Town of Brewster Health Department 2198 Main Street Brewster, Massachusetts 02631-1898 (508) 896-3701 Ext. 120 FAX (508) 896-4538 E-mail: brhealth@town.brewster.ma.us THE BREWSTER BOARD OF HEALTH EMERGENCY MEETING AUGUST 9, 2006 8:30AM Present: Ed Wanamaker, Chairman, Raquel Ellis, Vice Chairman, Joanne Hughes, James Reynolds, Dan Brightman, Nancy Ellis Ice, Health Director, Sherrie McCullough, Assistant Health Director, Attorney Paul Benatti, Chris Flavell, Fire Department, Shannon Haley, Police Department, Jean Sears, COA Director and Charles Sumner, Town Administrator. Meeting was called to order at 8:45AM by the Chairman EW. EW declared that this situation was an emergency and there could not be a delay for a BOH meeting, therefore the 48 hour posting requirement was not adhered to. This meeting was called for an emergency situation at the residence of James & Carol Robinson of 104 Beechtree Drive. A call from the personnel at the FD stated that the house was in disarray and an occupant of the house was very ill and a Health Agent needed to do an inspection. A Health Agent did go out and it was recommended that the house be declared unfit for human habitation. Attorney Benatti suggested that the Board order the occupants to clean it up, impose a deadline for clean up and that the home not be occupied until the work is complete. Motion: DB-declare this house unfit for human habitation. RE seconded. 5 yes. Motion: DB-condition of house may be the cause of sickness to the occupants of the house. JR seconded. 5 yes. Motion: RE-this is an emergency situation and time does not allow for notice to be given to the homeowner. 5 yes. Motion: DB-accept report from the Police Department and testimony from Chris Flavell of the Fire Department. RE seconded. 5 yes. Attorney Benatti believes the BOH should order proper removal and cleaning of items in the home. It would then need to be re-inspected and would only pass if no other violations were discovered. Violations must be corrected within 24 hours according to 410.830 and shall not exceed 30 days. Motion: DB-occupants need to move out and the house shall remain unoccupied until clean up is complete and an inspection is done. RE seconded. 5 yes. Motion: JH-send correction order and state that items that were in contact with feces and urine should be properly cleaned and or disposed of.
