HomeMy Public PortalAbout1998_09_08_R189 The Town of Leesburg, Virginia RESOLUTION NO A RESOLUTION: PRESENTED September 8, 1998 98-189 ADOPTED September 8, 1998 APPROVING THE VACATION OF A PORTION OF AN OVERLAND RELIEF EASEMENT WITHIN TAVISTOCK FARMS, SECTIONS 20 AND 21 WHEREAS, Donald Miller of Arcadia Building Co. has requested that the Town vacate a portion of an overland relief easement within Tavistock Farms, Section 20 and 21; and WHEREAS, the portion of the easement to be vacated is no longer needed due to changes in the storm drainage and over lot grading which reduced the size of the easements in these section. THEREFORE, RESOLVED, by the Council of the Town of Leesburg in Virginia as follows: SECTION I. That portion of the overland relief easement labeled as "Portion of EX. 100 year Overland relief Esm't Hereby Vacated" as shown on the plat of vacation titled "Plat showing Storm Sewer Easements and Vacation of a Portion of Overland Relief Easements, Section Twenty, Tavistock Farms, Deed Book, Page 1657, and Section Twenty-one, Tavistock Farms, Deed Book 1095, Page 1672, Town of Leesburg" dated January 21, 1998, and prepared by Bengtson, DeBell & Elkin, LTD is hereby vacated. SECTION II. This resolution shall be in effect upon recordation of the associated plat of vacation as referenced above. PASSED this 8_~_m day of September, 1998. ATTEST: Ja3la~s E.
