VILLAGE COUNCIL Regular Meeting Minutes September 26, 2017 At 7:00 PM Rescheduled from September 18, 2017 due to. Hurricane Irma Bal Harbour Village Hall • 655 - 96th Street • Bal Harbour • Florida 33154 CALL TO ORDER / PLEDGE OF ALLEGIANCE (The Second Budget Hearing, originally scheduled for September 18, 2017 was changed to September 26, 2017 due to Hurricane Irma. CALL TO ORDER/PLEDGE OF ALLEGIANCE - Mayor Groisman called the meeting to order at 7:03 PM. The following were present: Mayor Gabriel Groisman Assistant Mayor Seth Salver Councilman David Albaum Councilwoman Patricia Cohen Councilman Jeffrey Freimark Also present: Jorge M. Gonzalez, Village Manager Dwight S. Danie, Village Clerk Susan L. Trevarthen, Village Attorney Stephanie Marquez -Quintero, Deputy Village Clerk The Pledge of Allegiance was led by Mayor Gabriel Groisman: SECOND BUDGET HEARING Items for the Second Budget Hearing were considered before Items for the Regular Village Council Agenda. Mr. Gonzalez announced that due the Hurricane Irma, the elevator was inoperable, and that a room had been set up on the 1st floor to allow accessible meeting participation for those who elected. R7 - BUDGET RESOLUTIONS R7A A RESOLUTION OF THE VILLAGE COUNCIL OF BAL HARBOUR VILLAGE, FLORIDA, ADOPTING THE FINAL MILLAGE RATE OF THE VILLAGE FOR THE FISCAL YEAR COMMENCING OCTOBER 1, 2017 THROUGH SEPTEMBER 30, 2018, PURSUANT TO SECTION 200.065, FLORIDA STATUTES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. Mr. Gonzalez introduced the item and recommended keeping the millage as its current rate (1.9654 mils). He stated that the roll -back rate would be 1.8933 mils and that the proposed rate is 3.81% higher than the current year rolled -back rate and that it was the third lowest millage rate in County. He said that this rate would continue to fund the operations of Village and he pointed out that the bulk of the additional revenue from the Oceana was proposed to fund capital projects identified by the Council. MOTION: A Motion to approve the proposed millage rate was moved by Councilman Jeffrey Freimark and seconded by Assistant Mayor Seth Salver. Babak Raheb (128 Balfour Drive) commented that the millage rate is technically not the same because the solid wasted assessment is now separate. R7B A RESOLUTION OF THE VILLAGE COUNCIL OF BAL HARBOUR, VILLAGE, FLORIDA, APPROVING AND ADOPTING THE FINAL BUDGET AND CAPITAL IMPROVEMENT PLAN FOR BAL HARBOUR VILLAGE FOR FISCAL YEAR 2017- 18; PROVIDING FOR EXPENDITURE OF FUNDS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. Mr. Gonzalez introduced the item stating that total proposed budget for all funds is $26,133,000, with a break down $16.1 million in the General Fund, $3.4 million in Resort Tax, $6 million in Water and Wastewater and $570,000 Security and Landscaping for the gated community. Bal Harbour Village Council Regular/Budget Hearing Minutes —September 26, 2017 Page 12 MOTION: A Motion to approve the proposed millage rate was moved by Councilman Jeffrey Freimark and seconded by Assistant Mayor Seth Salver. Babak Raheb (128 Balfour Drive) commented on the language that the Budget Advisory Committee approved the Budget by consensus and he commented that the $570,000 for Security and Landscaping did not distinguish between security and landscaping. Mr. Gonzalez stated that the Committee did vote on the millage rate, and did agree by consensus on other budget line -items. He stated that a breakdown of the activities does exist in the full line -item budget. Mayor Groisman suggested that the in the Manager's Memo to Council the language be amended to read "reached unanimous consensus, although without a formal vote due to lack of quorum recommended". REGULAR COUNCIL MEETING AGENDA Items for the Regular Village Council Meeting Agenda were considered after items for the Second Budget Hearing REQUESTS FOR ADDITIONS, WITHDRAWALS AND DEFERRALS There were no requests. PRESENTATIONS AND AWARDS - Proclamations & Recognitions Mayor Groisman presented videos/pictures taken during and after Hurricane Irma within Bal Harbour Village. Certificates of Appreciation were presented to Raj Singh and the Seaview Hotel, Mathew Lazenby and the Bal Harbour Shops, Russ Smith/Eric Austen