HomeMy Public PortalAboutResolution 2019-32, Bow And Arrow Deer And Coyote Hunting Rules and REgulations 2019/2020 Season RESOLUTION 2019-32 CITY OF RIVERDALE BOW AND ARROW DEER AND COYOTE HUNTING RULES AND REGULATIONS 2019-2020 SEASON WHEREAS, Bow and arrow deer and coyote hunting is allowed in the City of Riverdale during the period from September 14, 2019 through January 10, 2020, in areas of that City of Riverdale that are designated as a 'Special Hunt Area' by the Iowa DNR; and, WHEREAS, Each hunter must comply with the Iowa Department of Natural Resources(DNR) regulations covering bow hunting of deer and coyote as well as the City of Riverdale deer and coyote hunting rules and regulations outlined below; and, WHEREAS,The hunter must: 1. Obtain a Riverdale Hunting Permit(cost$0); 2. Successfully complete an Iowa Department of Natural Resources bow hunter safety education course and a proficiency test. The proficiency test must be taken annually; 3. Hunt on a parcel zoned agricultural or divided in a parcel of not less than three acres, obtain the expressed permission of the owner of the parcel, and follow the rules and guidelines of the property owner. Council may approve on a case by case situation properties of less than 3 acres; 4. Maintain a minimum distance of 100 yards from any residence, occupied building, church, city park, street and/or roadway, other municipal property, or school property(exclusive of Scott Community College property, where the hunter must maintain a minimum distance of 100 yards from the College's buildings and parking lots), except with the permission of an owner of a residence or occupied building to allow hunting nearer than 100 yards of said building(as amended on the floor of the August 14, 2018 Council meeting); 5. Hunt during the hours and days when such hunting is allowed by State or City of Riverdale for the Bettendorf/Riverdale Special Deer Management Zone. Hunters must abide with state, county and City laws and regulations. In addition to Riverdale's Resolution 2019-32 hunters will use the Bettendorf rules and regulations for the Bettendorf and Riverdale hunting areas. 6. Use proper field dressing techniques and not leave entrails; 7. Possess all licenses or permits required by the State, County, or City to hunt deer with a bow; 8. Demonstrate compliance with these requirements to any police or DNR officer upon request; and 9. Harvested deer will be checked in at Spruce Hills Dr. Bettendorf Fire Station AFTER 7:30 AM and BEFORE 9:00 PM. 10. Only IA DNR Deer Management Zone licenses will be allowed. (Note: Statewide licenses are invalid); and, WHEREAS,Kingsley Wildlife Management Services, Bettendorf, has provided deer hunting services for the City of Riverdale in years past and has provided satisfactory service; and, Prepared by MFB/tdl September 5,2019 Resolution 2019-32 Page 2 WHEREAS, Kingsley Wildlife Management has provided the City with its proposal for services again for the 2019—2020 season,again at no charge. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RIVERDALE, SCOTT COUNTY, IN THE STATE OF IOWA: Section I. Through participation in the bow and arrow season, the Kingsley Wildlife Management Services("Kingsley")agrees that the property owner and/or the City of Riverdale are not liable for stolen deer stands or other equipment and items. The hunter agrees to hold harmless, indemnify and defend the property owner and/or the City of Riverdale in any action or claim resulting from participation in the bow and arrow season in the City of Riverdale. Section 2. Any violation of the agreement may result in the revocation of permits and/or criminal charges under state and local law, as appropriate. Hunters are encouraged to have a safety plan in case of emergency. Section 3. These rules and regulations may be amended or modified by further resolution of the City of Riverdale at any time. As in the past, our company will attempt to remove as many of the target species as possible. We believe we operate at the highest possible standards and maintain some of the highest safety policies possible. Our company of Kingsley Wildlife Management has been active for over ten years. We have also been the sole provider for the Scott Community College Management hunt. As part of the requirement to hunt in the City of Bettendorf,the City of Riverdale and Scott Community College we maintain all proper licenses, Hunter Safety Certifications and proficiency requirements. These