Minutes of December 14 and 28, 2005,January 11 and 25, 2006: There were no changes or corrections. Motion to Approve- Paul Hush,second Roy Robinson Unanimous approval. 2. Sarah Korjeff- Historic Preservation Restrictions: It is very important to remember that for every application (in any of the four areas) that is approved -there must be a public purpose in order to use CPA funds. There are a number of examples of Historic Preservation Restrictions (HPRs) available on the internet at some of the Town CPA sites and MA Historic also has them - but they are not available digitally. She will get some hard copies for Brewster, but was not sure if she could get anything out of MA Historic that would be digital. It is also possible to combine a Conservation Restriction (CR) and a Historic Preservation Restriction when there are multiple resource issues. HPRs are necessary to protect the Town's interest in any application that is funded. 3. Korjeff-HPRs are not required for town-owned properties, but it is recommended. Applicants should be told that the CPC will require an HPR before they receive the requested funds. An HPR could be part of the project costs or the money for this could come from the administrative costs fund of the CPC. The CPC could write it and then give it to Sarah Turano-Flores (Town Counsel) to review. 4. Korjeff- Historic Designation: a. Is the building historically significant? If it is on the National Historic Register- it is already significant. Community Preservation Committee Minutes February 8,2006 Page 1 of 5 b. MA Historic can say that a structure is Historic, or the local Historic Commission can so indicate. c. A draft application can also be sent to MA Historic—once the CPC receives their OK, then the CPC or the applicant can do an HPR. 5. Questions about Project Management: Who does what? Project Management can be considered a project cost. 6. Korjeff—Will work with Town Counsel and review any drafts of HPRs. We can get copies of HPRs from MA Historic. Their"Bricks&Mortar"program requires HPRs. Otherwise, there are just a few HPRs done by Towns. However, these"models"are not good models for CPA HPRs—we need to get these from the CPA Coalition. 7. Robinson —Are there any HPRs that cover the inside of structures, too?There are also consultants out there— like Candace Jenkins that do nominations. She is also good at drafting HPRs. 8. Hush —If properties are Town-owned —aren't they less at risk? 9. Robinson —The Windmill will need an HPR. 10. Reyburn —What triggers an HPR? 11. Korjeff-The CPA says that if the Town acquires a real property interest—then an HPR is required. 12. Carr— If a structure does not qualify as historic— maybe we could put some other type of deed restriction on it in perpetuity? 13. Ruchinskas—What about cemeteries? 14. Korjeff—Cemeteries are already protected by state law. Presentation of Recreation Committee recommendations: 15. Bassett- a. Freemans Way Soccer Field - $32,000 for sodding b. Whitecaps - $5,000 for field work Total $37,000 Freemans Way Soccer Field Application: 16.Lach -Why does the field need re-sodding? 17.Bassett—That field is used before any other fields. Non-Town Groups such as bands or other sport groups that use the field pay towards the use of the field —The money goes into a revolving account. 18. Robinson —We need to see information about these other monies— how will sod do better than regular seeding?What is the account balance?When would this be done? 19.Bassett— Late fall and use will be restricted from September through the spring. 24. Lach - a. Problems with bikes on the field b. Parking and erosion from bikes on little league fields. Community Preservation Committee Minutes February 8,2006 Page 2 of 5 25. Taylor—We need to have more information: where other money is coming from —will this also be used towards the cost of sodding, not just CPC money?What is being done to prevent bikes, etc. from ruining the sod once it is installed?We also have to make sure that such an expenditure is allowed within the CPA funding mechanism —these lands were not purchased using CPA funds. 26.Carr— MOTION—Approve recommendation of Recreation Commission for Freemans Way Field of up to$32,000—Second—Hush. Unanimous approval. 27. Hush—We need to keep track of this—the cost was provided by the Golf Course. We need to see a written estimate from Steve Mann. Apparently the Town will do as much of the work as possible. 