HomeMy Public PortalAbout011-1981 - Zoniong - Special Use - 216 S. 4thSPECIAL ORDINANCE NO. 11-1981 AN ORDINANCE AUTHORIZING A SPECIAL USE IN A R-3 ONE -TO -EIGHT FAMILY RESIDENTIAL DISTRICT FOR A PROFESSIONAL OFFICE ON PROPERTY LOCATED AT 216 SOUIH 41H STREET PURSUANT TO ARTICLES 48 AND 22.012 OF CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY KN9,1N AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA. WHEREAS, Article 34.013 of Chapter 154 of the Municipal Code allows a professional office by Special Use authorization as pro- vided in Article 48 of said Chapter; and, WHEREAS, a notice was given and a public hearing on this Ordinance was conducted by the Richmond City Plan Commission the 24th day of March, 1981, at which time remonstrances were heard from all parties interested in or affected by this Ordinance; and, W9NMREAS, the vote of the Richmond City Plan Commission was eight (8) to zero (0) in favor of recommending the passage of Ordinance No. 11-1981. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, Indiana as follows: SECTION 1. As provided in Article 34.013 of Chapter 154 of the Municipal Code, the following described use of the following described real estate is allowed as a Special Use for a professional office at 216 South 4th Street in the City of Richmond, Indiana; more particularly described; to wit: Lot No. Fifty-three (53) in that part of the City of Richmond, Indiana, laid out by John Smith, EXCEPT: forty (40) feet off of the south side of said lot and a right-of-way ten (10) feet in width off the west end of said lot, which right-of-way is an easement appurtenant to that part of the said lot which is forty (40) feet in width off the south side of said lot. SECTION 2. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. ATTEST: City -Clerk CITY PLAN COMMISSION RICHMOND, INDIANA i.061y, April 3, 1981 Mr. Kenneth Mills, President Members of Common Council & Mrs. JoEllen Trimble, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 11-1981 Plan Commission Case PC-81-7 Dear Mr. Mills, Members of Common Council & Mrs. Trimble: The Richmond City Plan Commission held a public hearing on Tues- day, March 24, 1981, on the petition of Charles V. and June E. Livengood; Terry O'Maley, Agent, requesting Special Use authoriza- tion for a proposed law office on property located at 216 South 4th Street. Seven (7) notices of public hearing were sent to adjoining pro- perty owners with one (1) returned in favor of granting the request. During the public hearing, no one spoke in opposition to the request. The Plan Commission determined that the request does fulfill the requirements of Article 48 and 22.012 of the Zoning Ordinance regarding the granting of a Special Use. The subject residen- tial structure is presently being used as Charles Livengood's law office. This use was authorized as a home occupation in 1969. Mr. Livengood no longer lives at the subject address and attorney Terry O'Maley, who proposes to buy the property, does not plan to live there so that a Special Use is necessary to continue the law office use of the subject property.
