220 The Council of the City of Medina met in regular session on Tuesday, June 7, 1983 at
7:30 P.M.
Present: Mayor, Thomas Anderson; Councilmembers, Wilfred Scherer, Thomas Crosby, Anne
Heideman, William Reiser; Clerk -Treasurer, Donna Roehl; Planning and Zoning
Administrator, JoEllen Hurr; Police Chief, Michael Sankey; Public Works Dir-
ector, James Dillman; Engineer, Glen Cook; Attorney, Richard Schieffer
1. ADDITIONAL AGENDA ITEMS
Council agreed to discuss the following additional items:

2. MINUTES OF MAY 17, 1983
Anne Heideman asked that Brett Cook item, page 216 be corrected to read: "Motion by Reiser,
seconded by Scherer to approve agreement to extend use of manufactured home to Brett and
Kathy Cook at 2900 Co. Rd. 19, no later than August 31, 1983."
Motion by Heideman, seconded by Scherer to approve minutes of May 17, 1983, as corrected.

3. PUBLIC WORKS DEPARTMENT

Motion by Reiser, seconded by Crosby to adopt Resolution 83-22, approving the burial of
gas lines by Minnesota Gas Co on Co. Rd. 24 from Holy Name Dr. to and including Meadowwoods Tr.
Motion declared carried
Wright -Hennepin Electric
Motion by Reiser, seconded by Crosby to adopt Resolution 83-23, allowing Wright -Hennepin
Electric to bury cable at the intersection of Medina Rd. and Hunter Dr.
Motion declared carried
Medina Morningside Speed Limit
Jim Dillman asked that the matter be tabled until he has researched the matter.
Motion by Heideman, seconded by scherer to table the matter as requested.

Maple Plain Radio Frequency
Council reviewed information received from radio consultant, Don Wendling regarding the radio
frequency of which Medina is a part of, and the anticipated use that Maple Plain has stated
that they need from a radio system.
Motion by Heideman, seconded by Scherer to authorize the City Clerk to write a letter to
the Mayor of Maple Plain explaining that there are other systems that have less use than
the one that Medina is a part of, and that they should seek out such a system because of
the amount of use they need from a frequency.
Motion declared carried
4. MARGARET BARNES
Mrs. Barnes appeared to discuss her request to allow members of her family to repair her
septic system, although they are not bona fide installers.
Mrs. Barnes was advised to seek Rehab funds through the Community Development Block Grant
Program and if she was not successful she could return to the June 21st. Council meeting.
5. POLICE DEPARTMENT
Tom Hara, Letter of Appreciation
Motion by Heideman, seconded by Crosby to acknowledge receipt of the $50.00 check from Tom
Hara, to use to purchase additional First Aid equipment and to commend Mark Moran for his
efficient response to the Hara emergency.
Motion declared carried
6. PLANNING AND ZONING DEPARTMENT
William Nelson, VAriance
JoEllen Hurr reviewed memo and Planning Commission recommendations regarding Mr. Nelsons,
application for a variance to place a deck and entrance to his house at 3065 Lakeshore Ave.
She reported thatthe old septic tanks had apparently never been filled and that the 221
lower level bathroom may still be connected to the septic system.
Mr. Nelson stated that the proposed deck would be no closer to the lake than those on ex-
isting houses in the area.
Neighboring property owner, Robert Hebzynski, stated that he was concerned about the addition
to the house being to close to his property line on the north but he had no objection to the
deck.
Thomas Crosby asked if it would be possible for Mr. Nelson to retain the 5 ft. sideline set
back that now exists.
Motion by Heideman, seconded by Crosby to approve the variance for William Nelson to construct
an open deck onto his home at 3065 Lakeshore Ave., 35 ft. from Lake Independence and an ent-
rance on the north end of the house no closer than 5 ft. from the west property line.
Motion declared carried
Discussion of existing septic tanks; also keeping deck in line with those of adjacent houses.
Motion by Heideman, seconded by Reiser to specify that lower level bathroom be disconnected
within 10 days and that sepeic tanks be filled according to ordinance, by September 1, 1983,
and that deck shall be no closer to the lake than adjacent houses.

7. CHEROKEE RD.,VACATION
JoEllen Hurr explained that the vacation of the excess cul de sac had been agreed upon at
the time that Meadowwoods Farm had been platted.
Richard Schieffer explained that the vacated section of Cherokee Rd. would be given to abut-
ting property owners, at their request.
Ms. Hurr stated that Jim Johnston, representing S.J. Groves and Mike Bitterman had no object-
ion to the vacation.
Motion by Crosby, seconded by Heideman to close the Public Hearing.
Motion declared carried
Public Hearing closed at 8:10 P.M.
Motion by Crosby, seconded by Heideman to adopt Resolution 83-24, vacating portions of Cher-
okee Rd.

