HomeMy Public PortalAboutORD-CC-2000-08ORDINANCE 2000-08 AN ORDINANCE AMENDING SECTION 12.16.020 OF CHAPTER 12.16, TITLE 12, OF THE MOAB MUNICIPAL CODE REGARDING THE PARKING OF COMMERCIAL VEHICLES ON CITY STREETS. WHEREAS, the Moab City Council on advice of the Moab Planning Commission deems that it is necessary to amend the Moab City Code with respect to allowing certain commercial vehicles to park on city streets for a period of time: That Section 12.16.020 shall be amended in the Moab City Code as follows: 12.16.020 Parking of inoperable and commercial vehicles on streets. It is unlawful to park any inoperable vehicle, including trucks, passenger vehicles, travel trailers, campers or other trailers on any street within the city limits, for a period of more than seventy-two consecutive hours. An inoperable vehicle is one that: 1. Has any parts or attachments to the vehicle removed, broken or defective, so as to impede it's normal operation; 2. Has not received a legal state safety inspection; 3. A. Is not currently licensed by the state of Utah or other state or country, exposed to the view of the general public and not either enclosed in a building or structure or located on the sales lot of a licensed automobile dealer. B. Operative commercially licensed vehicles of over two ton capacity shall not be parked on the city streets at any time. Except vehicles with a two -ton capacity or more used for the specific purpose of moving residential households from one location to another are exempt, provided such vehicles shall not be parked for a period not to exceed forty-eight hours. Vehicles used for the express purpose of delivery are also exempt for a period not to exceed one hour while deliveries are being made. C. The police department may remove and impound any vehicle found to be in violation of the chapter. D. Any owner of any vehicle so removed and impounded may recover possession of his vehicle upon payment of all applicable fees incurred in the removal and impound process. PASSED, ADOPTED AND APPROVED by the Governing Body of the City of Moab in open session this 12"' day of December, 2000. This shall take effect immediately upon passage.
