Brewster Town Office Building Date approved: SEPTEMBER 27, 2006 TOWN OF BREWSTER PLANNING BOARD September 13, 2006 -Meeting Minutes Town Hall Office Present: Henchy, McMullen, Taylor, Remy, Bugle, Tubman 8< Pierce Chairman William Henchy called the meeting to order at 7:10 p.m. 1. CONTINUED -LEGAL HEARING -SPECIAL PERMIT #SP2004-20 -CORRIDOR OVERLAY PROTECTION DISTRICT BYLAW -Smith -Located at 282 Underpass Road, on Assessors' Map 26, Lot 104-1 -Status regarding Special Permit Conditions. Dave Smith, Owner Square One Bistro stated he is renegotiating 5 more parking spaces with his neighbor, which will bring him into compliance on the parking issue. The dumpster is in the process of being screened and will be completed by September 15, 2006. Parking bumpers are being ordered and will be installed by September 22, 2006. The handicap parking space is on a hard packed surface, which is acceptable to Victor Staley. The Board requested Mr. Smith have Victor Staley send the Board a memo stating the handicap parking space meets requirements. Approval Not Required -Peter Soule/Church of Latter Day Saints -Located at 94 Freemans Way, on Assessors' Map 42, Lot 32. To create one buildable lot. Peter Soule was present for the Church of Latter Day Saints. The lot in question is west of the church and has adequate frontage. The Board was in agreement that a buildable lot could be created. MOTION To Approve MOVED by Bugle, SECOND by Tubman. All voted "AYE" The Site Plan was signed by the Board 2. LEGAL HEARING -DEFINITIVE SUBDIVISION PLAN #DEF2006-17 -Roland M. Mayo, Jr. -Located at the Southside of Freeman's Way on Assessors' Map 53 ,Lot 6-1 ~ 6-2. Subdivision of property into two lots with a new way to serve same. Henchy -read legal advertisement from Cape Codder and information regarding appeal period. Planning Board Meeting 1 of 3 September 13, 2006 Chet Slade was present for Roland Mayo, requesting approval of a Definitive Subdivision of two lots. The sight lines are adequate and stated there is no need for a street light. Henchy stated our regulations demand a street light at an intersection or end of street. Mr. Slade believes there is already a street light at the end of the street and will check before the next meeting. Henchy requested the water department conditions be specified as conditions of approval. Conditions: 1. Freeman's Way is supplied with a twelve inch (12) water main on the opposite side of the street as the proposed development. Town water is shown on the subdivision plan. There is sufficient water available for the subdivision and the captioned 8" water main is sufficient for the subdivision as long as the property continues to be developed for residential use. The Brewster Department of Public Works may require a bond or other performance surety for the road. crossing. 2. Blanket easement for water main and appurtenances should be granted along all ways. Alt easement documents must be registered at the Barnstable Registry of Deeds with a copy provided to the Water Department prior to final approval of the project. 3. All proposed water and related work must conform and comply with best industry standards, Commonwealth of Massachusetts statute and regulations and Brewster Water Department specifications. All materials used in water works construction are subject to site specific requirements as determined by the Water Superintendent. 4. Water service stubs will be required from the water main to property lines at lot centers and will be sized according to lot depth. All lots will be serviced from the subdivision. Stubs are noted on the plan but both must be 1.5" size. 5. All water construction work must be done by a Department approved installer. All water main construction including service stubs and certification shall be performed under supervision of a Department approved inspector at the developers cost. 6. All required Brewster Water Department fees shall be paid prior to the commencement of water works construction. A $2,000.00 tapping fee for the subdivision will apply to this proposal. 7. An engineer certified asbuilt plan for the water main and service stub installation must be supplied to the Department incorporating all information from the inspector's field notes and measurements. The asbuilt plan shall be delivered in ESRI ArcView shape file format or AutoCAD translatable files on floppy disc or CD and two printed copies. Detailed specifications and regulations are available from the Department office at 1671 Main Street, Brewster, MA 02631, phone number 508-896-5454. Mr. Slade will bring the mylar site plan in to be signed by the Board at the October 25, 2006 meeting. MOTION To Approve MOVED by Bugle, SECOND by Pierce All voted "AYE". Informal Discussion 3. Roger O'Day for Stanley Tenerowicz, Pine Bay Lane, located on Assessors' Map 1, lot 14. During the December 9, 2005 storm, the boathouse on the back of the house was damaged. It was realized that the boathouse was not shown on the site plan signed the Board in June 2002, although it was there. Mr. O'Day presented a new site plan with the boathouse and pictures of the cottage with the attached boathouse. Mr. Tenerowicz wants to replace the damaged boathouse with a new one in the exact same location. Mr. O'Day requested submission of the corrected plan be the plan of record. It still needs to go the Registry of Deeds. MOTION to Accept New Corrected Plan MOVED by McMullen, SECOND by Taylor All voted "AYE". Planning Board Meeting 2 of 3 September 13, 2006 Zoning Codes Due to the presence of Myer Singer, the Vesper Pond Drive Village Business District issue was addressed. Zisson and Veara, Legal Counsel for the Town of Brewster, upheld Victor Staley's opinion. If a residence is to be built in Brewster, it must have a minimum of 60,000 SF, no matter the zoning district. After much discussion by the Board, it was decided not to change the Village Business District on Vesper Pond Drive to residential. MOTION To Approve MOVED by Bugle, SECOND by Pierce All voted "AYE". 4. Roy Jones, Fire Chief Flex Bus -Roy Jones made a detailed presentation on the Flex Bus with exhibits and suggested the necessity of passable roads should be a concern of the Planning Board. Cul-de-sacs -Chief Jones requested the radius of cul-de-sacs be kept at 45 feet, a 90 ft. diameter. No plantings in the middle of the cul-de-sac is best, although possible if the circle is extraordinarily large. MOTION TO ADJOURN MOVED by Taylor, SECOND by Bugle All voted "AYE".
