A RESOLUTION: 99-51 PRESENTED February 23, 1999 ADOPTED February 23, 1999 DIRECTING THE TOWN MANAGER TO REQUEST RIGHT-OF-WAY FOR TRAILVIEW BOULEVARD ON CARDINAL INDUSTRIAL PARK LOT 5 IN ACCORDANCE WITH RECORDED RESERVATION AND DEDICATION AGREEMENTS WHEREAS, On August 7, 1979 the Virginia Department of Highways and Transportation (Now VDOT) entered into a RESERVATION AND DEDICATION AGREEMENT with the owners of Cardinal Industrial Park stipulating that the lands of Cardinal Industrial Park lots 5, 8 and 9 are encumbered with a sixty (60) foot wide private easement for ingress and egress; and WHEREAS, the owners agreed to dedicate, upon VDOT request, the aforementioned sixty (60) foot wide ingress / egress easement for public street purposes, such dedication is to be without cost to VDOT. Further, the agreement exempts the owners of Cardinal Industrial Park from any costs of public street construction within the dedicated area; and WHEREAS, The dedication of the sixty (60) foot wide ingress / egress easement for public street purposes has occurred on Cardinal Industrial Park lots 8 and 9. Trailview Boulevard has been constructed on lots 8 and 9; and WHEREAS, The RESERVATION AND DEDICATION AGREEMENT has a life of twenty years and thus becomes null and void on August 7, 1999; and WHEREAS, The agreement is binding upon the successors and assigns of the original signatories. The Town of Leesburg is the successor to VDOT and thus has the right to request this dedication; and WHEREAS, during the approval process in 1991 for development on Cardinal Industrial Park lot 5A (lot 5A being the consolidation of the original lots 5 and 6) the owners agreed to an additional dedication of five (5) feet to bring the total right-of-way width to sixty-five (65) feet on Cardinal Industrial Park lot 5A. A RESOLUTION: DIRECTING THE TOWN MANAGER TO REQUEST RIGHT-OF-WAY FOR TRAILVIEW BOULEVARD ON CARDINAL INDUSTRIAL PARK LOT 5 IN ACCORDANCE WITH RECORDED RESERVATION AND DEDICATION AGREEMENTS THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: The Town Manager is authorized, on behalf of the town, to request in a form approved by the Town Attorney the dedication of sixty-five (65) feet of right-of-way on Cardinal Industrial Park lot 5A at this time.
