HomeMy Public PortalAbout97-146RESOLUTION NO. 97-146 RESOLUTION OF THE CITY OF CLAREMONT DISAPPROVING THE LOS ANGELES COUNTY COUNTYWIDE SITING ELEMENT WHEREAS, Section 41700 of the California Public Resources Code requires that each county government prepare a countywide siting element; and WHEREAS, the Los Angeles County Countywide Siting Element has been completed under the auspices of the Los Angeles County Solid Waste Management Committee/lntegrated Waste Management Task Force; WHEREAS,. the City of Claremont questioned the appropriateness of a number of those assumptions; and WHEREAS, the Countywide Siting Element must be approved by a majority of the cities within the County containing a majority of the incorporated population of the County; and WHEREAS, the County of Los Angetes has submitted the Countywide Siting Element dated June 1997, to the City of Claremont for consideration and approval together with the certified Environmental Impact Report for the Siting Element; and WHEREAS, notice of a public hearing to confider approval or disapproval of the Countywide Siting Element by the City Council of the City of Claremont was given as required by faw; and WHEREAS, on September 23, 1997, the City Council held a public hearing at which approval or disapproval of the Countywide Siting Element was considered; and . Reso. No. 97-146 WHEREAS, at the public hearing all interested persons were given an opportunity to appear and be heard and the City Council considered all public comments. NOW, THEREFORE, BE !T RESOLVED that the City Council of the City of Claremont: Section 1. Finds that disposal quantities for future years are distorted in the Countywide Siting Element by the assumption that all cities will reach their required goal of 50% diversion by the year 2000 and maintain that diversion rate indefinitely without regard to the fact that one-half of Los Angeles County cities responded in a May 1997 Southern California Association of Governments survey that they were not prepared to meet the 50% diversion rate. Section 2. Finds that the tonnage summaries in the Countywide Siting Element are distorted by the failure to recognize imported waste from out-of- county areas while recognizing the exportation of waste from the county. Section 3. Finds that the Countywide Siting Element does not adequately consider regional impacts in that (1) landfill capacity proposed in the northern part of Los Angeles County does not address the needs of cities located in the eastem area of the County known as the San Gabriel Valley where the City of Claremont is located; (2) transferring waste by rail and/or large trucks long distances to other parts of the County may not be technically or economically feasible for cities located in the eastem area of the County; and (3) failure to plan for disposal or transfer facilities in all regions of the County will require some regions, such as the San Gabriel Valley, to incur higher disposal costs and to charge higher fees to residents and businesses in those regions. -2- Reso. Finds that of the five different scenarios proposed in the Countywide Siting Element, only two scenarios indicate landfill capacity throughout the fifteen-year planning period based on the optimistic assumption of expansion at all existing facilities, and/or the development of all proposed new landfill facilities, without regard to the fact that historically the siting and expansion of landfill facilities is a very time consuming and costly endeavor which relies on the support of the impacted community. The remaining three scenarios indicate a shortage of landfill capacity by the year 2000. Section 5. Finds that the Countywide Siting Element does not achieve the goal of identifying environmentally safe, technically feasible, and cost effective disposal facilities throughout the county; Section 6. Therefore, the City Council of the City of Claremont disapproves the Countywide Siting Element, dated June 1997.
