HomeMy Public PortalAboutORD15579 BILL NO. 2016-61 SPONSORED BY COUNCILMAN Henry ORDINANCE NO. /S-5-1 AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, UPDATING CHAPTER 28 OF THE CODE OF THE CITY OF JEFFERSON, MISSOURI, PERTAINING TO THE RESTAURANT AND FOOD CODE BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. Chapter 28 of the Code of the City of Jefferson, Missouri, is hereby deleted in its entirety and replaced with the following. Sec.28-1. Food code adopted by reference. The"City of Jefferson, Missouri 2017 Food Code," is hereby adopted by reference and made a part of this Code as if fully set out in its entirety. The Jefferson City, Missouri 2017 Food Code is based on the Missouri Food Code for the Food Establishments of the State of Missouri, published June 13, 2013, as amended by the City of Jefferson. The City of Jefferson,Missouri 2017 Food Code shall be made available on the City's webpage,and hard copies shall be available for public use, inspection and examination in the office of the Department of Planning and Protective Services. Sec.28-2. Fees. A. "Food Establishment" as defined in the City of Jefferson, Missouri 2017 Food Code Chapter 1 Definitions, shall pay an annual inspection fee as set out in Appendix Y. B. The annual inspection fee shall be paid to the Finance Department when the application for business license or business license renewal is submitted. C. Only one annual inspection fee shall be charged for each food establishment, even if more than one operating permit is issued. D. Food establishments shall pay a re-inspection fee as set out in Appendix Y per inspection for the second and subsequent re-inspections required to correct violations noted during the inspection process. The re-inspection fee shall be paid to the Finance Department when the next application for a business license renewal is submitted. E. Persons/Organizations conducting a temporary food event (an event lasting less than fifteen (15) days) shall pay inspection fees as set forth in Appendix Y. The temporary food event inspection fee shall be paid to the Finance Department prior to receipt of the operating permit. Fees shall be calculated using the public health priority assessment in Exhibit 28-3 and point brackets in Paragraph B. Exhibit 28-3-Public Health Priority Assessment Yes No Points Assessed 1. Public Health Priority Assessment Point Brackets. The following brackets shall be used to determine fees for this section. 1. Low Risk, Bracket 1. Food establishments scoring fewer than 0.9 points on the public health priority assessment shall assigned to Bracket 1(Low Risk)for purposes of annual inspection fees. 2. Medium Risk, Bracket 2. Food establishments scoring between 0.9 to 1.1 points shall be assigned to Bracket 2(Medium Risk)for purposes of annual inspection fees. 3. High Risk, Bracket 3. Food establishments scoring more than 1.1 points on the public health priority assessment shall be assigned to Bracket 3 (High Risk) for purposes of annual inspection fees. Sec.28-4.Penalty. Any person who violates any provision of the City of Jefferson Food Code shall be guilty of a misdemeanor punishable by a fine of not more than$500 or by imprisonment not exceeding three months or by both such fine and imprisonment. Each day that a violation continues is a separate offense. Appendix Y, Schedule of Administrative Fees, Permits, Licenses and Other Charges, is hereby amended with the addition of food inspection fee brackets, as follows.
