Members present: Wayne Neddermeyer, Mayor; Councilmembers, Arthur Theis, William Reiser, Nancy Laurent; Councilmember Thomas Crosby absent until 8:00 P.M., Clerk, Donna Roehl; Attorney, Richard Schaeffer; Planning and Zoning Administrator, Jeanne Mabusth. Motion by Arthur Theis, seconded by William Reiser to accept minutes of May 10, 1977 meeting, as presented. Motion carried unanimously Minutes of May 17, 1977: Nancy Laurent asked that Item 2, page 131 be changed to indicate the easement is not being maintained, not just the steep slope. Motion by William Reiser, seconded by Nancy Laurent to accept minutes of May 17, 1977 as corrected. Motion carried unanimously Minutes of May 31, 1977: Motion by Arthur Theis, seconded by William Reiser to accept minutes of May 31, 1977, as presented. Motion carried unanimously 1. WILLIAM COLEMAN, DOCKSIDE INN William Coleman appeared to request that he be allowed to add an outdoor "Beer Garden" to his present establishment. Richard Schieffer explained that this must be contiguous to the building and proceed under the theory that a beer garden would be part of the licensed premises. Donna Roehl stated that Robert Franklin, one of the nearest neighbors, has no objections to Mr. Coleman's plans. Motion by Nancy Laurent, seconded by Arthur Theis to approve the On -Sale Intoxicating Liquor licenses for Dockside Inn included within the licensed premises an outdoor Beer Garden accord- ing to plans to be placed on file with the City Clerk. Said beer garden to be closed at 10:00 P.M. daily. Motion carried unanimously 2. HOLY NAME DRIVE Engineer Lyle Swanson presented detailed report on alternatives for upgrading Holy Name Dr. Cost will be from $63,350 - $76,750 or approximately $14.00 per foot of street. He explained that there are several areas of blue clay and black dirt that must be removed. Ditches would be constructed, but in areas where lawns are maintained to the road bituminous curbs could be constructed. These curbs would cost approximately $1.10 per foot and could be assessed against the property owners. As to surfacing there are 3 alternatives: 1. All bituminous, cost approximately $59,000 2. 6" crushed rock and 2" of blacktop, approximately $45,800 3. Recycled blacktop and 2" of blacktop, approximately 844,000 The cost for preparation of the road surface would be approximately $17,600 Spreading the project over a 2 year period, the first years costs wouldle $59,000 and the placement of a final blacktop mat the second year would cost approximately '17,000. The alternatives to re -doing the entire road would be: 1. Patch the existing blacktop 2. Scarify the surface and add crushed rock 3. Resurface the road with recycled blacktop Lyle Swanson reported that the engineering cost would be approximately $7000, but could be used at any time. Nancy Laurent reported that she would ckeck with the County as to use of County -State Aid funds and also the possibility of changing the prioirity of the HUD grant to Holy Name Dr. Worth Bruntjen, resident of Hunter Dr, asked that council continue consideration of the Hunter Dr, blacktopping project, as originally applied for in the JUT application, as it is a much traveled road by residents as well as non-residents of the area. Discussion of other means of payment for the project including special assessment of the affectec property owners. The city and individuaa, property owners each paying a portion of the cost and issuance of bonds after a vote of the Medina residents. 14 3. HAMEL WELL Engineer, Lyle Swanson, reported that Wally Doerr has said that he would give the city a well site at one of two locations; one on Co. Rd. 116 and the other on Hwy. 55. If the Hwy 55 site were chosen he would ask the city to connect his property to the w-„ter main and con- struct a driveway to the well site, in exchange for the property. He also explained that a well would cost from 33000 to $4000 and could be developed as a standby to the present well. Discussion of the present well and the possibility of bringing it back to its original capacity. Motion by Thomas Crosby, seconded by Nancy Laurent to approve the finalization of an agreement with Wally Doerr for the property on Hwy. 55 as a well site. Authorize the engineer to sec- ure quotes for a test well and enter into negotiations with well companies interested in renovating the existing well on a 1 year guarantee basis. Motion carried unanimously 4. RUSS KRUEGER Wayne Neddermeyer advised Lyle Swanson to investigate the septic system problem of Mr. Krueger and discuss a possible solution iwth him. 5. DIVERSIFIED INSULATION Jeanne Mabusth read letter from Lyle Swanson regarding the need for 91 parking spaces, 27 more than shown on the latest site plan. He indicated that there is ample space for truck parking. Also that the bond amount should be $18,000. Motion by Thomas Crosby, seconded by Arthur Theis to approve the site plan of Diversified Insulation subject to: 1. Construction of a total of 91 parking spaces 2. bond amount acceptable to the city engineer 3. enter into development contract with the city 4. install landscaping as shown on plans 5. furnish the city with an as built plan, after completion. Motion carried unanimously 6. KATHI ELLIS, BOARDING KENNEL 11111 Ms. Ellis, in requesting a variance from the blacktopping ordinance, stated that her bus- iness is agricultural related and that she would be living on the property which would be somewhat different from other commercial ventures. She requests that Council establish a policy for agricultural related businesses. Richard Schieffer stated that the