HomeMy Public PortalAboutORD-CC-1999-16CITY OF MOAB TEMPORARY ORDINANCE # 99-16 AN ORDINANCE ENACTING A TEMPORARY MORATORIUM ON NEW BED AND BREAKFAST BUSINESS LICENSES. WHEREAS Bed and Breakfast establishments can have a significant impact upon residential neighborhoods, if not properly constructed and managed. WHEREAS the Bed and Breakfast establishments form an important part of the local lodging industry; WHEREAS the City of Moab finds that it has a compelling interest in the clarification of its ordinances and the rational and orderly control of development; and WHEREAS U.C.A. 10-9-404, as amended, authorizes cities to enact temporary regulations prohibiting or restricting certain land uses for a period not to exceed six months. NOW THEREFORE, it is enacted as follows: 1. Moratorium. A moratorium on the issuance of new Bed and Breakfast Conditional Use Permits and Business Licenses shall take effect immediately upon the effective date of this ordinance. 2. Exceptions. This moratorium shall not apply to applications for renewal of conditional use permits and business licenses for bed and breakfast establishments licensed and operating prior to the effective date of this ordinance, provided the permittee does not seek a modification or change to the original permit and the permittee is otherwise in compliance with the existing ordinance and all permit terms. The moratorium shall similarly not apply to new permits or licenses sought pursuant to a change of ownership of an existing licensed bed and breakfast facility, provided the new applicant does not seek a modification or change to the original permit and the facility is otherwise in compliance with the existing ordinance and all permit terms. 3 . Duration. This ordinance shall remain in effect until rescinded by action of the Moab City Council, or until six months from the date of enactment, whichever first occurs. The ordinance shall take effect immediately upon passage. 4. Ordinance Review. During the moratorium the City staff is directed to review existing bed and breakfast regulations for the purpose of updating and clarifying the City Code.
