Bal Harbour Village Council Regular Council Meeting Minutes December 14, 2021 At 6:30 PM Bal Harbour Village Hall • 655 - 96th Street • Bal Harbour • Florida 33154 This meeting was conducted in -person and virtually via "Zoom" in order to minimize exposure to the Coronavirus to Councilmembers and members of the public. The meeting was also broadcast on the Village's website (www.balharbourfl.gov) and members of the public were encouraged to participate by email (meetings@balharbourfl.gov) or by telephone at 305-865- 6449. CALL TO ORDER/ PLEDGE OF ALLEGIANCE - Vice Mayor Salver called the meeting to order at 6:41 P.M. following the workshop regarding the Village Manager's compensation. The following were present: Vice Mayor Seth Salver Councilman David Albaum Councilman Jeffrey Freimark Councilman Buzzy Sklar The following were not present: Mayor Gabriel Groisman Also present: Jorge M. Gonzalez, Village Manager Dwight S. Danie, Village Clerk Robert Meyers, Deputy Village Attorney The Pledge of Allegiance was led by Vice Mayor Salver. CONSENT AGENDA C6 - COUNCIL MINUTES C6A November 16, 2021 Regular Council Meeting Minutes C7 - CONSENT AGENDA RESOLUTIONS C7A A RESOLUTION OF THE VILLAGE COUNCIL OF BAL HARBOUR VILLAGE, FLORIDA; SETTING COUNCIL MEETING DATES FOR THE 2022 CALENDAR YEAR; PROVIDING FOR IMPLEMENTATION; PROVIDING FOR AN EFFECTIVE DATE. C7B A RESOLUTION OF THE VILLAGE COUNCIL OF BAL HARBOUR VILLAGE, FLORIDA; AUTHORIZING AND APPROVING THE DONATION OF $5,000.00 OF LAW ENFORCEMENT TRUST FUNDS TO "DO THE RIGHT THING OF MIAMI, INC."; PROVIDING FOR IMPLEMENTATION; AND PROVIDING AN EFFECTIVE DATE. C7C A RESOLUTION OF THE VILLAGE COUNCIL OF BAL HARBOUR VILLAGE, FLORIDA; APPROVING THE AGREEMENT WITH ZETA ENTERTAINMENT FOR SPECIAL EVENT PRODUCTION DURING FY 2021-22 IN AN AMOUNT NOT TO EXCEED $70,000; APPROVING AN INITIAL TERM OF ONE YEAR WITH TWO ADDITIONAL ONE-YEAR RENEWAL OPTIONS; PROVIDING FOR IMPLEMENTATION; AND PROVIDING FOR AN EFFECTIVE DATE. MOTION: A motion to approve the Consent Agenda was moved by Councilman Buzzy Sklar and seconded by Councilman David Albaum. VOTE: The Motion passed by unanimous voice vote (4-0). R5 - ORDINANCES R5A AN ORDINANCE OF BAL HARBOUR VILLAGE, FLORIDA, AMENDING CHAPTER 8 "ELECTIONS" OF THE VILLAGE'S CODE OF ORDINANCES TO CLARIFY THE DETERMINATION OF PERSON ELECTED AND THE UTILIZATION OF A RUN-OFF ELECTION IN THE EVENT OF A TIE VOTE; PROVIDING FOR CODIFICATION, SEVERABILITY, CONFLICTS, AND FOR AN EFFECTIVE DATE. Bal Harbour Village Council Regular Meeting Minutes — December 14, 2021 Pa g e 1 2 Mr. Gonzalez introduced the item saying that this ordinance clarifies an ambiguity in the Village Charter and Code by adding language to the Code saying that a run-off election is required if there is a tie vote. There were no comments from the public. MOTION: A Motion to pass the Ordinance on second reading was moved by Councilman Buzzy Sklar and seconded by Councilman Jeffrey Freimark. R7 - RESOLUTIONS R7A A RESOLUTION OF THE VILLAGE COUNCIL OF BAL HARBOUR VILLAGE, FLORIDA, ESTABLISHING AN EFFECTIVE DATE TO APPLY THE PROCESSES ENUMERATED IN CHAPTER 10, ARTICLE I I I OF THE VILLAGE'S CODE OF ORDINANCES TO ALL BEACH EQUIPMENT; PROVIDING FOR IMPLEMENTATION. Mr. Gonzalez introduced the item saying that earlier in the year the Village Council had passed an ordinance regarding specifications for beach huts and that this resolution, allowed by that ordinance, focused on specification for beach equipment, including beach chairs, umbrellas, boxes and so forth. He said that there is a general consensus from the condo building managers regarding the establishment of basic minimum requirements for quality which would also be governed by a site plan. Captain Mauricio Escarra, Bal Harbour Police, said that he had been having bi-weekly calls with the building managers and had gained consensus on the standards with the goal to have a higher quality appearance and keep a necessary footprint on the beach where stored equipment could be shielded. He provided an overview of current equipment and provided examples of approved designs and UL standards. He described the administrative review process that will be used for new purchase and location of new equipment. MOTION: A Motion to pass the Resolution was moved by Councilman Jeffrey Freimark and seconded by Councilman Buzzy Sklar. VOTE: The Motion passed by unanimous voice vote (4-0). R7B A RESOLUTION OF THE VILLAGE COUNCIL OF BAL HARBOUR VILLAGE, FLORIDA; AUTHORIZING DISBURSEMENT OF VILLAGE GENERAL EMPLOYEE AND VILLAGE MANAGER PERFORMANCE BONUSES; PROVIDING FOR IMPLEMENTATION; PROVIDING FOR AN EFFECTIVE DATE. Mr. Gonzalez introduced the item saying that non-sworn supervisory employees were eligible for an up to 5% bonus, and in-line employees were eligible for an up to 4% bonus, that would be prorated for newly hired employees. Mr. Meyers suggested that the resolution be amended to reflect the Village Council's recommendation provided at the workshop held prior in the evening to defer the award of the Village Manager's compensation/bonus/retirement until the March 2022 Village Council Retreat. MOTION: A Motion to pass the Resolution with the amendment to Section 2B being deferred until March was moved by Councilman Jeffrey Freimark and seconded by Councilman Buzzy Sklar. VOTE: The Motion passed by unanimous voice vote (4-0).