28. Bassett- Keith Arnold will manage the property with Charlie Sumner. We need to meet with Sumner to see who oversees what—ask Charlie and Lisa Souve who oversees what and how...??? I will help oversee along with the Recreation Commission. 29. Carr—Agreed —ask Keith Arnold to watch it— but check with Charlie Sumner. Ultimately the CPC is responsible. 30.Taylor—We need to have a form for applicants to sign once they have been approved at Town Meeting —so we can start a paper trail and have accountability and oversight over where the money goes and how it is used. Will check on internet to see what other towns are using. 31. Robinson— MOTION— We will meet with Charlie,but we will ultimately be responsible. Second Bassett. Unanimous approval. 32. Hush—We need to put someone in charge of each project. 33. Lach—Bassett will certify that the project is OK to the CPC—then the CPC will OK the payment. 34. Carr—we will meet with Charlie and Lisa Souve, Bassett and someone from Golf Course relative to oversight over project. Golf and/or DPW will do as much of the work as possible. Whitecaps Application: 35. Bassett- MOTION to approve$5,000 for Whitecaps—2'd—Hush—Unanimous approval. 36. Carr—We will need an overseer for this project, too. Bassett will also do this. We also need a new letter of clarification of what the funds will be used for and will need proof of where the monies go. Other Recreation Applications: Pool Tables- Julius Corn 37. Bassett— Recreation voted to deny the Pool table application. A letter needs to be sent to Mr. Corn from Recreation or from the Clerk. ' 38. Agreement from Committee. 39. Hush— For any project—we need to let the applicant know our decision and that they are welcome to come to a meeting to discuss our recommendation. 40. Hush —MOTION to invite applicant to speak with us—if they wish.Second—Bassett— Unanimous approval. Presentation of Affordable Housing Recommendations: Community Preservation Committee Minutes February 8,2006 Page 3 of 5 Lower Cape Cod Community Development Corporation Application 41. Hush -Purchase of Condominium in Nickerson Park Condos 3550 Main Street Brewster. The Condo is 15 years old; the price is $43,270 for unit #7. It will be sold to the Lower Cape Cod Community Development Corporation (Lower Cape Cod CDC) for affordable rental housing. The price is less than 1/2 of the current market price for these condos. The present tenant will stay on (she is income eligible). There will be a deed restriction in perpetuity. The CDC will own and manage/maintain the condo. It has a good track record. This is excellent because Brewster needs rentals, a good use of CPC funds. The restriction must be recorded. 42. Lach-The $43,270 is 75% of the total cost of the mortgage-which is $58,270 a. Deed restriction is in perpetuity? b. CDC will own and manage it, reviewing possible tenants for eligibility c. Brewster residents- restriction? Preference to persons who live, work or have relatives in Town. This preference is very important. d. There is also a right of first refusal as part of the deed - if the unit is ever sold. 43. Carr- Has bank language for agreements- need to keep benefits. This should go through Sarah Turano-Flores 44. Bassett- MOTION to review with Milan Douglass and Charlie Sumner also. Second- Robinson.All agreed. 45. Lach-What protects us if someone wants to tear it down?We should ask Town Counsel. Are we covered? Extinguishment clause? 49. Ruchinskas-I will be overseer for-project-contact for LCCCDC 50. Hush - Motion to approve application request-Second- Bassett- Unanimous approval. Habitat for Humanity Cape Cod Application: 51. Hush - Habitat for Humanity-Slough Road. This is for the four affordable houses that Habitat will be building on this property. There are four lots, the houses will all be on one lot and the other 3 lots will get a CR to keep for Conservation. Habitat needs help with the financing - usually they get a lot of help from owners. And normally the roads and utilities are already there. For this project the road-James Barr Road- needs to be brought up to standards and utilities need to be brought in. It may be possible that DPW can help with some of this....?The Cape Cod Commission also contributed $80,000 to this project. There is a written agreement that 3 out of the 4 homes will go to Brewster residents. 50. Robinson -we need information on timing, etc. and the commitment from Habitat for Humanity. 51. Hush - Ruchinskas will also be the overseer of this project. 52. Motion by Bassett-second Robinson-approve request for up to$95,000-Unanimous approval. 53. Meeting adjourned at 5:45 PM.