8. PLANNING AND ZONING DEPARTMENT (CONTINUED)
William Nunn -Carey Radtke
William Nunn reported that 50 loads or about one fourth of existing manure had been removed
from the property to a greenhouse on Hwy. 55 and 101 and that the remainder would be hauled
there after the trucker returned from a vacation.
JoEllen Hurr reviewed her memo which indicated a deadline for removal of old manure and a
requirement regarding securing a written statement for disposal of future manure.
Mr. Nunn stated that he had several properties onto which he culd haul manure in the future.
He also stated that he would be finishing the driveway and parking area after the city had
replaced culverts along Willow Dr.
Motion by Heideman, seconded by Scherer to table the variance application of William Nunn -
Carey Radtke until June 21st, at which time the remainder of accumulated manure is to be
removed, gravel placed on the driveway and parking area and a written agreement secured for
handling disposal of ongoing manure.

Clair Rood, Variance
JoEllen Hurr explained Mr. Roods application to construct a house at 2496 Bobolink Rd. with
a front yard set back of 35 ft., so as to align it with other houses in the area.
Motion by Scherer, seconded by Heideman to grant a 15 ft. front yard variance to Clair Rood
to construct a house at 2496 Bobolink Rd.
Motion declared carried
9. WATER AND SEWER RATES
Council discussed the need to increase sewer and water rates based on reports received from
the Auditor and staff regarding expenses.
Mayor Anderson suggested the possibility of an increase to $2.00 per thousand for both water
and sewer.
Council asked City Attorney to find out if bond funds could be used to finance infiltration
in the Hamel area.

Council asked the City Clerk to prepare a rate schedule that will balance the budget.
10. HAMEL WELL # 3
Glen Cook reported that specifications had been written for pump, piping and chlorination
equipment and that a bid date should be set.
Motion by Heideman, seconded by scherer to receive bids for Hamel Well # 3, equipment,
on June 30, 1983 at 10:00 A.M.

11. PLANNING AND ZONING DEPARTMENT (CONTINUED)
Hamel Sewer Connections
Council discussed information regarding possible number of connections the city would have
in the Hamel area, if the infiltration were corrected. Information provided by staff in-
dicates that there are 224 sewer units being used with 95 properties assessed front footage,
not connected to the sewer.
JoEllen Hurr reported that she has had requests for approximately 193 units from several
property owners.
Council discussed the amount of space available in the interceptor pipe that is to be
constructed.
Thomas Anderson stated that there is an established sewer district that has been approved
by the Metro Council that should be served. He asked for the number of possible units
that might be requested if the entire district were to be developed.
9:15 P.M. Thomas Anderson absent, William Reiser in Chair
Thomas Crosby stated that the City Council has the ability to do what it deem appropriate
when an application for use of sewer is received. He asked Attorney for information re-
garding other cities refusal to approve permits in a sewered area, for lack of sewer cap-
acity.
Motion by Crosby, seconded by Heideman to hold a public meeting on June 21, 1983, at 8:00
P.M. to inform property owners, in the Hamel sewer district of the number of sewer units
remaining to be used and the infiltration problem that needs to be corrected.

George Halvorson, representing the Medina Motor Inn, stated that they expected approval
from the State of Minnnesota on Wednesday, June 15th, regarding selling of Industrial
Revenue Bonds.

JoEllen Hurr reported that she was waiting for a response from Browning -Ferris regarding
additional studies that consultants had decided were needed.
She also reported that Dr. Renier had met with Ms. Gardebring of the PCA.
WCCO
Motion by Reiser, seconded by Heideman to acknowledge receipt of letter from WCCO, dated
May 25, 1983, regarding the fact that the1195 ft. antenna had been denied by the FCC and
that they would now be making application for the 990 ft. tower.

Application Fees
Motion by Scherer, seconded by Heideman to authorize the collection of up to $250 for
applications concerning Conditional Use Permits, variances, simple subdivisions and
land alterations with larger fees for large subdivisions and rezoning.

12. MINNEHAHA CREEK WATERSHED DISTRICT
Motion by Scherer, seconded by Crosby to appoint JoEllen Hurr as representative and Anne
Heideman as alternate to the Minnehaha Creek Task Force Advisory Committee.

13. ENGINEERS CONTRACT
Council discussed prepared contract with Thomas Crosby suggesting it could be simplified.
Matter was tabled until July 6th.
14. GAMBLING ORDINANCE
Council discussed the prepared ordinance and offered suggestions to be included.
Attorney was asked to rewrite with suggestions for the June 21st meeting.
15. RICHARD KREMER, RESOURCE RECOVERY
Thomas Anderson presented a prepared resolution which encourages some type of program that
would treat refuse nearer the source of collection.
Motion by Crosby, seconded by Heideman to adopt Resolution 83-25, regarding refuse manage-
ment, and to forward to County commissioner Kremer.

16. AMERICAN RED CROSS
Motion by Reiser, seconded by Scherer to grant a Non -Intoxicating malt Liquor License to
the American Red Cross to be used at Alpine Farms on August 20-21, 1983.

17. BILLS
Motion by Crosby, seconded by Reiser to pay the bills; Order Checks # 2090-2159 in the
amount of $75,538.63 and Payroll Checks # 7182-7211 in the amount of $12,945.88.

18. ORDINANCE # 207
Richard Schieffer presented corrected ordinance regarding boat motors on Holy Name Lake.
Motion by Reiser, seconded by Heideman to adopt Ordinance # 207, regulating type of boat
motors that are to be allowed on Holy Name Lake.
Motion declared carried
