A RESOLUTION: PRESENTED March 24, 1998 98-85 ADOPTED March 24, 1998 AUTHORIZING THE ISSUANCE OF A CHANGE ORDER FOR THE WEST MARKET STREET AT CATOCTIN CIRCLE / FAIRVIEW STREET INTERSECTION IMPROVEMENT PROJECT WHEREAS, the FY98 budget provided $330,000 for construction of intersection improvements consisting of new turn lanes and traffic signals at the intersection of West market Street at Catoctin Circle / Fairview Street; and WHEREAS, because of delays by the engineering firm in completing the construction plans, the award of a contract in the amount of $203,670 to construct these much needed improvements was delayed until late Fall 1997, and construction was extended into winter and to accommodate weather conditions and to ensure timely completion of the work, it was necessary as work progressed, to issue to the contractor work directives valued at $24,011; and WHEREAS, to accommodate field conditions, it was necessary to issue work directives valued at $33,669.86; and WHEREAS, as the result of negotiations for necessary right-of-way with the Holy Trinity Lutheran Church, the town issued a work directive in the amount of $3,304.36 for parking lot improvements requested by the church in partial lieu of cash; and WHEREAS, the total value of changes requested of the contractor by work directives is $60,985.76; and WHEREAS, in accordance with Section 8.1-20 of the Town's Purchasing Policy, the maximum value of contract change orders that can be issued without Council approval is 25% of the original contract amount or $50,917.50; and -2- A RESOLUTION: AUTHORIZING THE ISSUANCE OF A CHANGE ORDER WHEREAS, Change Order No. 1, in the amount of $48,447.65 covering Work Directives 1, 2, 3, 4 and 5, was issued to the contractor; and WHEREAS, authorization by Council to issue Change Order No. 2 in the amount of $12,538.11, covering Work Directives 6, 7, 8 and 9, for the additional work exceeding the 25% limit required to construct the project; and WHEREAS, the total cost of the project including the cost for engineering and design and utility relocation is $312,322.96, less than the total budget of $330,000. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia that the town manager is authorized to execute Change Order No. 2 for the West Market Street at Catoctin Circle / Fairview Street Intersection Improvement project.
