HomeMy Public PortalAbout010-1981 - Zoniong - 70 to 80 ft Ft Wayne Ave - 115 and 119-121 N. 5thGENERAL ORDINANCE NO. 10-1981 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968, PROVIDING FOR THE REZONING OF 70 THROUGH 80 FT.WAYNE AVENUE AND 115 AND 119-121 NORTH 51H STREET FROM R-3 ONE -TO -EIGHT FAMILY RESIDENCE DISTRICT TO C-4 GENERAL BUSINESS DIS- TRICT. WHEREAS, the Zoning Map which is part of Ordinance No. 2325-1968 designates and describes as P,3 One -to -Eight Family Residence District, the property located at 70 through 80 Ft.Wayne Avenue and 115 and 119-121 North 5th Street in the City of Richmond, Indiana; and, WHEREAS, it is the intent and purpose hereof to change the zoning classi- fication of said property from R-3 One -to -Eight Family Residence District to C-4 General Business District; and, W11ERFA.S, a study of this Ordinance was conducted by the Richmond City Plan Commission the 24th day of March, 1981, at which time remonstrances were heard from all parties interested in or affected by this Ordi- nance; and, WHEREAS, the vote of the Richmond City Plan Comnission was eight (8) to zero (0) in favor of recommending the passage of Ordinance No. 10-1981. NOW THEREFORE BE IT ORDAINED by the Cocoon Council of the City of Richmond, Indiana, as follows: SECTION 1. That the zoning classification of the property described below be, and the same is hereby changed to C-4 General Business District, and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana and all amendments thereto. A part of Lot Number Ten (10) in that part of the City of Richmond laid out by Jeremiah Cox and bounded as follows, to wit: Beginning at a point in the north line of said lot and sixty-nine (69) feet West of the northeast corner thereof; thence South thirty-nine and four tenths (39.4) feet to a fence; thence West to the east line of North 5th Street; thence North along the east line of North 5th Street; thence North along the east line of North 5th Street to the north line of said Lot Ten (10); thence East along said north line to the place of beginning. ALSO: A part of Lots Numbered Nine (9) and Ten (10) in that part of the City of Richmond laid out by Jeremiah Cox, and described as follows: Beginning at a point on the west line of Ft. Wayne Avenue Fifty-five and eighty-eight hundredths (55.88) feet Southwest of intersection of Ft. Wayne Avenue, and south line of first alley North of said Lot Number Ten (10), and running thence in a North- westerly direction ninety (90) degrees sixteen (16) minutes left thirty-one and eight tenths (31.8) feet; thence eighty-nine (89) degrees twelve (12) minutes left eight and five tenths (8.5) feet; thence sixty-one (61) degrees twenty-three (23) minutes right seventy-five and five tenths (75.5) feet to the east line of North Fifth Street; thence South along the east line of North Fifth Street one hundred thirty and thirty-nine hundredths (130.39) feet to north line of an alley and being in the south line of said Lot Number Nine (9); thence East along north line of said alley nine and twenty- eight hundredths (9.28) feet to the west line of Ft. Wayne Avenue; thence North along the west line of Ft. Wayne Avenue one hundred thirty-four and ninety-six hundredths (134.96) feet to the place of beginning. Subject, hxnaever, to agreement for widening of Ft. Wayne Avenue as shown in Plat Book 6, page 149 of the records of the Recorder of Wayne County, Indiana. ALSO: Part of Lot Numbered Ten (10) in that part of the City of Richmond laid out by Jeremiah Cox and boundred as follows, to wit: General Ordinance No. 10-1981 Page TW Beginning at the northeast corner of said lot and running thence Southwardly along the west side of Fort Wayne Avenue, fifty-five (55) feet to a fence; thence westwardly along said fence, thirty-one (31) feet; thence a little West of South along a fence eight (8) feet and six (6) inches; thence West along a fence, eleven (11) feet; thence Northwestwardly along a fence thirty-nine (39) feet and four (4) inches to the north line of said Lot; thence Fast along the north line of said lot sixty- nine (69) feet and six (6) inches to the place of beginning. SECTION 2. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. April 3, 1981 Mr. Kenneth Mills, President Members of Common Council & Mrs. JoEllen Trimble, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 10-1981 Plan Commission Case PC-81-6 Dear Mr. Mills, Members of Common Council & Mrs. Trimble: The Richmond City Plan Commission conducted a public hearing on Tuesday, March 24, 1981, on the petition of Harold and Marion Reisert; Gayle Gardner, Agent, requesting a zone change for property located at 70, 78 and 80 Ft. Wayne Avenue and 115, 119 and 121 North 5th Street from R-3 One -to -Eight Family Residence to C-4 General Business District. Fourteen (14) notices of public hearing were sent to adjoin- ing property owners with two (2) returned in opposition to granting the request. During the public hearing, two (2) persons spoke in opposition to granting the request. The Master Plan designation for the area in question is indus- trial. Present land use in the area is a mix of older declining residential structures and C-4 commercial uses. The requested C-4 zoning is compatible with existing land use in the general area and shall not harm adjoining property values.
