RESOLUTION DIRECTING DISCIPLINARY ACTION
TO DEPUTY CHIEF DENNIS NAGY
WHEREAS, on May 30, 1995, a two count indictment was recorded charging
Deputy Chief Dennis Nagy with false incrimination and retaliation against a witness
or informant; and
WHEREAS, N.J.S.A.40A:14-149.1 provides that if a Grand Jury returns an
indictment against an officer, said officer may be suspended from his duties without
pay until the case against him is disposed of; and
WHEREAS, pursuant to N.J.S.A 40A: 14-118, the Borough by ordinance, has
appointed the Mayor as the Appropriate Authority for the Police Department; and
WHEREAS, the Council recognizes the authority of the Chief of Police pursuant to
NJ.S.A.40A:14-118; and
WHEREAS, the Council having so designated and empowered the Mayor, and
creating a line of authority within the Police Department believes that the interests of
the Borough would be served by the suspension of Deputy Chief Nagy until the
disposition of the indictment.
NOW, THEREFORE, BE IT RESOLVED that the Borough Council does hereby
advocate the filing of charges by the Chief of Police to effectuate the immediate
suspension of Deputy Chief Dennis Nagy, without pay pursuant to N.J.S.A.40A: 14-
149.1.
BE IT RESOLVED that the Borough Council does hereby direct the Appropriate
Authority to file the necessary documents in order to effectuate the immediate
suspension without pay of Deputy Chief Dennis Nagy pursuant to N.J.S.A.40A: 14-
149.1, if not immediately done so by the Chief.
BE IT FURTHER RESOLVED that the Municipal Clerk is directed to effectuate
all necessary documents to notify the New Jersey Department of Personnel of the
Mayor's actions.
BE IT FURTHER RESOLVED that if the employee requests a hearing pursuant to
this action, an independent Hearing Officer be appointed to conduct a fair and
impartial hearing.
