AUTHORIZING THE PREPARATION OF A RIGHT-OF-WAY
ACCESS AGREEMENT WITH HYPERION
COMMUNICATIONS
WHEREAS, the tom has been approached by Hyperion Communications, a
telecommunications network provider of the possibility of installing fiber optic cable
along Market Street and the outer Route 15 by-pass in Leesburg; and
WHEREAS, in order for Hyperion to proceed with this work it is necessary that
they obtain an Access Agreement from the town for use of the town's right-of-way; and
WHEREAS, this Access Agreement shall set forth the terms and conditions
Hyperion must follow with respect to facility locations, permitting, insurance and
compensations.
THEREFORE, RESOLVED by the Council of the Town of Leesburg that the
Acting Town Manager and the Deputy Town Attorney are authorized to prepare an
Access Agreement for use of the town's right-of-way, subject to final approval by the
Town Council.
