Box 429 • Hillsborough, North Carolina 27278 919-732-1270 • Fax 919-644-2390 MINUTES PLANNING BOARD June 4, 2002 PRESENT: David Daniel (Chair), Jim Boericke, Joel Brinkley, Matthew Farrelly, Kelly Hopper, Bryant Warren PUBLIC: John Hamak, Margaret Hauth Daniel called the meeting to order at 6:34 PM. Hauth noted that Newton and Quinn had both said they would not be at the meeting. ITEM #2: Hauth said the Board of Adjustment did not meet in May. She said the Park Board is continuing to work on a neighborhood park and a skate park. She noted that there is a seat on the Park Board reserved for a Planning Board member. She asked the members whether they wanted to hold their regular July meeting. The members agreed to skip the meeting unless it became necessary later. Hauth said the Town Board had scheduled some meetings to discuss the Strategic Plan and Waterstone. June 11 was scheduled for the Strategic Plan, June 25 as a work session on Waterstone, and July 9 as a special public hearing on Waterstone. She said she would email the meeting times. She asked for confirmation that a quorum would be available for the July 9 hearing, the only required meeting of the group. Farrelly noted he would not be available for either July 2 or July 9. ITEM #3: Hauth introduced the continued discussion of the prevention of demolition by neglect ordinance. She said, unfortunately, the suggestion to hold the hardship hearing in closed session does not meet state law requirements. Since the owner is saying he/she has the hardship, the burden of proof falls to the owner and that claim must be made in a public meeting. Hauth said the second page is a staff proposal to clarify and amend the procedure to notify to owner sooner, specifically, give the owner more opportunities to make the charges go away and other changes. Brinkley said he discussed the ordinance with friends who are re -doing a house in a Raleigh historic district. He said they are overwhelmingly in favor of these types of ordinances and didn't see them as harassing. The members discussed the topic at length. They discussed whether a new hearing was needed. Hauth said the draft was not stricter, so one wasn't necessary, but could be held. MOTION: Brinkley moved to recommend approval of the amendment with the changes proposed at this meeting. Warren seconded. VOTE: 5-1 (Hopper opposed) ITEM #4: Hauth introduced the continued discussion of the special residential district. She noted that the changes are shown using the italics/strikethrough method. She said the buffers are not specified, nor are any other performance standards the members may want. The members discussed buffers and agreed that this type of development has different uses within it, which should be subj ect to different buffers depending on the neighboring use. With buffers ranging from 25' to 100', the members asked Hauth to prepare a matrix based on uses adjacent to one another. PB 6/4/2002, page 2 MOTION: Warren moved to send the proposed amendment to public hearing. Boericke seconded. VOTE: Unanimous. ITEM #5: Hauth introduced the discussion about cul-de-sacs. She said she did not see significant differences between Hillsborough and Carrboro's language. She said she would work with the attorney (who also works for Carrboro) to see how they can be made more similar, since the ordinances are arranged differently. The members discussed some of the pros and cons about prohibiting cul-de-sacs. Hauth noted that sometimes the choice is between stream crossings and connected streets. Hopper asked if interconnected streets didn't lead to more traffic. Daniel said they provide more options for drivers, so there is less congestion. Farrelly added that the trips get distributed over the whole network. The members agreed to look at this again after some recommendations by the attorney. ITEM #6: Hauth introduced a new concern pending about home occupations and yard sales. She noted the lack of clarity on when a permit was required, a requirement that the business owner be a resident of the house, and specific prohibitions for some occupations. The members agreed with the office policy Hauth had been employing and asked her to draft appropriate amendments for further consideration. She noted that perpetual yard sales were being called in as home occupation complaints, but owners were indicating the activity as a yard sale rather than a business. She added that the ordinance is silent on yard sales. The members agreed that this also needed additional work and suggested Durham's regulations as an example. They also suggested that 3 consecutive days and once per quarter would be reasonable standards. Hauth thanked the members for their help. Daniel adjourned the meeting at 8:15 PM.