and One Bal Harbour, and all Village employees for exceptional efforts before, during and after Hurricane Irma. Mayor Groisman explained that the Bal Harbour Shops, without hesitation, provided safe parking for residents and provided a staging area for debris to facilitate FEMA reimbursements. Bal Harbour Village Council Regular/Budget Hearing Minutes —September 26, 2017 Page I 3 Mr. Gonzalez described how the Incident Command Team originally slated to be housed in the St. Regis, was able to move to One Bal Harbour and then move to the Sea View Hotel, also without hesitation; corporate citizens providing a good contribution to the community. Mr. Gonzalez then provided a PowerPoint presentation showing a chronology of the operations of the Incident Command Team and Village staff. CONSENT AGENDA C6A - COUNCIL MINUTES C6A Approval of Minutes - July 11, 2017 Special Council Meeting C6B Approval of Minutes - July 18, 2017 Local Planning Agency Meeting C6C Approval of Minutes - July 18, 2017 Regular Council Meeting C7A - CONSENT AGENDA RESOLUTIONS C7A A RESOLUTION OF THE VILLAGE COUNCIL OF BAL HARBOUR VILLAGE, FLORIDA; AUTHORIZE AND APPROVE THE EXPENDITURE OF $42,525.00 TO PURCHASE AUTOMATIC EXTERNAL DEFIBRILLATORS; PROVIDING FOR IMPLEMENTATION; AND PROVIDING AN EFFECTIVE DATE. Councilwoman Cohen suggested that the Council take action on setting up a series of meetings to exclusively discuss the Future Land Use Map. Mr. Gonzalez provided an overview of meetings to be scheduled in late Autumn to the beginning of the new year. MOTION: A Motion to approve Consent Agenda was moved by Councilman Jeffrey Freimark and seconded by Assistant Mayor Seth Salver. VOTE: The Motion passed unanimous voice vote (5-0). R5 - ORDINANCES R5A AN ORDINANCE OF BAL HARBOUR VILLAGE, FLORIDA; AMENDING THE CODE OF ORDINANCES BY AMENDING ARTICLE II "VILLAGE COUNCIL" OF CHAPTER 2 "ADMINISTRATION" TO ADJUST THE SALARIES OF THE MAYOR AND VILLAGE COUNCIL TO REMAIN COMMENSURATE WITH NEIGHBORING MUNICIPALITIES; PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, CONFLICTS, AND FOR AN EFFECTIVE DATE. Mayor Groisman left the dais at 8:02 PM. Bal Harbour Village Council Regular/Budget Hearing Minutes —September 26, 2017 Page 1 4 Mr. Gonzalez provided a brief summary of the item. MOTION: The item was moved for discussion by Councilwoman Patricia Cohen and seconded by Councilman David Albaum. Babak Raheb (128, Balfour Drive) commented that people don't run for a public office for the money and that this item should be taken up later in the Fall when residents are back in the Village. He stated that the language regarding neighboring communities was misleading. Mayor Groisman returned to the dais at 8:06 PM. Councilwoman Cohen agreed with the comment regarding neighboring communities to which Ms. Trevarthen commented that the Council could make an amendment to the title of the resolution. Penny Sepler (10275 Collins Avenue) praised the communications from the Village throughout Hurricane Irma. She asked why is the Council bringing this issue now when all along it has been fine. Tony lmbesi (175 Camden Drive) comment that compensation is a good idea because of the amount of time required by councilmembers. He commented that Bal Harbour could do what it wanted to do, not just what surrounding communities are doing. Councilman Freimark asked for clarification of section 2.26 of the ordinance to which Ms. Trevarthen explained that if at the end of the term the council person is currently serving, that person is re-elected, then they would be eligible for the raise. There was a general consensus that the ordinance language should be clarified. Mayor •Groisman commented that he the higher level of compensation would be an incentive and increase the pool on interested candidates and that it would add to the seriousness of the obligation of the office. Assistant Mayor Salver agreed that this would be a good way to encourage people to run for public office. He stated that the obligations of the office are a full time job Councilwoman Cohen stated with she was in agreement with colleagues and added that this legislation could been delayed until October. MOTION: A motion to strike the words "commensurate with neighboring