PLEDGE OF ALLEGIANCE PRAYER BY MR. QUINN President Miller presided and the following business was conducted: ROLL CALL Councilors present were Howard "Jack" Elstro, Kelley Cruse - Nicholson, Bruce Wissel, Clay Miller, Bing Welch, Larry Parker, Robert Goodwin, Diana Pappin and Phil Quinn. Also present were: Walt Chidester, City Attorney; Sally Hutton, Mayor; Monica Burns, Deputy City Clerk; Ron Church, Paul Kriese, Josh Williams, Vicki Meek, Gwen Berry, Mario Simpson, Bob Hunter, Mike Nottingham, Yvette William, Kris Wolski, Richmond Police Chief, Brian MaOla, Sharon Brandley, Adet Ok Uh Bo Adeshile, Carrel Green, Barry Cramer, Monton Butler, Jane Stowe, Keith Dobbins, Gil Klose, Daniel Orek, Barbara Armstead, Joseph Campbell Toldem and Ron Etnier. APPROVAL OF MINUTES Ms. Pappin moved to approve the minutes of the meeting of January 4, 2010, supported by Mr. Goodwin. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS None COMMUNICATION FROM THE MAYOR ■ Reported on the Constitutional Amendment regarding Property Tax Caps. REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the December 29, 2009 and January 7, 2010 meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and /or ORGANIZATIONS ■ Police Chief Wolski presented an update on the status of the reserve officer program. They are still in training — there are currently eight reserve officers. ■ URBAN ENTERPRISE ASSOCIATION: Ms. Pappin nominated Rachel Hughes to serve on the UEA Board, supported by Mr. Wissel. Upon a vote viva voce, the motion passed. ■ HUMAN RIGHTS COMMISSION: Ms. Cruse - Nicholson nominated Barry Cramer to serve an additional term on the Human Rights Commission, supported by Mr. Parker. Upon a vote viva voce, the motion passed. Common Council Minutes January 19, 2010 Page 2 of 3 MISCELLANEOUS BUSINESS None ORDINANCES ON FIRST READING Mr. Elstro moved to suspend the rules and read Ordinance Nos. 74 -2009 and 1 -2010 on first reading by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. ORDINANCE NO. 74 -2009 — A SPECIAL ORDINANCE AUTHORIZING THE CITY OF RICHMOND TO RECEIVE DONATIONS FOR HUMAN RIGHTS DEPARTMENT The Deputy Clerk read Ordinance No. 74 -2009 on first reading by title only This Ordinance would authorize the City of Richmond Human Rights Commission to accept donations for the operation of the Human Rights office in an amount not to exceed Eighty Five Thousand Dollars ($85,000.00). Mr. Elstro moved to advance Ordinance No. 74 -2009 to second reading and to suspend the rules and read by title only, supported by Mr. Wissel. Upon a vote viva voce, the motion passed. Council President Miller declared Ordinance No. 74 -2009 on second reading and public hearing. There being no comments for or against the Ordinance, Ms. Cruse - Nicholson moved for engrossment of Ordinance No. 74 -2009, supported by Mr. Parker. Upon a vote viva voce, the motion passed. Mr. Welch moved to advance Ordinance No. 74 -2009 to third and final reading and suspend the rules and read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 74 -2009 on third reading by title only. Ordinance No. 74 -2009 was adopted with an 8 -1 roll call vote. Dissenting was Mr. Quinn. ORDINANCE NO. 1 -2010 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6- 1.12.1 ( Ahaus Tool) The Deputy Clerk read Ordinance No. 1 -2010 on first reading by title only. This Ordinance is a request of Ahaus Tool & Engineering for a ten -year tax abatement for equipment valued at $630,000.00. Ordinance No. 1 -2010 was referred to the Tax Abatement Committee for due diligence. ORDINANCES ON SECOND READING ORDINANCE NO. 73 -2009 — AN APPROPRIATION ORDINANCE AUTHORIZING ADDITIONAL APPROPRIATIONS FROM CERTAIN FUNDS The Clerk read Ordinance No. 73 -2009 on second reading by title only. Presented by Kelley Cruise - Nicholson, this Ordinance would appropriate $74,150.00 to fund the Human Rights Office for 2010. Council President Miller declared Ordinance No. 73 -2009 on second reading and public hearing. Speaking in favor were Ron Church, Paul Kriese, Josh Williams, Vicki Meek, Gwen Berry, Mario Simpson, Bob Hunter, Mike Nottingham, Yvette William, Kris Wolski, Richmond Police Chief, Brian Common Council Minutes January 19, 2010 Page 3 of 3 MaOla, Sharon Brandley, Adet Ok Uh Bo Adeshile, Carrel Green, Barry Cramer, Monton Butler, Jane Stowe, Keith Dobbins, Gil Klose, Daniel Orek, Barbara Armstead, Joseph Campbell Toldem and Ron Etnier. Mayor Hutton and Police Chief Wolski presented an option of appropriating $25,000 from the Police Department "seizure" monies received from the Drug Enforcement Agency. Mr. Elstro moved to amend this Ordinance to appropriate Thirty Five Thousand Dollars and zero cents ($35,000.00), supported by Ms. Pappin. Mr. Parker requested the $25,000 proposed to be received from the Police Department be included in the Ordinance. Mr. Elstro and Ms. Pappin rescinded their motion. Ms. Cruse - Nicholson moved to amend Ordinance No. 73 -2009 to replace $74,150 with $35,000 and add WHEREAS, In addition to this appropriation to the Human Rights Department from the General Fund, the Richmond Police Department will in 2010 augment monies for the Human Rights Department, in an amount not to exceed Twenty -Five Thousand Dollars ($25,000), to fund investigations by the Human Rights Commission for the Police Department, supported by Ms. Pappin. The motion carried with a 6 -3 roll call vote. Dissenting were Messrs. Welch, Parker and Goodwin. There being no comments against the Ordinance, Mr. Parker moved for engrossment of Ordinance No. 73 -2009 as amended, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed. Mr. Elstro moved to advance Ordinance No. 73 -2009 as amended to third and final reading and suspend the rules and read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. The Deputy Clerk read Ordinance No. 73 -2009 as amended on third reading by title only. Ordinance No. 73 -2009 as amended was adopted with a 5 -4 roll call vote. Dissenting were Messrs. Welch, Wissel, Goodwin and Miller.
