ACCEPTING A CASH PAYMENT IN LIEU OF CONSTRUCTION
FOR A PORTION OF THE FORT EVANS ROAD IMPROVEMENTS
FOR FORT EVANS PLAZA
WHEREAS, the Final Development Plan for Fort Evans Plaza includes construction of
frontage improvements along Fort Evan's Road; and
WHEREAS, the Town Council adopted Resolution #99-110 on April 13, 1999 which
authorized a contract and accepted a $950,000.00 corporate surety bond to guarantee the
installation of public improvements at Fort Evans Plaza, which includes Fort Evans Road
frontage improvements; and
WHEREAS, the developer, Fort Evans Plaza, L.P. (Uniwest), has requested that the town
accept a cash payment in lieu of construction for a portion of the ultimate median in Fort Evans
Road because the existing fight-of-way is not wide enough to install all the required lanes and the
median; and
WHEREAS, the estimated cost of the proposed deferred improvements is $15,000.00;
and
WHEREAS, all the frontage improvements must be installed or paid for by the developer
to comply with the town's Subdivision and Land Development Regulations; and
WHEREAS, deferral of the median construction will not adversely effect the public use
of Fort Evans Road.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:

FOR A PORTION OF THE FORT EVANS ROAD IMPROVEMENTS
FOR FORT EVANS PLAZA
SECTION I. The Town Council hereby accepts a cash payment of $15,000.00 in lieu of
construction of approximately 250 feet of raised median in Fort Evans Road between Station
24+00 and Station 26+50.
SECTION II. The $15,000.00 shall be held in a capital project account to be used for the
installation of the median as described in Section I above by the town or other parties as
authorized by the town.
