VILLAGE COUNCIL First Budget Hearing Minutes September 18, 2017 At 7:00 PM Sea View Hotel • 9909 Collins Avenue • Bal Harbour • Florida 33154 (The First Budget Hearing, originally scheduled for September 12, 2017 was changed to September 18, 2017 due to Hurricane Irma. The meeting was then relocated from Bal Harbour Village Hall to the Sea View Hotel due to the lack of air conditioning at Village Hall resulting from damages caused by the hurricane.) CALL TO ORDER/PLEDGE OF ALLEGIANCE - Mayor Groisman called the meeting to order at 7:05 PM. The following were present: Mayor Gabriel Groisman Assistant Mayor Seth Salver Councilman David Albaum Councilwoman Patricia Cohen Councilman Jeffrey Freimark Also present: Jorge M. Gonzalez, Village Manager Dwight S. Danie, Village Clerk Susan L. Trevarthen, Village Attorney The Pledge of Allegiance was led by Mayor Gabriel Groisman. He then thanked Manager and Village Staff for their combined efforts pertaining to Hurricane Irma with a special acknowledgment to Raj Singh for his contributions in housing the Command Center and in providing meeting space for the First Budget Hearing. Mayor Groisman announced the birthday of Jorge Gonzalez, Village Manager. REQUESTS FOR ADDITIONS, WITHDRAWALS AND DEFERRALS There were no requests. FIRST BUDGET HEARING R7 - RESOLUTIONS R7A A RESOLUTION OF THE VILLAGE COUNCIL OF BAL HARBOUR VILLAGE, FLORIDA, ADOPTING THE PROPOSED MILLAGE RATE OF THE VILLAGE FOR THE FISCAL YEAR COMMENCING OCTOBER 1, 2017 THROUGH SEPTEMBER 30, 2018, PURSUANT TO SECTION 200.065, FLORIDA STATUTES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. (FINANCE DEPARTMENT) Mr. Gonzalez introduced the item and recommended keeping the current millage as it is currently (1.9654 mils). He stated that the roll -back rate would be 1.8933 mils and that the proposed rate is 3.81% higher than the current year rolled -back rate and that it was the third lowest millage rate in County. He said that this rate would continue to fund the operations of Village and he pointed out that the bulk of the additional revenue from the Oceana was proposed to fund capital projects identified by the Council. There were no comments from the general public. MOTION: A Motion to approve the proposed millage rate was moved by Assistant Mayor Seth Salver and seconded by Mayor Gabriel Groisman. R7B A RESOLUTION OF THE VILLAGE COUNCIL OF BAL HARBOUR, VILLAGE, FLORIDA, APPROVING AND ADOPTING THE TENTATIVE BUDGET AND CAPITAL IMPROVEMENT PLAN FOR BAL HARBOUR VILLAGE FOR FISCAL YEAR 2017-18; PROVIDING FOR EXPENDITURE OF FUNDS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. (FINANCE DEPARTMENT) Bal Harbour Village Council First Budget Hearing Minutes — Sep. 18, 2017 Page 12 Mr. Gonzalez introduced the item stating that total proposed budget for all funds is $26,133,000 which includes a Capital Improvement Program amount of $3.8 million. Councilwoman Cohen ask Mr. Gonzalez to break down the funding of the sewer project. Mr. Gonzalez commented that Phase II of the sewer project was under redesign and would be less intrusive then he provided a brief history of the funding of the project. Mr. Gonzalez then provided a brief description of the changes and proposed enhancements to the proposed budget. He then provided a summary of the proposed budget for Resort Tax. Mr. Gonzalez described the process undertaken by the Budget Advisory Committee in providing input to the budget. MOTION: A Motion to approve proposed budget was moved by Assistant Mayor Seth Salver and seconded by Councilwoman Patricia Cohen. Councilwoman Cohen suggested that there be enhanced opportunities for Council to provide input to the Budget Advisory Committee, to which Mayor Groisman agreed, stating that he had attended meetings and offered his suggestions. He suggested that next year, the Council initially meet with the Budget Committee in a public setting. Assistant Mayor Salver suggested that, especially given the effects of Hurricane Irma, dollars be set aside for Collins Avenue. A general discussion ensued regarding short term solutions for beautifying Collins Avenue versus a utilizing a strategic approach. Mr. Gonzalez then describe how the estimates for the proposed capital expenditure amounts, including information and technology, were derived. Babak Raheb (128 Balfour Drive) voiced his