AUTHORIZING A TIME EXTENSION FOR COMPLETION OF PUBLIC
IMPROVEMENTS AND APPROVING A PERFORMANCE GUARANTEE
FOR TAVISTOCK FARMS SECTIONS 6, 9, 10, (1 l&12), 14, 18, (13, 19, 20 &
21) AND THE OFFSITE WATERLINE

Tavistock Farms Offsite Waterline $ 50,663.00
18, (13,19,20 & 21) and the Offsite Waterline:
WHEREAS, Arcadia Building Company, the developer of Tavistock Farms Sections 6, 9, 10, (11
& 12), 14, 18, (13,19,20 & 21) and the Offsite Waterline, has not completed all the required public
improvements in accordance with the approved construction drawings and town standards within the
two-year period agreed to in the contract for public improvements and previously approved time
extensions; and
WHEREAS, the developer has requested a one (1) year time extension to complete the public
improvements; and
WHEREAS, the contract time extension approved on April 22, 1997 by Council Resolution #98-
89 expired on April 23, 1998; and
WHEREAS, the town did not receive a request for a time extension for these sections of
Tavistock Farms until November 13, 1998; and
WHEREAS, corporate surety bonds in the following amounts from The American Insurance
Company was provided by the developer to guarantee the installation of public improvements in

2 l) AND THE OFFSITE WATERLINE
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
SECTION I. The corporate surety bond from The American Insurance Company are approved to
guarantee the installation of public improvements in Tavistock Farms Sections 6, 9, 10, (11 & 12), 14,
18, (13,19,20 & 21) and the Offsite Waterline:
SECTION II. A one (1) year time extension to April 23, 1999 for completion of the public
improvements is approved.
