The proposal includes the construction of an approximately 44,000 sf building and a variety of outdoor recreational fields on a 16.5 acre site. The property is located on the east side of Christy Drive three quarters of a mile south of Ellis Boulevard on property currently used as a rock quarry. The property is described as part of the East Half of the Southeast Quarter of Section 23 and part of the Northwest Quarter of the Southwest Quarter of Section 24, Township 44 North, Range 12 West, Jefferson City, Missouri (Central Missouri Professional Services, Consultant). Case No. B16006 — 2527 E. McCarty Street; Conditional Use Permit for Mini- Warehouse/Storage Sheds and Driveway Width and Bufferyard Variances. Application filed by Don Renkemeyer, property owner, for the following: 1. A conditional use permit to construct mini-warehouses in a C-2 zoning district. 2. A variance of 6 feet from the standard 30 feet drive lane width between storage buildings to permit a drive lane width of 24 feet and a variance of 6 feet from the standard 24 feet drive lane width for a storage building on one side to permit a drive lane width of 18 feet (Section 35-41.B.15.b.(2).(a)). 3. A quorum was present to hear the items on the agenda. The following members were designated to vote: Hake, Lacy, Partee, Rimiller and Young. Those wishing to speak to the Board were sworn in. 2. Procedures Explained Chairwoman Partee explained the procedures of the meeting. Mr. Barron entered the following documents as exhibits for all items under consideration at the meeting: 1. Minutes/Jefferson City Board of Adjustment Page 2 September 13, 2016 6. New Business —Public Hearing Case No. B16004— 310 and 312 West Elm Street; Lot Width and Street Frontage Variances. Application filed by Phoenix Healthcare Realty Holdings LLC, property owner, for the following: 1. An 8 feet variance from the 60 feet minimum lot width of the RA-2 zoning district to permit a lot width of 52 feet(Section 35-50.A Lot Dimensional Standards). 2. A variance from requirement of a lot to have street frontage to permit a lot to be platted with frontage on an alley (Section 35-50.C.1 Street Access). The purpose of the request is to permit the property, which is currently developed with two houses fronting on Elm Street and a commercial parking lot in the rear, to be divided into three lots (two residential lots fronting on Elm Street and one commercial parking lot with access from an alley). The property is located on the north side of West Elm Street 150 feet west of Broadway Street and is described as Inlot 686, Jefferson City, Missouri (Bartlett and West, Consultant). Mr. Barron described the proposal and explained that this property consists of a single tract with two houses, each of which had been converted into a two unit building, and a parking lot at the rear of the property. He stated that both houses are vacant and one is in a state of severe dilapidation and in need of demolition. Mr. Barron explained that the property was recently acquired by Phoenix Healthcare, who has offices located at 500 Broadway Street. He stated that they are interested in the parking lot portion of the property only with no desire to retain ownership of the houses. Mr. Barron explained that they submitted a plan that would divide the property into three lots, one lot for each house and one for the parking lot. He stated that in order to move forward with this property division plan, variances from lot width requirements and from the street frontage requirement, for the parking lot, would be required. Mr. Barron explained that if approved, the property owner would then proceed with submittal of a subdivision plat to divide the property into three lots and a rezoning application to realign the C-2/RA-2 zoning boundary along the new property line. He stated that the Elm Street frontage is quite steep, and not ideal for driveway access. Mr. Barron explained that in order to allow for vehicular access to the two residential lots, the owner is planning to place easements through the parking lot to access the rear of each lot. He stated that while parking lots with sole access from an alley are ideal, especially in historic areas of the City, buildings that rely solely on alley access are not ideal. Mr. Barron explained that in order to prevent any future use of the rear tract as a building lot, staff recommend a condition placed on the approval of the street frontage variance that no permanent structure be permitted on the property. Mr. Jeff Buker, Phoenix Healthcare Holdings, LLC, 312 Deerfield Place, spoke regarding this request. Mr. Buker explained that Phoenix Healthcare Holdings LLC recently purchased the property. He stated that their goal is to occupy the parking lot for additional parking in order to keep congestion off of the street. Mr. Buker explained that the lot is also used by residents in that area and he does not have any current issues with that. He stated that they have no interest in the adjacent houses. Mr. Buker explained that the house to the west will remain intact however the log cabin would need to be demolished. Mr. Mike Prenger, 902 Tanya Lynn Drive, had questions regarding drainage and side setbacks. Mr. Barron explained that no additional construction is proposed. He explained that side setbacks would adhere to City Code and would be 10 feet or less. No one spoke in opposition to this request and no correspondence was received. Mr. Barron explained that the required findings appear to be met. He stated the lot width variances would allow for platting of lots around existing residential structures and would be similar in scale to the existing lots in the neighborhood. Mr. Barron explained that the creation of a parking lot with sole access to an alley is an ideal feature for the older historic areas of the City, as it allows for necessary parking while not impacting the street line or character of a street. He stated that Staff recommends a condition that no permanent structure is permitted on the parking lot tract. Ms. Young moved and Ms. Lacy seconded to approve the requested variance of 8 feet from the 60 feet minimum lot width of the RA-2 zoning district to permit two lots with a width of 52 feet each. NATURE OF REQUEST Special Olympics of Missouri is planning to construct their Training for Life Campus in