A RESOLUTION: PRESENTED October 28, 1997 97-249 ADOPTED October 28. 1997 AUTHORIZING THE DEPUTY TOWN ATTORNEY TO INITIATE CONDEMNATION PROCEEDINGS TO ACQUIRE THE NECESSARY RIGHT-OF-WAY TO IMPROVE FORT EVANS ROAD AS REQUIRED BY THE COMPREHENSIVE TOWN PLAN AND ORDINANCE NO. 97-0-06 WHEREAS, Ordinance No. 97-0-06 adopted by the Town Council on March 11, 1997 approved Rezoning Application #ZM-150 Leesburg Comer and Town Plan amendment requiring the construction of a four lane divided portion of Fort Evans Road from the bypass to Potomac Station Drive; and WHEREAS, the Leesburg Comer proffers provide that if the applicant is unable to obtain the right-of-way necessary to construct the Fort Evans Road improvements, the applicant could request assistance from the Town of Leesburg to obtain the required right-of-way so long as the applicant paid the fair market value for such right-of-way; and WHEREAS, the Leesburg Comer applicant has been unable to obtain the right-of-way necessary to construct the Fort Evans Road improvements required by the Town Plan and the proffers as set forth in Rezoning Application #ZM-150 Leesburg Corner. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: The Deputy Town Attorney is hereby authorized to initiate negotiations up to and including condemnation proceedings necessary to acquire the right-of-way necessary to improve Fort Evans Road as required by the Town Plan and the proffers as set forth in Rezoning Application #ZM-150 Leesburg Comer, Ordinance No. 97-0-06.
