AN ORDINANCE AMENDING ARTICLE 14.06 OF CHAPTER 154 OF THE
MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY KNOWN
AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA,
ADOPTED JUNE 3, 1968.
WHEREAS, it is the intent and purpose hereof to amend Article
14.06 of Chapter 154 of the Municipal Code, commonly
known as the Zoning Ordinance of the City of Richmond,
Indiana; and,
WHEREAS, a study of this Ordinance was conducted by the Richmond
City Plan Commission the 27th day of January 1981, at
which time remonstrances were heard from all parties
interested in or affected by this Ordinance.
WHEREAS, the vote of the Richmond City Plan Commission was ten
(10) to zero (0) in favor of recommending the passage
of Ordinance No. 5-1981.
NOW THEREFORE BE IT ORDAINED by the Common Council of the City
of Richmond, Indiana, as follows:
SECTION 1. That Article 14.06 of Chapter 154 of the Municipal
Code shall read amended as follows:
14.06 Property Not Included: In every case where
property has not been specifically included
within a district, the same is hereby declared
to be in the R-1 District.
SECTION 2. This Ordinance shall be in full force and effect from
and after its passage and approval as by law required.
PASSED AND ADOPTED by the Common Council of the City of Richmond,

Dear Mr. Mills, Members of Common Council and Mrs. Trimble:
The Richmond City Plan Commission conducted a public hearing on Tues-
day, January 27, 1981, on its own petition seeking to amend Article
14.06 of the Zoning Ordinance.
Article 14.06 as presently written specifies that newly annexed terri-
tory shall become a part of the R-1 zoning district upon annexation
as a temporary zoning classification, and that the Plan Commission
shall recommend to Council a final zoning plan for the area within
six (6) months of the annexation. The proposed amendment rewrites
Article 14.06 to read as follows:
14.06 Property Not Included: In every case where property
has not been spec' ically included within a district,
the same is hereby declared to be in the R-1 District.
During the public hearing, no one spoke in opposition to or in favor
of the petition.
The Plan Commission considered the following facts in making their
determination:
1. with the acquisition of the two mile fringe jurisdictional
area, Article 14.06 as presently written is no longer func-
tional as newly annexed territory would necessarily be
situated in the fringe area where the final zoning plan
has already been established.
2. The proposed amendment uould eliminate redundant paperwork
and public hearings.

Therefore, the Plan Commission voted ten (10) to zero (0) to recommend
that Ordinance No. 5-1981 be approved.
