HomeMy Public PortalAboutResolution 69-965RESOLUTION NO. 69 -965 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DENYING A CONDITIONAL USE PERMIT IN CASE NO. 69 -291. THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES RESOLVE: SECTION 1. That the City Council does hereby find, determine and declare as follows: (a) That the owners of certain real property located in the City of Temple City, County of Los Angeles, State of California, located at 9503 Las Tunas Drive in said City, more particularly described as: Lots 289, 290, 291 and 292 of Tract No. 6561, Book 72, Pg. 34 and 35 of Maps in the Office of the County Recorder, County of Los Angeles, State of California have heretofore filed an application for a conditional use permit to construct and operate a drive -in restaurant in a C -2 Zone; and (b) That after a denial by the Planning Commission, the City Council conducted a duly noticed public hearing on such application, that said hearing was duly closed; and (c) That based upon the evidence adduced at said hearing, the Planning Commission files and applicable staff reports, and each member of the Council being familiar with the pro- posed site, said City Council determines that the facts required by Section 9203 of the Temple City Zoning Ordinance were not present, in that: (1) The site is not adequate in size to accommodate the applicant's plan and the evidence showed that the applicant is unable or unwilling to modify his plans. (2) That the property relates to traffic in a hazardous manner for the proposed use, since Cloverly is a narrow residential street and increased driveway traffic generated by the proposed use on Las Tunas will be dangerous to the extensive pedestrian traffic at this location. (3) The proposed use of the property would be materially detrimental to surrounding property and to the area due to the following facts: That the area has many residential apartments which will be adversely affected; the use would generate noise at night; the proposed washrooms are so located as to enter directly from the public sidewalk; and the property is not a proper location for the proposed use in that it abuts residential uses. Resolution No. 69 -965 SECTION 2. That the conditional use permit application hereinabove described be and the same is hereby denied for the reasons above set forth. SECTION 3. The City Clerk shall certify to the adoption of this Resolution. ADOPTED and APPROVED this 21st day of October , 1969. fi?
