ADOPTED December 8, 1998 AUTHORIZING AN AGREEMENT AND APPROVING A SUBSTITUTE PERFORMANCE GUARANTEE AND WATER AND SEWER EXTENSION PERMITS FOR POTOMAC STATION SECTION 6H WHEREAS, Council Resolution #98-269 adopted on November 24, 1998 authorized an agreement and water and sewer extension permits and approved a performance guarantee from Frontier Insurance Company in the amount of $514,324.80 as security to guarantee installation of the public improvements shown on the plans approved by the Director of Engineering and Public Works for Potomac Station Section 6H; and WHEREAS, the developer has requested to change the surety company from the Frontier Insurance Company to Reliance Insurance Company; and WHEREAS, the Reliance Insurance Company meets the town's requirement for a surety company. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: SECTION I. The manager shall execute the contract for public improvements for the improvements shown on the plans approved by the Director of Engineering and Public Works for Potomac Station Section 6H. SECTION II. The extension of municipal water and sewer for Potomac Station Section 6H is approved in accordance with Sections 15-9 and 19-18 of the Town Code. A RESOLUTION: -2- AUTHORIZING AN AGREEMENT AND APPROVING A SUBSTITUTE PERFORMANCE GUARANTEE AND WATER AND SEWER EXTENSION PERMITS FOR POTOMAC STATION SECTION 6H SECTION III. The corporate surety bond in a form approved by the town attorney from Reliance Insurance Company in the amount of $514,324.80 is approved as security to guarantee installation of the public improvements shown on plans approved by the Director of Engineering and Public Works for Potomac Station Section 6H.