communities" from the ordinance title and second Whereas clause was moved by Mayor Gabriel Groisman and seconded by Assistant Mayor Seth Salver. VOTE: The Motion passed by unanimous voice vote (5-0). Bal Harbour Village Council Regular/Budget Hearing Minutes —September 26, 2017 Page 1 5 MOTION: A Motion to amend section 2-26 of the ordinance to read "Salaries shall be paid on a monthly basis with any increase to be paid to the Mayor and Council members enacting this section only following their election to a new term of office" was moved Councilman Jeffrey Freimark and seconded by Assistant Mayor Seth Salver. R7 - REGULAR COUNCIL MEETING RESOLUTIONS R7C A RESOLUTION OF THE VILLAGE COUNCIL OF BAL HARBOUR VILLAGE, FLORIDA; APPROVING THE FIRST AMENDMENT TO THE ORIGINAL AGREEMENT DATED APRIL 27, 2012 BETWEEN BAL HARBOUR VILLAGE AND PROGRESSIVE WASTE SOLUTIONS OF FLORIDA, INC. D/B/A WASTE, CONNECTIONS OF FLORIDA; PROVIDING FOR IMPLEMENTATION; PROVIDING FOR AN EFFECTIVE DATE. MOTION: The item was moved for discussion by Assistant Mayor Seth Salver and seconded by Councilman Jeffrey Freimark. Mr. Gonzalez summarized the item describing the terms of the contract highlighting that recycling pickup will be increased to 1 days per week and bulky trash pick will be one time per week. A general discussion ensued regarding educating the community on the availability of bulky trash pickup. Councilwoman Cohen suggested looking into passing an ordinance to require recycling. John Oldenburg, Director of Parks and Public Spaces, stated that he had data on that he could present to the Council and stated that the County has an ordinance requiring recycling. Mayor Groisman asked Mr. Oldenburg to bring the data to Council for a discussion regarding a local ordinance. Mr. Oldenburg provided an overview .of the existing recycling program stating that the older buildings do not have adequate recycling accommodations and the addition one Bal Harbour Village Council Regular/Budget Hearing Minutes -September 26, 2017 Page 1 6 more recycling day combined with education was aimed at facilitating the process. He described the benefits of recycling. Councilman Freimark agreed with Councilwoman Cohen regarding having the Council explore passing a local recycling ordinance. He asked Mr. Oldenburg if the vendor had considered raising its rates due to the recent storm, to which Mr. Oldenburg replied that the Vendor had not and provided the Village with exceptional service following the storm. Councilman Freimark asked if the consumer price index was overall or a subset, to which Mr. Gonzalez replied that it was CIP-U. (Consumer Price Index of Urban Consumers). Mayor Groisman asked Mr. Oldenburg to return to the next Council meeting with a report that would facilitate the formation of a local ordinance, and he asked the Village Attorney to distribute copies of the County ordinance and ordinance from other municipalities that would also facilitate the process. Babak Raheb (128 Balfour Drive) asked for clarifications of the Exhibits attached to the resolution and the methodologies utilized for single family residential units, units on the west side of Collins Avenue and units on the east side of Collins Avenue. He stated that the size of the unit should be considered in the methodologies. VOTE: the resolution passed by unanimous voice vote (5-0) R7D A RESOLUTION OF THE VILLAGE COUNCIL OF BAL HARBOUR VILLAGE, FLORIDA; RATIFYING THE VILLAGE MANAGER'S DECLARATION, EXTENSION AND TERMINATION OF A STATE OF EMERGENCY DUE TO HURRICANE IRMA; RATIFYING THE VILLAGE MANAGER'S ACTIONS TAKEN PURSUANT TO HIS POWERS UNDER THE VILLAGE STATE OF EMERGENCY AND THE FLORIDA GOVERNOR'S EXECUTIVE ORDER 17-235 DECLARING A STATE OF EMERGENCY FOR THE STATE OF FLORIDA FOR HURRICANE IRMA;. PROVIDING FOR AN EFFECTIVE DATE. MOTION: A Motion to approve the resolution was moved by Assistant Mayor Seth Salver and seconded by Councilman Jeffrey Freimark. VOTE: The Motion passed unanimous voice vote (5-0). R9 - NEW BUSINESS AND COUNCIL DISCUSSION R9A PUBLIC COMMENT Babak Raheb (128 Balfour Drive) asked for justification of the Council raises to which Councilwoman Cohen commented that the Council had thoroughly discussed the justifications.
