THE BREWSTER BOARD OF HEALTH WORK MEETING
TUESDAY, AUGUST 15, 2006 AT 7:OOPM
TOWN HALL, ROOM A
Present: Ed Wanamaker, Chairman, Raquel Ellis, Vice Chairman, Joanne Hughes, James Reynolds,
Dan Brightman, Nancy Ellis Ice, Health Director and Tammi Mason, Administrative Clerk
7:00 Bob Swanson-discuss septic system at 39 Marion Lane
BS present. Spoke to the Board about his septic system that was put in, in 1988 for 4 bedrooms. His
permit application (which we are required to go by) however, states the septic system is good for 2
bedrooms. EW told BS that the Board's hands were tied and there was nothing they could do.
1. Update-2111 Main Street-Scott Reilly
NI told Board that a soil test has been scheduled for August 31, 2006 with Bennett & O'Reilly.
2. Discuss Private Well Regulations
Put on hold and invite well drillers in to discuss any changes they might think would be good. (Have
members bring blue binders, give them a reminder).
3. Discuss email from George Heufelder re: CLPH document
NI handed out additional information to the Board.
4. Application to Planning Board-preliminary Subdivision -Map 36, Parcels 1 & 5
Motion: JH-Board would like to see a cluster system used to better treat the wastewater. JR
seconded. 5 yes.
5. Performance Objective-approval
Objective #1-To identify all private wells in Brewster
Objective #2-To design/create a rental regulation
Objective #3-To stay up to date with deliverables of LEPC
Motion: DB-accept 3 objectives. JR seconded. 5 yes.

6. Request to review Brewster Farms again
)H spoke about calculations for supermarket. (all the convenience stores)
7. Update-Smith Pond
NI called David Ellis but has not had a response back as of yet. Board wants a letter still sent.
8. Update-104 Beechtree Drive
NI told the Board about SM going to the house and condemning it (unfit for human habitation). Mr.
Robinson spoke with NI and EW. Mr. Robinson is going to have Whalen restoration clean it up.

2. Monthly report for Ocean Edge (Send another letter to DEP stating that even with the
change of operators they still fail in the summer and an expansion is in the works, more
attention needs to be paid to the details of what is going on there. CC the attorney.

12. Letter from La Tanzi, Spaulding & Landreth, P.C. re: Bayside Seafood & Market (EW spoke
about approving them for 21 seats (temporarily). He noticed today that they have 6
picnic tables with 6 people at each table. He stated that he thought they needed to
remove a table and some chairs to go back to the original approved 21 seats. RE- send a
letter to owners that the Board decided that each picnic table seats 6 and they have to
eliminate enough seats to get to the 21 approved seats. ~R seconded. 5 yes.)
13. Memo from Sherrie McCullough re: 40 Sean Circle (RE-send letter to owners that the
Board will hold off on the fining, but they want everything cleaned up and vehicles gone
by September 1, 2006. If it's not picked up and vehicles are not gone, a ruling will be
made at that time. 7R seconded. 5 yes.

Add on's
NI spoke about the on going problems with JT's. They have been prepping food outside. Inspectors
have seen the violation several times.
Motion: DB-based on the findings of the health inspectors in the past 5 weeks with regards to
food handling and food prep, the Board has voted that if you are found in violation again you
will be closed down and your license will be suspended and will have to come before the
Board before can reopen. You can expect spot inspections by any of our health agents at any
time. RE seconded. 5 yes.
Motion: RE-we as a BOH empower individual Board members to spot check JT's restaurant. If
a gross violation is seen by any board member, they will have the power to close them down.
JR seconded. 5 yes.
Motion: DB-empower NI and SM to be able to close down the restaurant (including after
hours). ]H seconded. 5 yes.
NI handed out letter from DEP re: Eddy Elementary School.
