Brewster Town Office Building 1. Present: Chairman Henchy convened the Planning Board meeting at 7:OOPM in the Brewster Town Office Building with members Taylor, Tubman, Pierce, McMullen and Remy present. 2. LEGAL HEARING - SPECIAL PERMIT #COPD2005-29 - CORRIDOR OVERLAY PROTECTION DISTRICT BYLAW -Brewster Ladies Library -Located at 1822 Main Street - on Assessors' Map 25, Lot 8 - Modification of Special Permit 6502 - to allow annual library book sale in the basement of the library. The sale is typically held during the month of August and is the library's largest fund raiser. 3. Prior to the public hearing, the Board had requested written reports from the Department of Public Works, Police and Fire Chiefs, Board of Health, Water Department, Zoning Agent/Building Inspector and the Conservation Commission. There were no concerns to report. 4. Sitting on the Planning Board and present at the hearing were members Henchy, Taylor, Pierce, Tubman, Remy and McMullen. Chairman Henchy opened the hearing by reading the legal advertisement and making the applicant and parties in interest aware of their rights to appeal as required under Chapter 40A, Section 17. He stated that during the hearing any member of the Board or interested party could direct questions through the Chairman to a speaker relating to the proposal. He asked the applicant to make his presentation. Present: Christopher Kenny, President, Brewster Ladies Library Association. 5. In his presentation, Mr. Kenny stated: The Brewster Ladies' Library, Brewster's free public library, is operated by a private, non-profit corporation, the Brewster Ladies' Library Association. The library, founded in 1852, was financed exclusively by the Association until 1983. Currently, the Town funds approximately 80% and the Association 20% of the Library's $550,000 annual budget. The Town owns the Library building and the land; the Association owns the furniture and equipment and manages the Library. 6. The Book Sale has been held annually for a number of years and has become the second largest (after Membership) fundraising activity conducted by the Association. While originally stocked by surplus from the Library's collection, donated books from numerous sources are now collected throughout the year by a team of dedicated volunteers. The Sale is generally conducted during the month of August. Last year, more than $28,000 was raised. All monies were used to support the Library's operating budget. 7. The Sale is usually held during the month of August. The first few hours (9 - 11 AM) of the first day of the event are the most heavily trafficked. Last year we had approximately 150 attendees during the first two hours. A number of used book dealers generally attend early to buy in their areas of specialization. While the event runs over 4 weeks, attendance falls off dramatically after the first day. Average daily attendance after the first day is less than 100 per day and after the first week less than 50. The event is held during the same hours that the Library is open. 8. The event is held in the Library Storage area (outlined on the attached plan). Temporary shelving, accommodating some 40,000 volumes, is set up in roughly three quarters of the space. The Library has parking for 50 cars on site. In addition, there is extensive overflow parking (with an asphalt pathway) available next door at the Brewster Baptist Church. On the first day, there are numerous volunteers who direct attendees to appropriate parking locations (as well as monitoring the use of handicapped parking). We always contact the Brewster PD to alert them to the opening day. Obviously, a number of volunteers continue to work throughout the event. With the Board's concurrence, we are planning to begin this year's event on July 31, 2006. 9. The Board had no objections with the proposal, and knew that this has been an on going yearly project. It was brought to the attention of the Planning Board that they needed to modify their original special permit to allow this. The original Special Permit application provided a reference for possible future use of the Basement area. The use proposed is for one month of each year (August) for the annual book sale. 10. Motion by Taylor, Pierce second "approve the request for modification of Special Permit for Brewster Ladies Library to allow annual book sale to be held for the month of August and to commence on the last Monday in July before the first of August it with in the same week. All conditions and findings of the original Special Permit #6502 shall remain in effect. Roll call voted all voted in favor. 11. LEGAL HEARING -SPECIAL PERMIT #COPD2006-O1-CORRIDOR OVERLAY PROTECTION DISTRICT BYLAW - G. Howard Hays -Located at 2404 Main Street - on Assessors' Map 15, Lot 123 -Construction of a new 18 lot gravel parking area, with new curb cut on Underpass Road. 12. The Board reviewed a letter from acting Zoning Agent Thyng and agreed that application be withdrawn as requested by the applicant. Motion by McMullen, Pierce second, "approve applications withdrawal" all voted in favor. 13. INFORMAL DISCUSSION -JOHN ORIELLY RE: USE OF STEEL SURVEY MARKERS INSTEAD OF CONCRETE BOUNDS TO DELINEATE THE AREAS OF FOREVER-WILD AREAS. 14. O'Reilly - I would like permission to set steel survey markers with caps instead of the concrete bounds, to delineate the "Forever Wild Areas in the Harrison Hill and Pond Oaks Subdivisions. The caps would identify the "Forever Wild Areas". This would save time and money and be less intrusive to the areas being maked. 15. The Board agreed to this for Harrison Hill but the state would need to agree for Pond Oaks. Also a formal request would need to be made to this board prior to a vote. Mr. O'Reilly agreed. 16. LEGAL HEARING -SPECIAL PERMIT #COPD2006-02 -CORRIDOR OVERLAY PROTECTION DISTRICT BYLAW - Eble/Gomes -Located at 125 Underpass Road - on Assessors' Map 27, Lot 15-2 - Change of use of existing business (Video Store) to a Real Estate Office. 17. Prior to the public hearing, the Board had requested written reports from the Department of Public Works, Police and Fire Chiefs, Board of Health, Water Department, Zoning Agent/Building Inspector and the Conservation Commission. The following reports concerning the application were received: B.O.H. - 2/7/2006 -The existing septic system is not sized adequately for the proposed change of use. Mr. O'Reilly stated that the property known as 125 Under Pass Road on Assessor's Map 27, Parcel 15- 2, contains about 34,791 square feet of area with a wood framed building, paved parking area and associated utilities currently existing on the property. The current uses of the property area 2,100 s.f. retail space along with 2-2bedroom apartments. The property has 110 feet of frontage along Underpass Road. The topography is relatively flat with a grade variation of no more than 5 to 6 feet from the front to the rear. The property also contains a portion of a small vegetated wetland and an intermittent stream. 20. The proposal calls for the change of use from retail space to an office space while keeping the two apartments. At the same time, there are no changes to the site being proposed, with the exception of striping the parking area and the addition of a second means of egress from the second floor apartments. The interior of the building will be remodeled as necessary for the intended use. 21. Sixteen (16) Parking Spaces are provided with 1 as a handicap area. The board asked about lighting and requested that the existing flood light be removed and a down projecting light be used. Dumpster will be screened with stockade fencing. 22. Motion by McMullen, Taylor second, "approve Special Permit for Eble with conditions as discussed." Roll call voted all voted in favor. 23. A brief discussion regarding the three up coming articles, it was agreed that the sign area for the event signs be changed to 100 square feet. 24. Meeting Adjourned.
