a compelling public interest in preventing
commercial development that harms residential areas, and existing
zoning code provisions may prove inadequate for that purpose; and
WHEREAS U.C.A. 10-9-404 permits the adoption of temporary
zoning regulations for a period not to exceed six months.
NOW THEREFORE, MOAB CITY, upon action of the governing body,
enacts as follows:
1. No building permits shall issue, nor shall any person
engage in any construction or alteration of existing buildings or
structures, or otherwise engage in land development of real
property located within the C-1 and C-5 zones within the Moab City
limits. No petitions to rezone real property currently denominated
as C-1 and C-5 shall be accepted for filing during the effective
period of this ordinance.
2. The Moab City Zoning Administrator shall be authorized to
enforce this ordinance, as provided under existing City Codes.
3. This ordinance shall take effect immediately upon
passage, and shall expire no later than six months following the
effective date, unless rescinded upon action by the Governing Body.