Jefferson City on a site on Christy Drive, and is in the process of acquiring the site. The subject property is a portion of the rock quarry that has been in operation for many years. The facility would consist of a 44,000 sf building, approximately 160 parking spaces, and a variety of outdoor athletic fields including soccer fields, track and field, softball, tennis, bocce courts, and golf. Commercially operated outdoor recreational facilities are a conditional use in the C-2 zoning district. The building and parking areas are arranged at the southern side of the site with direct access to Christy Drive. Sidewalks are shown along the access driveway/road and within the site for internal pedestrian circulation. Water, sewer, gas, telephone, and electric utilities are shown on the plan. A variety of athletic fields are shown at the northern side of the site, and it is understood that the exact arrangement and type of outdoor athletic fields may change over time as Special Olympics works to meet the needs of their customers. Outdoor lighting impacts on nearby property, which are typically the major concern with respect to outdoor recreational fields,are largely negated due to the high rock quarry walls. A conditional use permit to construct mini-warehouses in a C-2 zoning district. 2. A variance of 6 feet from the standard 30 feet drive lane width between storage buildings to permit a drive lane width of 24 feet and a variance of 6 feet from the standard 24 feet drive lane width for a storage building on one side to permit a drive lane width of 18 feet(Section 35-41.B.I 5.b.(2).(a)). 3. A variance from the requirement to install a screening fence on the southern side of the property adjacent to Hideaway Court(Section 35-41.B.15.b.(1)). 4. A variance from the bufferyard standards to permit a zero foot bufferyard on the west and south property lines(Section 35-59). The purpose of the request is to permit the expansion of the neighboring storage shed business on to the property. The property is located toward the rear of the property addressed as 2527 E. McCarty Street and is accessible via Hideaway Court. The property is described as part of Reserved Tract #1 of Mount Hope Heights Subdivision,Jefferson City, Missouri. PUBLIC NOTICE By publication in the newspaper, letter to adjacent and affected property owners within 185 feet, and by property sign posting. NATURE OF REQUEST The owner recently acquired the subject property, which was split from the adjacent property to the west and rezoned from RA-2 to C-2. The owner also owns the property to the east of the subject site, which is developed as a mini-warehouse/self-storage facility. The owner wishes to develop the subject property as an expansion of the adjacent self-storage facility. Mini-warehouses/self-storage facilities are a conditional use of the C-2 zoning district. The development of the site is complicated due to the presence of a private road named Hideaway Court. The road is a gravel road that serves two single family residential homes. The road is located on the applicants property, and no known easement exists to define the boundaries, maintenance, etc. of the road (although an easement by use presumably exists for the two single family properties, which have used the road for many years as the sole access to their property). In addition to seeking a conditional use permit for a mini-warehouse/self-storage facility, the owner is seeking several variances from zoning code requirements, as follows: - A variance from the driveway width requirements for mini-warehouses/self-storage facilities. The specific use standards of the Zoning Code require a 30 feet wide driveway between storage shed buildings. In an effort to fit the driveways with minimal impact to a private road serving houses at the southern side of the site, the owner is requesting a 24 feet wide drive lane. - A variance from the requirement to install a screening fence on the southern side of the property adjacent to Hideaway Court. Placement of a fence could be problematic given the competing needs for vehicle circulation, stormwater drainage, and maintaining access in the vicinity of the private road. The applicant has been in contact with one of the single family home property owners, who has expressed (in writing to the applicant) that they have no preference one way or another regarding the presence of a screening fence. A fence is shown along the western property line (currently shown as a chain link fence but would be required to be a solid screening fence). - A variance from the bufferyard requirements for the southern and western property lines. The Zoning Code calls for a bufferyard where commercial zones abut residential zones. In this case, the requirement would be for a minimum 10 feet wide area along the western property line with a row of trees planted at 20 feet intervals and a 25 feet wide area along the Case No. B 16006 November 8, 2016 Planning Staff Report Page 2 boundary with the single family residential properties with a 6 feet tall fence and trees planted at 25 feet intervals. Placement of the bufferyard along the boundary with the single family lots would be problematic due to the presence of the private road and placement of the bufferyard along the western property line would confine the site design with little benefit to screening from the currently undeveloped adjacent property. A 35 feet wide natural bufferyard is shown along the northern property line in accordance with zoning code requirements. Stormwater Drainage—although the stormwater drainage plan is not clearly indicated on the site plan submitted with the conditional use permit application, consultation between city staff the applicant reveals that the stormwater drainage plan is to construct the driveways with swales in the middle that would collect the stormwater and send it east to the applicants other property, where it would drain through an existing grass ditch and then down to the public system along McCarty Street. Submittal and approval of a professional site plan, prepared by a registered engineer, would be necessary prior to issuance of a building permit. This site plan would be required to document compliance with all applicable city codes, including stormwater drainage requirements, prior to administrative approval by city staff.
