Your requests were approved based on a finding that the proposed improvements meet the minimum intent of the Design Manual and applicable review standards with the condition that the gates be removed, the new landscaping be moved out of the town's right -of -way and prior to the issuance of a certificate of occupancy, the property owner shall prepare and record a deed restriction, which shall provide that all roof projection areas be required to remain unenclosed as per approval of the special exception for as long as the structure is in existence or exceeds the maximum permissible FAR If a building permit is not applied for by June 1, 2008, these approvals will expire.
