Vice Chairman McMullen called the meeting to order at 7:00 p.m.
October 11, 2006 Meeting Minutes reviewed for approval
MOTION to Approve as corrected
MOVED by Taylor, SECOND by Remy.
All voted "AYE"
Roger O'Day presented the board with a new mylar of Pine Bay Lane for the Planning Board to sign. The original mylar
signed by the Planning Board was not acceptable to the Registry of Deeds because they could not scan the entire plan.
A new plan was presented and the Board signed.
LEGAL HEARING -APPROVAL NOT REQUIRED #ANR2006-20 -Town of Brewster -Stony Brook and Eddy
Elementary Schools -Located on Route 6A and Underpass Road on Assessors' Map 16, Lot 80-0-E - To provide
the opportunity to separate the elementary schools if desired.
Donald Poole, Outermost Land Survey - Charles Sumner, Brewster Town Administrator, requested a division plan of
two (2) lots for the two (2) Schools in case it became necessary to split ownership. The plan tonight is requesting
endorsement as approval not required.
McMullen asked if there were any questions from the Board
MOTION to Approve
MOVED by Taylor, SECOND by Remy.
All voted "AYE"
Mylar plan was signed.
LEGAL HEARING -CORRIDOR OVERLAY PROTECTION DISTRICT - #COPD2006-21 -William Rayburn of
Reyburn Associates, applicant; K 8~ M Investments LLC, owner -Located at 84 Underpass Road, Assessor's Map
26, Parcel 7. To convert 3 second level office units into 3 two bedroom apartments.

Taylor -Not sure how we can permit this. It's mixed use and that is not in our bylaws. Shouldn't they be going before the
ZBA?

Reyburn -Have you read the letter from Victor. We are here for a special permit.
Taylor - We don't have a bylaw for mixed use residential. We only allow one apartment above businesses right now.
Victor's letter was read by the Board.
McMullen -Interpreting Victor's letter, stated they are not changing the footprint of the building and the only change is
the apartment and therefore, doesn't require a ZBA hearing. The issue had been discussed by the DPRC. The
understanding is if the size of the building doesn't change, it can be handled under a special permit from the Planning
Board.
Reyburn agreed, if the requirements are met they would not have to go before the ZBA.
McMullen - At the DPRC meeting, Harvey agreed with the fact that the Planning Board could issue the special Permit.
It was agreed that the Board would hear all of the COPD requirements from Reyburn. Once satisfied they were in
conformance, the Board agreed to seek Town Counsel on this matter. The action item was for Taylor to draft a letter to
Town Counsel and request feedback before November 8, 2006.
McMullen suggested Reyburn and Rowles proceed with an application for a ZBA hearing, just in case.
Special Permit Discussion:
John Mostyn -Ocean Edge
The draft Special Permit was reviewed and corrections were made as follows.
1. Parking Design Standards
In section (3) a -Added - Relocating the loading area within the existing parking to allow trucks to be
unloaded off Village Drive
2. Parking Design Standards
In section (3) c -Added -and additional new parking.
3. SPECIAL PERMIT CONDITIONS
Under the Traffic heading -removed -Reduction in golf rounds from 40,000 to 24,000.
The next step is to finalize the Special Permit to be signed by the Board Chair and filed in the Town Clerk's office.
McMullen -Motion to approve the special permit as corrected.

Second by Tubman
All voted AYE
Informal Discussion:
Duane Landreth, Mr. 8 Mrs. Rylander and Phil Scholomitti
Atty. Landreth discussed with the Board their power to declare adequate access on the road at Sweetwater Forest. The
Rylanders maintain their own road with equipment used for Sweetwater Campground. They are looking to subdivide 3
acres from a 16 acre parcel to build a handicap accessible house for Mrs. Rylander. The Rylanders are hesitant to
encumber the entire parcel with the bank.
The Rylanders contend the right of way is more than a cart way. It has been maintained as the main driveway to the
campground for approximately 50 years and is wide enough and solid enough to accommodate large trucks.
After the Board's discussion regarding the dirt road issue with the Atty Landreth, the Rylanders and Phil Scholomitti, it was
decided Atty Landreth will submit a subdivision plan which will allow for conditions to be specified and would access from
