HomeMy Public PortalAboutResolution 16-17 Procedure for Complaints to bidding process for FAA funded airport bidsCity of McCall RESOLUTION NO. 16-17 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF McCALL, VALLEY COUNTY, STATE OF IDAHO, ADOPTING A PROCEDURE FOR REVIEW OF COMPLAINTS AND OBJECTIONS TO THE BIDDING PROCEDURE FOR THE FEDERAL AVIATION ADMINISTRATION FUNDED ACQUISTIONS AT THE McCALL AIRPORT. WHEREAS, the City of McCall has engaged in the process of soliciting bids for new snow removal equipment which will be used at the McCall Airport; and WHEREAS, the snow removal equipment will be acquired using Federal Aviation Administration (FAA) grant funds and City funds; and WHEREAS, 49 CFR 18.36 requires that the City have a written procedure for review of complaints arising out of bidding procedures used in acquiring equipment funded with FAA funds; and WHEREAS, the McCall City Council desires to establish and adopt the procedure contained herein for review of complaints relating to bidding on the snow removal equipment acquisition at the McCall Airport and any objections to future airport related bids funded in whole or in part by FAA funds. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF McCALL, IDAHO THAT THE FOLLOWING PROCEDURE FOR REVIEW OF COMPLAINTS AND OBJECTIONS TO THE BIDDING PROCEDURE FOR THE SNOW REMOVAL EQUIPMENT AND ANY OBJECTIONS TO FUTURE FAA FUNDED BIDS AT THE McCALL AIRPORT BE ADOPTED: 1. At least seven (7) days' notice of the following complaint procedure shall be provided to any party submitting an objection or complaint regarding a bidding process, and any party submitting a bid. 2. The City Council will hold a hearing at a regular or specially called City Council meeting to address bidding procedure complaints as follows: a. City Staff will give an overview of the bidding specifications and process which was conducted in obtaining bids. RESOLUTION NO. 16-17 July 14, 2016 ADOPTING PROCEDURE FOR COMPLAINTS TO BIDDING PROCESS FOR FAA FUNDED AIRPORT BIDS - 1 b. Any party who in writing has complained or objected to the bidding procedure shall be given an opportunity to present their complaint or objection to the bidding process and/or bidding rules and specifications. An objecting party may simply submit a written objection or complaint which will be read into the record. Any person who submitted a responsive bid will also be given the opportunity to present their position on the bidding process either in person or in writing to be read into the record. c. City Staff will then offer a rebuttal and response to any complaint or objection made. d. Members of the City Council will then deliberate and by majority vote, either uphold or reject the complaint or objection. e. During items a, b, or c above, Members of the City Council, the City Manager, or City Attorney may interject questions or comments at any time. 3. This Resolution shall be in full force and effect immediately upon its adoption and approval. PASSED by the City Council of the City of McCall this 14 day of July, 2016.
