A RESOLUTION: PRESENTED October 28, 1997 97-256 ADOPTED October 28, 1997 ENDORSING THE POLICY CONCERNING THE REVIEW OF TELECOMMUNICATIONS FACILITIES WITHIN PUBLIC RIGHTS-OF-WAY PROPOSED BY THE NORTHERN VIRGINIA PLANNING DISTRICT COMMISSION Clerk of Council Jaj3~fs E. Clem, Mayor Tbwn of Leesburg WHEREAS, the Northern Virginia Harming District Commission adopted a resolution urging the requirement of shared approval authority in the Virginia Department of Transportation's (VDOT) proposed changes to policies and regulations governing rights-of-way for telecommunications citing, zoning and shared tower proposals; and WHEREAS, Section 704 of the Telecommunications Act of 1996 provides that local authority regarding the placement, construction and modification of personal wireless facilities shall not be preempted by federal authority provided that local regulation does not have the effect of prohibiting the provision of personal wireless services; and WHEREAS, local governments have the authority to regulate the placement of towers and antennae through the comprehensive planning and zoning processes under the Code of Virginia of 1950, as amended; and WHEREAS, the Town Council recognizes the need for effective telecommunications operations and the importance of locating telecommunications facilities in order to minimize interference among service providers while protecting the health, safety and welfare of Town citizens. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: SECTION I. The Northern Virginia Planning District Commission's policy dated July 24, 1997, regarding the adoption of rules by VDOT to require dual submission to VDOT and local governments applications for placement of towers and antennae by telecommunications service providers in VDOT rights- of-way is hereby endorsed.