documents can all be provided upon request. We also understand how sensitive hunting can sometimes be. We only hunt from elevated temporary stands that are removed at the end of each season, when removing deer we do it discretely by using tarps and sleds. The Iowa Department of Natural Resources has made available 125 antlerless deer licenses for archery only, from September 14, 2019 through January 10, 2020, for the cities of Bettendorf and Riverdale. Antlerless deer licenses may only be purchased at B & B Shooting Supplies located at 2152 State Street in Bettendorf. Each antlerless deer harvested must be checked in at the Bettendorf Fire Station located at 1933 Spruce Hills Drive, no later than 9 p m. This includes deer harvested in the City of Riverdale. Parking is available in the east parking lot next to the alley. DO NOT PARK IN FRONT OF THE BAY DOORS. If fire personnel are unavailable, please call Bettendorf Police Dispatch at 344-4015, select option 9. Dispatch will radio a police officer to respond to the fire station. The City of Bettendorf will issue a check for $20.00 to each hunter for every antlerless deer that is harvested in Bettendorf/Riverdale and checked at the Spruce Hills Fire Station. All city regulations must be followed to hunt within the city limits of Bettendorf and Riverdale. A copy of those regulations can be obtained at the Bettendorf Police Department, Riverdale City Hall, or B & B Shooting Supplies. The Iowa Department of Natural Resources is also recommending an `Either Sex Incentive License' for the 2019/2020 hunting season. If you decide to take the $20.00 incentive from the City of Bettendorf, you will not be eligible for the any sex tag incentive for the 2020/2021 season. The City of Bettendorf appreciates your assistance in helping thin the deer herd population within our city. Kimball Chief of Police CApiA TE-ARSON __;„,;„, Bette a premier city Regulations for Bow Deer Hunting Within the City of Bettendorf > Each hunter must register at the Bettendorf Police Department prior to obtaining licensing and proficiency examination. > Each zone captain hunting on private property not owned by that hunter and/or property owned by the City of Bettendorf must obtain a 'Land Owners Permission to Hunt' form from the Bettendorf Police Department. The zone captain will ensure each hunter for that zone is listed on the completed permission form submitted to the Bettendorf Police Department. The Bettendorf Police Department will then issue a 'Permission to Hunt Urban Deer' form to take to B & B Guns where a proficiency exam will be performed. Upon successful completion, a permission to hunt card signed by the Chief of Police will be issued and license sold by B & B Guns. > Each urban deer hunter must give contact information to the Chief of Police or his designee. > Neighboring property owners will be notified by the Police department that deer hunting will be taking place in their area. • If objection to hunting is received by an adjacent property owner, the deer advisory committee will review the request to hunt. • Certain hunting areas may have a time restriction of when hunting is allowed. > All hunting areas will have a sign posted, provided by the Police department, that bow deer hunting is in progress. > All deer must be checked at the Spruce Hills Fire Station no later than 9:00 p.m. If after 9:00 p.m., contact the Bettendorf Police Department at 563/344-4015. • No obvious remains of harvested deer shall remain at site of hunt. > If deer is shot with arrow and flees into residential or commercial area, notify Chief Kimball at 563/320-6187. > When tracking a shot deer in darkness, hunter must use a flashlight. > When tracking a shot deer, hunter must wear a reflective vest. • If deer is located after tracking, and deer has fallen on a residential or commercial property, an attempt to notify the property owner, prior to removal, must be made. If unsuccessful, a door hanger must be placed on door with hunter's information. Adopted this 1St day of August, 2019. 