zoning code could be amended to take ore of projects in an agriculture district. But there are some businesses that the city may not wish to include, such as picnic areas and golf courses. Motion by Nancy Laurent, seconded by Arthur Theis to authorize the city attorney to draft an amendment to the zoning ordinance relating to blacktopping exceptions for agriculture related businesses. Motion carried. Abstaining Thomas Crosby 7. SUMMER YOUTH AGREEMENT Motion by Arthur Theis, seconded by Nancy Laurent to enter into agreement with Twin City Tree Teust for the summer employment of youths through the CETA program. Motion carried unanimously 8. PERSONNEL Motion by Thomas Crosby, seconded by William Reiser to accept the resignation of Leo Leuer, effective, June 15, 1977. Motion carried unanimously Thomas Crosby asked that Mr. Lauer's work record be studied so that proper settlement is made regarding sick leave and vacation time. Motion by Wayne Neddermeyer, seconded by Arthur Theis to accept the resignation of George Wyse from the Planning Commission and to send a letter of appreciation. Motion carried unanimously Discussion of prospective members for the Planning Commission and the Elm Creek Comm- 141. ission. Jeanne Mabusth stated that she would attend the Elm Creek Commission meeting and would help to find a representative from Medina. Discussion of hiring someone to take care of the Sewer and Water and other city jobs, if needed. Ron Duran stated that someone working on seiner and water would not have a lot of extra time to work on the roads. Motion by Thomas Crosby, seconded by William Reiser to advertize for a sewer and water employee plus part time building inspector. Motion carried unanimously Motion by Nancy Laurent, seconded by Arthur Theis to advertize for a road department employee. Motion carried unanimously 9. INSURANCE Discussion of renewing insurance and increasing coverage. Motion by William Reiser, seconded by Arthur Theis to renew insurance coverage with Wayzata Insurance agency and increase coverage on city hall to $223,000; contents to $15,000; City garage to $28,000; contents, $7,000. Motion carried unanimously 10. LINDGREN, TAX FORFEIT LOTS Motion by Thomas Crosby, seconded by Williim Reiser to request an appraisal from Hennepin Co. on Lots 10, 11, 17 and 20, Block 6, Independence Beadh. Motion carried unanimously 11. PLATTING AND PARK PEES Jeanne Mabusth presented comparison fees of neighboring municipalities. Wayne Neddermeyer felt that the platting fee is adequate but that the park fee is to high, especially in small plat situations. Jeanne Mabusth asked if securing a per acre valuation from the assessor each year and consider- ing epoh case separately would be an appropriate basis for determining the park fee. Motion by Thomas Crosby, seconded by Nancy Laurent to continue chargint the platting fees currently in force. Motion carried unanimously Discussion of park fee tabled until Planning and Zoning Administrator can secure data from Corcoran and discuss property valuations with the assessor. 12. BILLS Motion by Arthur Theis, seconded by Thomas Crosby to in the amount of 39340.88; Order Checks # 6732-6792 Motion carried unanimously Motion by Arthur Theis, seconded by Thomas Crosby to for Jeanne Mabusth. Motion carried unanimously pay the bills: Payroll checks # 4512-4537 in the amount of $46,939.66. begin paying PERA and Social Security 13. VOCATIONAL TECHNICAL SCHOOL Letter from Suzie Schmidt regarding the Vo Tech School was read. Letter suggested that the School will eventually be built, the city has spent enough time on the project and it is time to go on to other things. Thomas Crosby explained briefly what has gone on and if application is submitted again it will be referred to the Planning Commission. 14. 1977 LICENSES Motion by Thomas Crosby, seconded by Arthur Theis to grant an On -Sale non -intoxicating malt liquor license to the Animal Humane Society for June 23,24,25, 26 for a fee of $10.00 to be used at the Hunt Valley Farm. Motion carried unanimously Motion by Arthur Theis, seconded by Nancy Laurent to grant a Sunday Liquor license to Rolling Green Country Club. Motion carried unanimously 15. INDEPENDENCE BEACH BOAT RAMP Arthur Theis presented 2 quotes for repairing the boat ramp at Bury and Carlson - $2600; Buffalo Bituminous - 21885. Motion by Gilliam Reiser, seconded by Arthur Theis to contract pair of the boat ramp at Lake Independence for $1885. with the 1. Excavate and haul away the existing ramp. 2. Shepe, subgrade and install base, provided by the city. 3. Install 2i" pavement, plus the bituminous berms. Motion carried unanimously Lake Independence. with Buffalo Bituminous for re - following conditions: 16. JUBERT LAND DIVISION Motion by Thomas Crosby, seconded by William Reiser to authorize the Clerk and Mayor to enter into a road agreement with Richard Berthiaume. Motion carried unanimously Wayne Neddermeyer asked that the June 21st agenda include discussion of a North -South road through Medina and increasing of the Council's salaries, as of July 1, 1977. Thomas Crosby reported that he would ask Bob Searles to attend the July 19th meeting as Mr. Searles wishes to discuss several matters with the Council. Ron Duran asked if he should use they have experimented on Willow Council advised that he use only crushed blacktop in other areas of the city beside where Dr. on an experimental basis. Council advised Richard Schieffer to talk with Darrell Farr about the guarantee the city will have regarding Hunter Farms Addition. Motion by Arthur Theis, seconded by Thomas Crosby to adjourn.
