A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE FORTHE
ABANDONMMENT OF A PUBLIC UTILITY EASEMENT ON 1483 SOUTH SHORE DRIVE
ASSESSOR'S PARCEL NUMBER 17-382-01

WHEREAS, the Town of Truckee has received an application requesting approval of a
Public Utility Easement abandonment, 10-feet wide, located along the entire frontage of the parcel,
and a 20' x 2' anchorage easement located at the northwest corner of the property of Lot 66, of
Southside Highlands Subdivision, Unit No. 1, per Book 1 at Page 122, in the Recorders Office of
Nevada County, California: and
WHEREAS, environmental review has been conducted in accordance with the California
Environmental QualityAct (CEQA) and the CEQA Guidelines and the Town Council has determined
the project will not have a significant impact on the environment and is exempt from environmental
review in accordance with Section 15061(b)(3) of the CEQA Guidelines; and
WHEREAS, the Community Development Director, Town Engineer and Public Works
Director have reviewed the public utility easement abandonment and find the easement in question
has not been used for the purpose for which it was dedicated or acquired for five consecutive years
preceding the requested vacation, and the easement is not necessary for present or prospective
use; and
WHEREAS, there are no public utility facilities located within the easement to be abandoned
and the Town has not received any objections to the proposed abandonment from any public utility
or special district.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF
TRUCKEE, the Town Council hereby abandons any and all interest to the easement for
overhanging wires, cables, and conduits overthe front ten feet of the lot and for pole anchorages at
the front lot corner within an area shown on the face of the map of Lot 66, of Southside Highlands
Subdivision, Unit No. 1, per Book 1 at Page 122, in the Recorders Office of Nevada County,
California;
BE IT FURTHER RESOLVED that the Town Clerk is hereby authorized and directed to
coordinate the recordation of this easement abandonment.

The foregoing Resolution was introduced at a Regular Meeting of the Truckee Town Council,
held on the 21 sc day of June, 2007, by Council Member Susman, who moved its adoption, and which
motion was duly seconded by Council Member Brown, was upon roll call carried and the Resolution
adopted by the following vote:
AYES: Council MemberSusman, Council Member Brown, Council Member Dee,
Vice Mayor Green and Mayor Anderson.
NOES: None.
