PLANNING BOARD
November 6, 2001
PRESENT: Ed Gill (Chair), Joel Brinkley, David Daniel, Kelly Hopper, Brian Ketchem, Chris Quinn,

Gill called the meeting to order at 6:40 PM.
ITEM #2: Hauth provided updates from the Board of Adjustment and Parks and Recreation Board.
ITEM #3: Warren moved to approve the minutes as written. Daniel seconded.
VOTE: Unanimous.
ITEM #4: Hauth introduced the Housewright Builders rezoning request. Hauth distributed a new
comment letter from the Hartkopfs. Knight described the revised plan showing a 75' rear
buffer. He noted that combined with the 20 -foot rear setback, buildings would be 95' from the
Cornwallis Hills rear property lines. Hartkopf thanked Knight for the buffer. He highlighted
the points in his letter, noting the negative impact to property values in Cornwallis Hills due to
the smaller lot size, his concern about the lot being clear-cut to accommodate the houses. He
asked the members to consider a lower density to help protect Cornwallis Hills. The members
discussed the application. Brinkley expressed concern about the larger lots to the east that
aren't seeing any buffering. Daniel said it is not unreasonable to expect some creep of the
non-residential uses westward down Oakdale Drive; not as far as Knight's property, but
nearby. He said that unknown makes it hard to determine what kind of buffer is needed and
what type of interconnectedness is reasonable. He noted his concern, which would be
addressed during subdivision review, that the parcel doesn't provide any access neighboring
lots east and west.
MOTION: Ketchem moved to recommend approval of the rezoning with the rear buffer as a condition of
annexation. Warren seconded.
VOTE: 5-1 (Brinkley opposed, concerned for values of properties to the east with no buffer)
ITEM #5: Hauth introduced the owner of the former Southern States building and a potential tenant
(Quinn arrived). Rhinehart described the restaurant he currently operates in Timberlake and
expressed his interest in operating a similar operation in Hillsborough. He showed the
members drawings of the site. Hauth said the site is currently zoned Limited Office and would
need to be rezoned to Entranceway Special Use and have a Special Use Permit. She added that
the applicants want to gauge the members' willingness to have a special hearing to consider
the rezoning and SUP. The members said they were generally willing to attend a special
hearing after Thanksgiving or at their regular December meeting.
ITEM #6: Hauth introduced the continued discussion of prohibiting towers in residential districts. She
noted that the Town Attorney has significant experience in this area and may be helpful in
crafting language. The board members agreed to hold this item for Mr. Hornik's input.
Gill adjourned the meeting at 7:30 PM.

Gill called the meeting to order at 6:34 PM.
ITEM #3: Daniel moved to approve the minutes as written. Lloyd seconded.
VOTE: Unanimous.
ITEM #4: Hauth introduced the preliminary subdivision plan for Oakridge, 16 new lots on a new public
street. She said the owners and engineers are present, as well as a neighbor in Cornwallis Hills.
She said there is a discussion point about the extra rear setback required on the rear two lots and
what the usability of that area is that has to be clarified by the Town Board before final approval
is given. Daniel passed around a drawing he made showing a road alternative that would stub the
street out to both adjoining lots for future connectivity. He also asked that the lack of sidewalks
be explained.
Steve Rice presented the details of the plan. He said the sidewalk requirement was new and he
was looking for flexibility from the board. He said no adjoining parcels have sidewalks, so the
installation would serve no purpose, as there is nothing to connect to. He said his client is asking
to not have to provide sidewalks. Gill asked about street connectivity to adjacent parcels. Rice
said none was planned as the adjacent lots are developed as a mobile home park and single
family. He added that this is a small site and no adjoining lots stubbed to this one. Daniel said
that looking to the future redevelopment of this corridor is important. He added that the stub -out
would remove a cul-de-sac but would cost a building lot. Rice said that it is not a requirement.
Carroll said she would prefer a sidewalk along the frontage, so that it would be there if one was
installed later. She added that the frontage walk was more important in her view than along the
new road. Lloyd said she agreed with Carroll. Carroll asked Hauth whether the sidewalk along
Oakdale was required. Hauth said her interpretation of the section was that one was clearly
required on the new road, but not on Oakdale.
Ketchem asked what material was being used in the swale. Rice said it is a fabric, which is a
substitute for riprap. He added that the road could be striped narrower to allow for wide
shoulders for walking. Warren arrived at this time. Gill noted that the separation provided by a
true sidewalk was important for safety. Ketchem noted that the wide shoulder would become
parking. Boericke noted that the open space area could be used for east -west walking. Knight
agreed to allow access to that area. Neighbor Hartkopf spoke against any use of the buffer/open
space. He said he disagrees that the condition of annexation was for additional setback, he
understood it to be additional no cut buffer.
Daniel said that the members worked hard to get the sidewalk requirement added and they needed
to stick by it. Knight offered to put the Oakdale sidewalk in and do one side of the cul-de-sac.
Carroll and Brinkley agreed. Hartkopf noted his continuing concern about the fate of the open
space. He asked who would receive title to it. Hauth said standard procedure is that the land is
offered to either the town of a homeowners association. Hartkopf expressed concern about it
going to an association. He also shared copies of letters between Knight and his attorney to
illustrate his concern about Knight's intensions.

Members returned to the sidewalk issue. Some agreed that the compromise sounded workable.
Others expressed concern that since that's not what the ordinance requires, they would be in a
shaky position. Knight agreed to meet the ordinance requirement. Members agreed that was
their best position.
MOTION: Lloyd moved to recommend approval of the preliminary plat to the Town Board with the
conditions that they clarify their intent regarding the usability of the rear setback and that
sidewalks that comply with the Subdivision Regulations are provided by the applicant. Warren
seconded.
VOTE: Unanimous.
Lloyd suggested the members look into addressing adjoining streets like Oakdale in this case and
curb and gutter. Brinkley suggested that undeveloped areas also be looked at to address infill and
connectiveness issues.
Gill adjourned the meeting at 7:50 PM.