concerns about the importance of input from the Budget Advisory Committee and the Council into the budget process. He also suggested budgeting for the provision of beach furniture and facilities for those living on the west side of Collins. Tony lmbesi (175 Camden Drive) asked about the status of beach erosion, to which Mr. Gonzalez replied that there are Resort Tax dollars set aside and he described how the Village is working with the State and the County. R7C A RESOLUTION OF BAL HARBOUR VILLAGE, FLORIDA, RELATING TO THE COLLECTION AND DISPOSAL OF SOLID WASTE AND RECYCLABLE MATERIALS IN BAL HARBOUR VILLAGE, FLORIDA; DESCRIBING THE METHOD OF ASSESSING SOLID WASTE COSTS AGAINST ASSESSED PROPERTY LOCATED WITHIN BAL HARBOUR VILLAGE, FLORIDA; DETERMINING THE SOLID WASTE COST AND THE INITIAL SOLID WASTE SERVICE ASSESSMENTS; DIRECTING THE PREPARATION OF AN ASSESSMENT ROLL; AUTHORIZING A PUBLIC HEARING AND DIRECTING THE PROVISION OF NOTICE THEREOF; AND PROVIDING AN EFFECTIVE DATE.. (FINANCE DEPARTMENT) MOTION: The item was moved by Assistant Mayor Seth Salver and seconded by Councilwoman Cohen. Mr. Gonzalez introduced the item stating that the rate would remain the same as last year and would be equal to $480.32 for each single family residential unit and $224.74 for multifamily dwelling units. Babak Raheb (128 Balfour Drive) stated his concern that the rate did not account for the square footage of a residential unit, stating that he believed more waste was generated by larger units. Bal Harbour Village Council First Budget Hearing Minutes — Sep. 18, 2017 Page 14 R7D A RESOLUTION OF BAL HARBOUR VILLAGE, FLORIDA, RELATING TO THE PROVISION OF SECURITY AND LANDSCAPE SERVICES, FACILITIES AND PROGRAMS IN THE GATED RESIDENTIAL SECTION OF BAL HARBOUR VILLAGE, FLORIDA; ESTABLISHING THE RATE OF ASSESSMENT; IMPOSING SECURITY AND LANDSCAPE SERVICE ASSESSMENTS AGAINST ASSESSED PROPERTY LOCATED WITHIN THE GATED RESIDENTIAL SECTION OF BAL HARBOUR VILLAGE, FLORIDA; APPROVING THE ASSESSMENT ROLL; CONFIRMING THE INITIAL ASSESSMENT RESOLUTION; AND PROVIDING AN EFFECTIVE DATE. (FINANCE DEPARTMENT) Mr. Gonzalez introduced the item providing a brief history of the gated community and the ongoing creation of a civic association. He stated that there was a consensus from members of the Gated Community to raise the annual rate to fully fund the operating budget. MOTION: A Motion to approve the resolution was moved by Councilwoman Cohen and seconded by Councilman Freimark. Babak Raheb (124 Balfour Drive) stated his concern that the rate was not based on the size of the property. He also stated that the rate did not separate landscape costs from security costs. He stated that the tax was improper because the gated community was a private entity. Mirelle Gonzalez (32 Bal Bay Drive) expressed her concerns about the gate security stating that people were losing items from their yards. Councilwoman Cohen expressed her discomfort with voting on the item then left the dais at 8:05 PM and the Council took a recess. The Council reconvened at 8:10 PM. (FINANCE DEPARTMENT) Mr. Gonzalez provided a summary of the item. Amber Riviere (Director of Finance) explained the Miami -Dade County Water & Sewer and Miami Beach incorporation of rate increases for water and wastewater. MOTION: A Motion to approve the resolution was moved by Assistant Mayor Salver and seconded by Councilwoman Cohen. Babak Raheb (124 Balfour Drive) questioned the 3,000 gallon minimum monthly charge given the transitory nature of many residents. (MANAGER'S OFFICE) Mr. Gonzalez summarized the item stating that a zero percent increase resulting from negotiations with the provider. VOTE: The Motion passed by unanimous voice vote (5-0) R9 - NEW BUSINESS AND COUNCIL DISCUSSION R9A - Public Comment Babak Raheb (124 Balfour Drive) stated that he did not receive any communications from the Village just after Hurricane Irma. Mr. Gonzalez reported that multiple emails and text messages were sent every day. R10 - VILLAGE MANAGER REPORT Mr. Gonzalez provide a brief update regarding the clearing of hurricane debris and stated that he would provide a more thorough report at the October 26 Village Council Meeting. R11 - VILLAGE CLERK REPORT R12 - VILLAGE ATTORNEY REPORT Ms. Trevarthen announced an Executive Sessions: Lynn Bloch Mullen et al vs Bal Harbour Village.