5-5A-4: WEAPONS: A. Dangerous Weapons; Underage Persons: 1. Dangerous Weapon Defined: A dangerous weapon is any instrument or device designed primarily for use in inflicting death or injury upon a human being or animal, and which is capable of inflicting death upon a human being when used in the manner for which it was designed, except a bow and arrow when possessed and used for hunting or any other lawful purpose. Additionally, any instrument or device of any sort whatsoever which is actually used in such a manner as to indicate that the defendant intends to inflict death or serious injury upon the other, and which, when so used, is capable of inflicting death upon a human being, is a dangerous weapon. Dangerous weapons include, but are not limited to, any offensive weapon, pistol, revolver or other firearm, dagger, razor, stiletto, switchblade knife, knife having a blade exceeding five inches (5") in length, or any portable device or weapon directing an electric current, impulse, wave, or beam that produces a high voltage pulse designed to immobilize a person. 2. Underage Persons: a. No person shall sell, give or otherwise supply dangerous weapons, as defined in subsection Al of this section, to any person, knowing or having reasonable cause to believe that person to be under eighteen (18) years of age, and no person under eighteen (18) years of age shall individually or jointly possess or control a dangerous weapon. b. Nothing contained herein shall be deemed to prevent possession of dangerous weapons by a person under eighteen (18) years of age while in the home with the consent of that person's parent or guardian, nor shall it be a violation of this section to possess a dangerous weapon in conjunction with martial arts training, when such possession is limited to a properly licensed martial arts school or facility and when the person's parent or guardian has given written authorization to participate in such training. 3. Penalty: The penalty for violation of this subsection A shall be as provided in section 1-4-1 of this code for each violation. Additionally, any use in violation of this section is hereby declared a public nuisance, and may be abated in any manner consistent with law. (2008 Code § 19-16; amd. 2015 Code) B. Discharge Of Weapons And Projectiles: 1. Prohibited Acts; Exceptions: It shall be unlawful to: a. Discharge any cannon or firearm of any description without first having obtained permission in writing from the mayor, unless the person discharging the firearm is a peace officer acting pursuant to the duties of his office. b. Discharge or propel any object by means of an air or spring loaded gun, slingshot, blowgun, bow or crossbow. c. Throw any stick, stone or other object at a vehicle, residence or auxiliary structure thereto without permission of the owner. 2. Penalty: Any person violating this subsection B shall be subject to the general penalty provisions of section 1-4-1 of this code. 3. Bow And Arrow Use; Conditions: It shall not be deemed a violation of this section to use a bow and arrow to hunt deer on land zoned agricultural and divided in a parcel of at least three (3) acres, with the following conditions: a. The person is the owner of the property or has permission from the owner to allow for bow hunting; b. The person bow hunting must successfully complete an Iowa department of natural resources bow hunter safety education course, or the equivalent, and a proficiency test must be taken annually; c. The person has any license or permit required by the state or county to hunt deer with a bow; d. Hunting will be done in accordance with all state or county laws or regulations; e. Hunting does not occur within one hundred (100) yards of any residence, church or occupied structure or park ground; f. Hunting takes place from an elevated position of at least four feet(4'). Elevated stands must have hunter's name and phone number on the stand; g. The person hunting can demonstrate compliance with these requirements to any police officer upon request; and h. As an alternative to subsection B3e of this section, any person may hunt on such terms and conditions approved by the chief of police and with the recommendation of the deer advisory committee for the sole purpose of deer control, including land zoned other than agricultural and parcels less than three (3) acres. (2008 Code § 19-17) 5-8-11 : FEEDING WILD DEER, RACCOONS AND COYOTE:' A. Prohibition; Exception: 1. It is unlawful to feed, provide feed or other attractants, to wild deer, raccoons and coyote within the city limits. 2. This section shall not apply to naturally growing grain, fruit or vegetable material, gardens, and ornamental plants. (Ord. 26-13, 9-17-2013) B. Penalty: Penalty for violation of this section shall be as provided in section 1-4-1 of this code. Each day of violation shall constitute a separate offense. (Ord. 26-13, 9-17-2013; amd. 2015 Code)
