HomeMy Public PortalAboutOrdinance 947 - Enacting 4.7.6 - Craft Fairs and BazaarsORDINANCE NO. 947 AN ORDINANCE OF THE CITY OF McCALL, VALLEY COUNTY, IDAHO, AMENDING TITLE 4, BUSINESS REGULATIONS, CHAPTER 7, LIMITED DURATION BUSINESS LICENSES, OF THE McCALL CITY CODE TO ENACT SECTION 4.7.6, CRAFT FAIRS AND BAZAARS; APPLICATION, PERMIT, AND FEE, ALLOWING FOR THE PERMITTING OF CRAFT FAIRS AND BAZAARS WITHIN THE CITY OF McCALL, ESTABLISHING THE REQUIREMENTS FOR LOCATION, SIGNAGE AND FEES AND PROVIDING AN EFFECTIVE DATE THEREFOR. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF McCALL, VALLEY COUNTY, IDAHO: Section 1: That Section 4.7.6, Craft Fairs and Bazaars; Application, Permit, and Fee, to Title 4, Business Regulations, Chapter 7, Limited Duration Business Licenses, of the McCall City Code, be, and the same is hereby, ENACTED as follows, to -wit: See Exhibit A attached hereto and, by this reference, incorporated herein as if set forth in full. Section 2: This ordinance shall be in full force and effect after its passage, approval and publication, according to law. CRAFT FAIRS AND BAZAARS; APPLICATION, PERMIT, AND FEE: (A)A permit for Craft Fairs and Bazaars may be issued for a location on private property, on City right of way, or other City property, provided that insurance is provided with the City as a coinsured if on City property or right of way. A Craft Fair or Bazaar shall pay a license fee as set from time to time by Resolution of the City Council. (B) The Craft Fair and Bazaar organizers must collect all state and local applicable taxes and remit within the required time frame. (C) Allowable signage for Craft Fairs and Bazaars 1. Limit the square footage of allowable vendor signage to 15 total sq. ft. 2. The maximum square footage includes a -frame portable signs so long as they are not located on a sidewalk or public pathway and are within 25 feet from the point of sale. 3. The maximum square footage includes flags or banners, so long as the flags or banners are not free-standing (i.e. should be mounted to the vendor's tent, truck, table, booth etc.). 4. Individual vendors are limited to signage displayed within their allotted vending space within the event. (D) To receive a permit for Craft Fairs and Bazaars from the City an application for such license shall be made to the City Clerk in such form and manner as provided by the City Clerk's office and will include the following: 1. Name and description of the applicant; 2. Address, both legal and local; 3. Location of event; 4. The date or dates for which the permit is requested; 5. Expected attendance; 6. When the applicant proposes to have vendors who sell any prepared food product for human consumption (other than frozen products not intended for immediate consumption), an approval from Central District Health that the proposed method of food preparation and service meets applicable health standards for each vendor. 7. When the applicant proposes to have vendors who sell any products they must collect all applicable state and local taxes. Page 2 of 3 Ordinance 947 Enacting 4.7.6 August 11, 2016 8. The license fee. (E) The fee for the license or permit shall be set from time to time by Resolution of the City Council. Such fees shall be non-refundable. Page 3 of 3 Ordinance 947 Enacting 4.7.6 August 11, 2016 A SUMMARY OF ORDINANCE NO. 947 PASSED BY THE CITY OF McCALL, IDAHO AN ORDINANCE OF THE CITY OF McCALL, VALLEY COUNTY, IDAHO, AMENDING TITLE 4, BUSINESS REGULATIONS, CHAPTER 7, LIMITED DURATION BUSINESS LICENSES, OF THE McCALL CITY CODE TO ENACT SECTION 4.7.6, CRAFT FAIRS AND BAZAARS; APPLICATION, PERMIT, AND FEE, ALLOWING FOR THE PERMITTING OF CRAFT FAIRS AND BAZAARS WITHIN THE CITY OF McCALL, ESTABLISHING THE REQUIREMENTS FOR LOCATION, SIGNAGE AND FEES AND PROVIDING AN EFFECTIVE DATE THEREFOR. • This Ordinance adds a new section for Craft Fairs and Bazaars to the Business Regulation section of the McCall City Code. The principal provisions of the Ordinance allow craft fairs and bazaars on private property, City rights of way or other City property upon receipt of the proper license; require insurance naming the City as a coinsured if on City property; provide for the payment of a non-refundable license fee and that organizers collect and timely remit applicable state and local taxes; limit vendor signs to 15 total square feet displayed within their allotted vending space, including a -frame portable signs not located on sidewalks or public pathways and within 25 feet from point of sale and non free-standing flags or banners; specify that permits for craft fairs and bazaars are issued by the City Clerk upon a completed application which will include the name and description of the applicant, address, event location, dates for which permit is requested, expected attendance, that the method of preparation and service of products to be sold for human consumption (other than frozen products not intended for immediate consumption) has the approval of Central District Health, That the effective date of the Ordinance is upon its passage and publication as required by law.
